December 21 , 1970
Regular meeting of the Kent City Council was called to order at
7 :00 p.m. Present: Mayor Hogan, Councilmen: Baffaro, Barnier,
Clements, Elliott, Lee, Martell and Masters , City Administrator
Street, City Attorney Mirk and City Engineer Sherwood
Minutes of the meeting of December 7 and 14 were approved as
printed and accepted by motion.
STREETS LID 260 - Supplementary Roll . MASTERS MOVED
that the Council acting as a committee-of-the-
whole reviewed each protest to the Supplementary
Roll of LI.D 260 and find no justification for
changing said roll . Martell seconded , motion
carried. The City Attorney read Ordinance 1701 ,
confirming the Supplementary Roll for LID 260 .
CLEMENTS MOVED for passage of the ordinance,
Martell seconded . Under discussion, Lee opined
that the City could have given some relief to
alleviate this additional burden, but did not do
SO. Motion carried , with Lee voting nay.
East Valley Highway at SR 167. MARTELL MOVED
to approve Change Order #1 for the traffic signal
and ramp widening project in the amount of $161 .00
for Butler Construction, Barnier seconded, motion
carried.
Improvement of Intersection of SR 516 & S.E. 256th.
Upon the City Engineer ' s recommendation, MARTELL
MOVED to grant a time extension to Moss Construction
until January 15 , 1971 without penalty. Masters
seconded , motion carried .
LID 258 4th Avenue Improvement. A letter from
Dennis Scott was read requesting a time extension
for LDL Land Development Co. to cover repairs to the
sanitary sewer. MASTERS MOVED for approval of the
time extension from December 11 , 1970 to January 8,
1971 and for the contractor to reimburse the City
for all engineering and inspection costs incurred
beyond the original date of completion Elliott
seconded, motion carried.
LID 265 , Pacific Highway S. It was noted that the
State Highway Department has agreed to have the
city ' s contractor do the improvement work on the
intersections, which were not part of the LID,
at an estimated cost of $27, 000 . ELLIOTT MOVED
to authorize the Mayor to sign a contract with the High-
way Department in which the City agrees to include
this work in our call for bids and for which the State
will reimburse the City. Masters seconded, motion
carried.
HEALTH & LID 259 , Horseshoe Acres Sewer. MASTERS MOVED for
SANITATION the City to enter into a contract with Dames & Moore
for soils analysis at an estimated cost of $3500 to
$3900 . Clements seconded, motion carried.
Sewer Rates. Ordinance 1699 was introduced by the
City Attorney covering the new Metro sewer charges.
LEE MOVED for passage of the ordinance, Elliott
seconded, motion carried. It was noted that this
is a temporary measure in that it is proposed to
submit a new ordinance later in the year which will
update the present ordinance.
Bids - James Street Sewer Repair. Mr. Street reported
that LDL Land Development Co. was low bidder on the
James Street sewer repair project at $17 , 447.33 . He
noted that the project is already underway.
POLICE & Masters reported that Fireman Larry Stormant
FIRE has just completed a course in the Fire Ser-
vice Medic Training Program, an extensive
first aid program.
MASTERS MOVED to authorize the Mayor to sign
the Sea-King Alert Agreement for 1971, Mar-
tell seconded, motion carried.
MARTELL MOVED to authorize the Mayor to sign
the contract with the Department of Motor
Vehicles for reimbursement to the City of Kent
Police Department $125 .00 per month for informa-
tion regarding certain types of accidents,
Masters seconded, motion carried.
BIDS Wood Chipper. It was noted that bids for a
wood chipper were received December 15th and
that a recommendation will be made after the
demonstration.
S. 268th Improvement, From Military Road to
Princeton Ave. The City Engineer reported that
Slayton & Sons were low bidders on this project
at $11 , 619 .05 . The next low bidders were: Scott ' s
Bulldozing, $12 , 157.50 and T. J. McCann & Sons, Inc.
$13, 618.80. He stated that he had requested informa-
tion from Slayton & Sons as to previous projects they
had completed, but that the letter was not very
specific. The City Engineer recommended that since
they will be required to post a performance bond, he
saw no reason to delay the awarding of the bid . LEE
MOVED to accept the low bid of Slayton & Sons, Barnier
seconded, motion carried.
Blue Banner Roof. It was noted that no bids were
received for repairing the Blue Banner roof, there-
fore a new bid call will be issued.
BUDGET The City Attorney read Ordinance 1700 , adopting the
Corrected-Refer to 1971 budget. ELLIOTT MOVED for passage of the ordi-

PERSONNEL, The City Attorney read Ordinance 1698, amending
HOLIDAYS the present personnel ordinance to coincide with
national policy, regarding adoption of certain
Mondays to replace national holidays. MASTERS MOVED
for passage of the ordinance, Clements seconded, motion
carried.
LEASE ELLIOTT MOVED to authorize the Mayor to sign a lease
with the State of Washington for office space in the
city shops for the state electrical inspector at $75 .00
per month. Barnier seconded, motion carried.
CLAIM - Upon the City Attorney' s recommendation, MARTELL MOVED
to deny the Wight claim in the amount of $25 ,000,
Masters seconded, motion carried.
ANNEXATIONS Elliott reported that there will be a meeting of the
annexation committee, December 22 at 11:00 a.m.
ZONING Kaltenbach. The City Attorney introduced Ordinance
1696, zoning portions of the Kaltenbach Annexation
R-A and M-A. MASTERS MOVED for passage of the ordi-
nance, Lee seconded, motion carried.
McCann. The City Attorney introduced Ordinance 1697,
zoning the McCann Annexation R-A. ELLIOTT MOVED for
passage of the ordinance, Masters seconded, motion
carried.
OPTION Mayor Hogan noted that a proposed option for the IOOF
IOOF Hall was discussed at a workshop session . LEE MOVED
BUILDING for a $500 option to be taken on the IOOF Hall and for
an MAI appraisal to be included in the option. Motion
failed for lack of a second. Mayor Hogan noted that
this is included in the Hohn Graham Plan for a green
belt in the City.
UNDERGROUND It was noted that Ordinance 1695 (Underground
WIRING Wiring) was passed on December 7th and was vetoed
by Mayor Hogan on December 16th. The City Attorney
stated that the ordinance could be referred to the
December 28th council workshop . MASTERS MOVED to
adopt Ordinance 1695 and for consideration of the
Mayor ' s comments to be handled by an amending ordi-
nance, Martell seconded. Under discussion, Lee
opined that it should go to the Council committee
and Chamber committee with time allowed for their
recommendations on the amendments. MASTERS WITHDREW
her motion and Martell withdrew his second, in order
to defer discussion. until Baff aro & Barnier arrived.
Upon their arrival , Mr. Street explained that the
Council could overrule the Mayor ' s veto, which
requires 5 affirmative votes, or the Council may
make a motion to refer the matter to a work
session for discussion, and then vote on the
ordinance prepared for consideration, noting that
this ordinance cannot be changed between the time
of passage and the time of resubmittal . He noted
that if the veto was sustained the City would then
be operating under the old underground wiring
ordinance, and the arterial street programs would
be delayed. MASTERS MOVED for passage of the
ordinance , with Mayor Hogan ' s objections to be
considered as future amendments, Martell seconded .
Motion carried unanimously. Mayor Hogan suggested
the matter be further discussed at the December
28th workshop.
HISTORIAN It was noted that Mayor Hogan has accepted the
offer of Clarence Shoff to be official Historian
for the City of Kent and has appointed him to this
office .
PROCLAMATION Mayor Hogan proclaimed the week of December 20-26
as Prisoner of War Week and urged the citizens to
show their respect and concern for these serviceman.
FINANCE Claims received through December 7th, for which
authorization for payment was given at the last
meeting.
