HomeMy WebLinkAboutCity Council Meeting - Council - Minutes - 05/18/1970 Kent, Washington May 18, 1970 Regular meeting of the Kent City Council was called to order at 7:00 p.m. Present: Mayor Hogan, Councilmen: Baff aro, Barnier, Clements, Elliott, Lee, Martell and Masters, City Administrator Street, City Attorney Mirk, and City Engineer Sherwood Minutes of the last meeting were approved as printed and accepted by motion. STREETS LID 260 Off Street Parking. Assistant City Engineer Joe Engeln explained that the purpose of the project is to create two off street park- ing lots, He defined the boundaries of the proposed LID and noted that the LID- is segregated into two zones. Credits for parking spaces already provided are based on 400 sq. ft. for Zone 1 and 200 sq. ft. for Zone 2. The assessments in Zone 1 are based at $1 .14 per sq. ft. for the net area, totaling $334, 644.88 and assessments in Zone 2 are based at $.61 sq. ft. for the net area, totaling $336,021.74. The total cost of the LID is $670 , 666.62 . Engeln noted that improvements will consist of surfacing the lots with asphalt concrete. Sidewalks, lighting and tree planting will be included. Mr. Street ex- plained that financing is proposed as a 10 year LID with 10 annual payments over 12 years. The public hearing was opened. Written protests were read from Valley Finance- of I- ing County, J. P. Curran for Timco, Albert C. Eaden, Trustee for the Estate of E. 13. Carroll, Nels E. Mattson, A. S. Leeper, H M H Investment Co. , Gwinn Construction, J. Martin Anderson, Charles Eckland, Stokley Van Camp, St, Anthonys Church, B. J. Petrovich, Dora and Mr. R. Lamphear, Donald & Elsie Hellickson and James A. Sunden. A letter was read from Burlington Northern Railroad stating that Item 83 , for which they were assessed, is property that is leased to the City for a Park. A letter was also read from Harold heath stating that he had no objections to his assessments. There were no further comments from the audience and LEE MOVED to close the hearing, Martell seconded, motion carried. MASTERS MOVED for the Council to sit as a committee of the whole as a Board of Appeals to consider each protest, Martell seconded, motion carried. This meeting was then scheduled for Wednesday, May 20th at 7:30 p.m. Upon a query from the audience, Mr. Street stated that those protesting would be heard on Wednesday evening if they wished. MASTERS MOVED for the Council to hold a special meeting at 7:00 p.m. , Monday, May 25th for the purpose of hearing the findings of the council acting as a committee of the whole, and to consider passage of an ordinance adopting the LID 260 assessment roll, Martell seconded, motion. carried . LID 257 James Street. ELLIOTT MOVED to approve Change Order #1 to Red-Samm Mining Co. , Contract A and Change Order #2 to Butler Construction Co. , Contract B. , Clements seconded, motion carried. Alley Vacation. A petition signed by the majority of ORRECTED REFER TO the property owners along a platted alley in Blocks 1 *' and 4, Clark ' s 2nd Addition, requests that this alley IINUTES OF 4 j_ 70 be opened. The alley is between Clark and Kennebec, running from James to Temperance. It was noted that the estimated cost of this project is $561 .72, MASTERS MOVED to acknowledge receipt of the petition and to forward it to the Police, Fire and Street Committees for determination, Barnier seconded, motion carried. WATER S. 218th Reservoir Site. MARTELL MOVED to approve Change Order #1 to Atlas Construction Co. on the 218th St. Reservoir contract, Barnier seconded, motion carried. It was pointed out that there is no monetary 'change in they contract, but it does change the Federal wage rate scale to the new scale effective after July 5 , 1970. This is necessary to submit to E.D.A. WATER S. 218th Reservoir Site. Two requests were received from Butler Construction Co. concerning their con- tracts for removal of material from the 218th St. Reservoir Site. The first request was to be relieved from paying 5c� per cu . yd. for 12,000 yds. of mater- ial removed , because they had anticipated that the city would not require them to weigh the material used on the James Street project. While the con- tractor may have so anticipated such action, they were informed by the Administrator that such probably would not occur, and Mr. Butler was definitely in- formed of this prior to entering into the second con- tract. The second request is that they be paid for removing 12,000 yards of material wlien t•lie cross- section shows that they removed 10, 200 yards. The reasons given are (1 ) the top elevations used were lower then known and ( 2 ) considerable material that normally is classified as solid rock, per APWA specifications, section 13-1 .01 was encountered. Two items should be considered in this request (1 ) boulders did show up in the first removal so their presence was not unexpected and (2 ) the second contract left an out for the contractor due to weather or other unforseeable conditions, so it does not seem reasonable that the City should pay a premium. BARNIER MOVED that the contracts as written shall be respected, Lee seconded, motion carried. WATER A request has been received from Robert Bogue, 23519 CONNECTION 98th S.E. for city water. This property is approximately 600 feet north of the city limits. ELLIOTT MOVED to refer the matter to the Utilities Committee, Clements seconded, motion carried. FINANCE CLEMENTS MOVED to authorize the City Treasurer to release the cash bonds of Utilidor Construction and F. A. Breda for a 61 unit apartment for the elderly and Jim Rice for the Eastridge Plat, amounting to $500 each, Barnier seconded, motion carried. POLICE & A letter from Attorney Alva C. Long was read suggesting FIRE consideration of an alternative course of action in situations involving arrests for public intoxication of persons who are passengers in cars, CLEMENTS MOVED to place the letter on file, Elliott seconded, motion carried . THE RATING OF KENT for fire insurance purposes by the Washington Survey and Rating Bureau has been received. This report shows 2044 deficiency points as a Class 5 rating. While the Class 5 rating remains the same, the deficiency points have been improved, and an examination will be made to determine if it is possible to remove at least 45 points which would place Kent in Class 4. If this can be accomplished in the next few months , a Class 4 rating would reduce fire insurance premiums approximately 9 . The Fire Chief, City Engineer, Water Superintendent and Administator will review each item and report at a later date. CLIFFORD BARNIER MOVED to accept the Bill of Sale covering certain ADDITION utilities in the Clifford Addition, Lee seconded, motion carried. PLAT Yorkshire South. The continued public hearing was opened on the final plat of Yorkshire South. The City Engineer noted that the Planning Commission approved the plat sub- ject to submission of the executed linen. There were no objections from the floor. A letter from L. I. Schroeter was read requesting consideration of permitting a rolled concrete curb with integral 5" concrete sidewalk, 5 feet wide. At a work session held May llth, considerationwas given to this request and it was determined that roll curb does not meet adopted city specifications and the sidewalk when placed immediately back of curb is not as safe for the pedestrian and precludes the use of street trees in the parking strip for a more pleasing neighborhood. It was determined that the plat should follow the city's normal specifications. ELLIOTT MOVED to close the hearing, Martell seconded , motion carried. Ordinance 1660 approving the final plat of Yorkshire South was introduced by the City Attorney. MASTERS MOVED for passage of the ordinance, Elliott seconded, motion carried. NORTI-WEST Complaints were heard from Mr. Merville Bishop, STEEL ROLLING Gary Klingle, Terry Klingle and Mr. Novak regard- MILLS inc.; the noise level , smoke, etc. from the Northwest Steel Rolling Mills. Mr. Bishop stated that four years ago, when the Mills were granted a Conditional Exception by the city, they were supposed to install a 7 ft. cyclone fence and shrubs, which has never been done. A letter dated "pril 28th from Mayor Hogan to NW Steel Rolling Mills was read, pointing out that they had not complied with Board of Adjust- ment Resolution 52A. The Resolution was also read by Mr. Street. The City Attorney noted non-compliance with the Resolution could result in the plant being shut down by the City. CLAIM Mr. Street noted receipt of a claim from Leona A. Lesser in connection with the death of Kenneth E. Lesser, on January 24th on Meeker St. at the Mil- waukee tracks. MASTERS MOVED to acknowledge receipt of the claim and to refer it to the City Attorney and the city' s insurance carrier, Barnier seconded, motion carried. ZONING Barrett. - The City Attorney introduced Ordinance 1661 , approving the Barrett rezone ,from M-A to M-1 . LEE MOVED for passage of the ordinance, Martell seconded, motion carried. ANNEXATIONS Elliott noted that the Annexation Committee will meet.on Tuesday, May 19th at 10 : 30 a.m. A Resolution received from the City of Tacoma was introduced stating objections to proposed leasing of state lands in the Puget Sound area for commercial oil drilling and urging other cities to take similar action. Lee suggested that this matter be discussed at the workshop session on May 25th. ARTS The City ittorney introduced Ordinance 1662, creating COMMISSION a "Civic Improvement fund" in the office of the City Treasurer. MASTERS MOVED for passage of the ordinance, Barnier seconded, motion carried. TOUR It was noted that on May 7th, members of the Urban Arterial Board toured the James Street and the S. 212th projects. PROCLAMATIONS Mayor Hogan read a Proclamation declaring the week of May 24th as St. James Day School Week. Mayor Hogan read a Proclamation urging citizens to recognize and support the observance of Buddy Poppy days.
