January 4, 1971
Regular meeting of the Kent City Council was called to order at
7 :00 p.m. Present: Mayor Hogan, Councilmen: Baffaro, Barnier,
Clements, Elliott, Lee, Martell and Masters, City Administrator
Street, City Attorney Mirk, City Engineer Sherwood and Planning
Director Harris
Barnier moved to approve minutes of the last meeting with the
following correction: On Page 3 , under Budget, include the informa-
tion that neither Barnier nor Baffaro voted on this ordinance, since
neither had arrived as yet. Baffaro seconded, motion carried .
HEALTH & Sewer Rates. The City Attorney introduced
SANITATION Ordinance 1702 , amending Section 1 of Ordinance
1699, establishing a new schedule for sewer charges .
LEE MOVED for passage of the ordinance, Barnier
seconded, motion carried.
Des Moines Sewer District. Upon the City Engineer ' s
recommendation, BARNIER MOVED to approve Des Moines
Sewer District Resolution 1970-37, wherein the
district proposes to extend sanitary sewers along
S. 216th west of Highway 99 , Martell seconded,
motirn carried .
STREETS LID 260 - Off Street Parking. MARTELL MOVED to
accept as complete the contract with LDL Land
Developers for LID 260, Elliott seconded, motion
carried.
RAILROAD Auto Marshalling Complex. BAFFARO MOVED to
authorize the release of the $500 cash bond
posted by the contractor, F. J. Schade, Inc. on
the completed water main extension project for
the auto marshalling complex, Barnier seconded,
motion carried .
COMMUNICATIONS , LEE MOVED to authorize the Mayor to sign a
"termination" agreement with Pacific Northwest
Bell for Series 100 PBX system for the new city
hall , under which the city agrees to keep the
equipment for three years , Clements seconded,
motion carried.
BIDS Wood Chipper. It was noted that action on award
of the wood chipperbid would be delayed, since only
one machine has been demonstrated .
Fuel Oil. The following bids were received to
furnish fuel oil and heavy oil for 1971:

Suburban Fuel $ .1548 per gal - -
City Transfer $ .1568 per gal $5 .51 bbl
MARTELL MOVED to accept the bid of Suburban Fuel
at $ .1548 per gallon for P.S. 200 and the bid of
City Transfer at $5 .51 bbl . for P .S. 300 . Elliott
seconded , motion carried.
VRPC Mr. Street reported that he had reviewed payments
made by Kent to the Valley Regional Planning Commission,
noting that prior to 1969, flat fees were paid. In
1969 , a per capita figure of 30(,' was utilized and Kent
paid $4500 . Because of the problems involved in 1970 ,
only the first quarterly payment of $1 ,'250 was made.
He noted that VRPC has some assets in office furniture
which should be sold. At a per capita cost of between
8G and 9(,, it would cost Kent approximately $1, 400 .
The City Attorney recommends that notice be given to
the other member cities that Kent is prepared to pay
such a proportionate share and to request that the
other cities do the same to eliminate any moral or
legal liability the member cities have . MASTERS MOVED
to direct the Mayor to inform each of the member cities
of this proposal and request that they enter into such a
solution, Clements seconded, motion carried .
ZONING Bay Construction Property. ELLIOTT MOVED to
request the Planning Commission to hold a public
hearing to consider a rezone from R-1 to R-3 , for
the Bay Construction property, Masters seconded,
motion carried. It was noted that this zoning
is to be considered in conjunction with the ex-
tension of Reith Road through this property.
O 'Connell Annexation. It was noted that the
Boundary Review Board has elected to review the
proposed O'Connell Annexation, including considera-
tion of zoning to be proposed by the City for this
property. The future plans for the Kent/Tukwila
boundary lines and the question of the avilability
of utilities must also be considered. Upon the
recommendation of the City Administrator, ELLIOTT
MOVED to request the Planning Commission to hold a
public hearing on the proposed zoning of the O'Connell
Annexation and for the Annexation Committee to meet
with the Tukwila Annexation Committee to discuss a
common city limits boundary, Masters seconded, motion
carried.
RETIREMENT It was noted that on January 22, 1971, the Statewide
SYSTEM City Employees Retirement System will have a public
hearing in Seattle on the proposed consolidation of
the Statewide system with the State Employees System
(PERS) . This consolidation would eliminate the
Statewide system. Upon Lee ' s query, Mr. Street ex-
plained that the Council had opposed consolidation of
these two systems, but had been in favor of consolida-
tion of all systems. He explained that Statewide costs
are based upon age at the time of joining, while the
PERS cost is 5% for the employee and 6.1% for the City.
Advantages and disadvantages of both systems were dis-
cussed, and upon Mr. Street ' s recommendation, MASTERS
MOVED for the Council to favor the consolidation of
the Statewide City Employees Retirement System with
the State (PERS) , Elliott seconded. Lee spoke in
favor of delaying a decision until after the hearing.
Motion failed, by unanimous vote.
CLEMENTS MOVED to authorize Lee to represent the
City at the meeting of January 22nd, Barnier seconded ,
motion carried. Street noted that he was a board
member of Statewide, an d as such would represent employees .
He noted he would discuss the proposed consolidation with
Kent employees and report at the next workshop, so that
the Council would be informed before Lee attended the
hearing on the 22nd.
FINANCE MARTELL MOVED to pay the bills received on or before
January 20, 1971 , and chargable to the 1970 budget,
after approval by the Finance Committee, Barnier seconded,
motion carried.
MARTELL MOVED that the bills received on or before January
5 , 1971, and approved by the Finance Committee, be paid,
Barnier seconded, motion carried .
