Regular meeting of the Kent City Council was called to order at 7:00 p.m.
Present: Mayor Kogan, Councilmen: Baffaro, Barnier, Clements, Elliott, Lee,
Martell and Masters, City Administrator Street, City Attorney Mirk, City
Engineer Sherwood and Planning Director Harris.
Minutes of the last meeting were approved as printed and accepted by motion.
STREETS Vacation. The public hearing was opened on Mr.
Peth's petition for a vacation of a portion of 27th
Ave. S. The City Engineer pointed out the location
on the map. Mr. Peth was present to answer any
questions, but there were no objections and the hear-
ing was closed by motion. MASTERS MOVED to 'instruct
the City Attorney to draft an ordinance vacating that
portion of 27th Ave. S., described in the petition,
Elliott seconded, motion carried. It was noted that
.1payment of 1/2 of the appraised value of the vacated
area'is required by Mr. Peth.
Willis Street. Mr. Street noted that he met with
Joe Bell of the State Highway Department to review
information on Willis Street. He noted that the
street department believes that the proposal for the
storm drainage at the intersection of 4th Avenue is
physically impossible and that the Highway Department
will look into this. Ile thought that it would be
possible to combine the high voltage lines, distribu-
tion of street lights, telephone and power in order to
restrict them to one line of poles on one side of the
street. IIe stated that the phone company indicated that they
might go underground and opined that progress on Willis Street
could begin somewhat as the plans reviewed on last Monday
night.
LID 260 Off Street Parking. The City Attorney read
Resolution 667 designating I.4ay 10th at 7:00 p.m. as the
date of the final hearing on LID 260. LEE MOVED for adoption
of the resolution, Martell seconded, motion carried.
Parking Restrictions. Ordinance 1656 was read by the City
Attorney, eliminating parking on both sides of the 6th Ave.
alley north of Smith to the first rail spur track. MASTERS
MOVED for passage of the ordinance, Elliott seconded, motion
carried.
Kent-Kangley. Mr. Street noted that plans for the Kent-
hangley Road were also reviewed with the Highway Department,
and had suggested to the department that widening to four
lanes without left turn lanes would not be satisfactory.
He stated that the engineering department is working on a
proposal showing some left turn lanes. He stated that a
Chamber of Commerce representative had opined that since
this is a state highway, the State Highway Department should
pay all costs. Clements noted that the Kent-Kangley Road
had stillrmt been properly restored. Mr. Street noted
that Metro had stated it would be done during the month of
April.
Traffic Control. Representatives of the Kent Meridian High
School presented a petition requesting a traffic light at
9800 Black Diamond Road. Mr. Pat Hill presented slides show-
ing the traffic flow, lack of crosswalk, etc. MASTERS MOVED
to accept the petition and place it on file, Barnier seconded,
motion carried. Mayor Hogan noted that the City is working
with the Chamber of Commerce and State Highway Department
regarding this traffic problem. Mr. Street noted that un-
fortunately this highway is not high enough on the State
priority list, and that the traffic count now being made
might have some affect on this.
STREETS Reith Road. Two changes are recommended for the
plans for the Reith Road U.A.B. project: 1) to
increase the planter strip from three to four feet
on each side, so that street tress will have a better
chance for survival and 2) to acquire right-of-way to
back of sidewalk only. ELLIOTT MOVED that a four foot
planter strip be utilized along Reith Road, and that the
right-of-way extend to back of sidewalk only, whenever
possible, Martell seconded. Under discussion, Lee asked
if this would increase the amount of right-of-way to be
acquired. Mr. Street stated that it would probably
reduce it, as slope easements would be used where possible.
Motion carried.
WATER S. 218th Reservoir. BARNIER MOVED for the Treasurer to
be authorized to issue a check to King County in the
amount of $805.25 to cover the cost of the building per-
mit for the S. 218th Reservoir, Martell seconded. Under
discussion, Elliott asked about annexing this property.
Mr. Street suggested that the advisability of annexing
non-contiguous property be discussed at the next work
dession. Motion carried.
S. 212th Supply Main. MARTELL MOVED to accept the bid
of F. A. Breda in the amount of $73,665.75, plus tax,
for the installation of a water line to connect the S.
218th reservoir with the north valley area, contingent
upon receipt of approval of EDA. Barnier seconded,
motion carried.
WATER & A request for sewer and water service by the East Valley
SEWER Branch of National Bank of Commerce was discussed at a
REQUEST recent work session, where it was determined that at this
time, an annexation is not possible. A letter from the
bank has been received indicating that they will annex at
any time it becomes possible. MASTERS MOVED to allow the
sewer and water extensions, Elliott seconded, motion carried.
UTILITIES North Sewer ULID #1 Contract V. It was pointed out that
& Murphy Brothers has completed the necessary repairs on
SANITATION Contract V. Additional engineering due Hill, Ingman &
Chase amounts to $2,421.17 which is a liability of Murphy
Brothers. In addition, Murphy failed to install a side
sewer stub for which the property owner was charged $150.
Mr. Larry Hawley of Murphy Brothers has requested that since
this side sewer stub was not installed, a revision be made
to remove the assessment on this property and has agreed that
if this cannot be done for some legal or other reason, Murphy
Brothers will pay the $150 assessment. Since the LID is
closed, it is recommended that the City accept Mr. Hawley's
offer. CLEMENTS MOVED to accept this recommendation and for
the retainage of $9535 to be released, and that the payment
consist of two checks, one to Hill, Ingman & Chase and the
other to Murphy Brothers, Elliott seconded, motion carried.
North Sewer ULID #1 Contract IV. It was noted that Tonneson-
Slead, contractors on Contract IV, ULID #1 were notified on
January 15th by the City Engineer to repair Mr. Williams'
property. To date, they have not done so. BARNIER MOVED that
the property described in Easement No. 1-7-25 (Williams)
be restored to original condition as outlined in the City
Engineer's letter of January 15th, 1970. The cost of said
restoration shall be deducted from the amount due to Tonneson-
S.lead under Contract IV, ULID 41, Masters seconded, motion
carried.
CITY Mr. Don Breiner of Fred Bassetti and Co., presented a revision
HALL of the irrigation plans for the new city hall, noting that the
contractor has elected to put in the base for the asphalt paving
soon, so the piping must be put in at the same time. The cost
is about $1,700, which is approximately $500 more than was
approved for irrigation. Mr. Street suggested that this be
discussed at the workshop session on April 27th after which
time Mr. Breiner will be given an answer.
RAILROAD
4th Avenue. Mr. Street noted that the City has appealed
CROSSINGS
to the Washington Utilities and Transportation Commission
regarding the actions of the Milwaukee Railroad in laying
a track across 4th Avenue and have notified both the Milwaukee
Railroad and Mr. Sanwick that no permit was issued for con-
struction or filling and that each will be held liable if.
any sewer backup occurs and we are unable to get into the
sewer manhole which is partially covered by the ballast and
ties.
UNDERGROUND
It was noted that at a recent work session, the underground

wiring ordinance as it affects street lighting was discussed.
The need to install street lights in the existing overhead
areas is paramount. It is suggested that the spirit of the
ordinance can be accomplished by the following: The present
distribution system is temporary in that it will go underground
in the reasonable future. The high voltage lines are permanent.
Any poles that are installed for street lighting purposes only
are permanent. It was recommended that the Engineer require
undergrounding when lights are installed on poles carrying high
voltage lines only and newly installed poles used for street
lights only, and that the Engineer be directed to allow over-
head wiring where the installation is on a pole considered
temporary. MASTERS MOVED to adopt the above policy, Barnier
seconded, motion carried.
POLICE &
A letter was read from Mr. & Mrs. Orvel Cavender expressing
FIRE
their appreciation to the Police Department for the apprehen-
sion of juveniles involved in recent breaking and entering
incidents in their neighborhood. MASTERS MOVED to place the
letter on file, Clements seconded, motion carried.
PLAT
Yorkshire South. LEE MOVED for a public hearing to be held
May 4th, 1970 on the final plat of Yorkshire.South, Barnier
seconded, motion carried.
FINANCE
LID 258 Note in. Lieu of Bonds. The City Attorney read
Ordinance 1657, providing for issuance of an installment note
from LID 250, to be sold to the Firemen's Relief & Pension Fund
of the City, in the amount of $37,120.30 at 8%. MASTERS MOVED
for passage of the ordinance, Lee seconded, motion carried.
FRANCHISE
It was noted that the ordinance granting a franchise to
Clearview T.V. Cable Company will be presented at the next
meeting.
UNIFORM
Ordinance 1654, amending Ordinance 1652 which adopted Volume
BUILDING
III, housing, Uniform Building Code - 1967 Edition, was read

by the City Attorney. MARTELL MOVED for passage of the ordi-

UNIFORM
The City Attorney read Ordinance 1655, adopting Volume IV
BUILDING
(Dangerous Building Code) of the Uniform Building Code - 1967
CODE
Edition. ELLIOTT MOVED for passage of the ordinance, Masters
VOLUME IV
seconded, motion carried.
PARKS &
tIt was noted that the Parks Department has requested permission
RECREATION
to apply for 75% matching funds from the Interagency Committee
to purchase 4+ acres of ground for a park site adjacent to Linda
Heights subdivision. The quoted price is $10,500. BAFFARO
MOVED for the Mayor to be authorized to sign a request for 75%
matching funds for a Linda Heights park site, Masters seconded.
Under discussion, it was pointed out that the remaining 25%
would come from park acquisition funds which are budgeted this
year. Motion carried.
IT WAS NOTED that Sue Christensen of the Parks Department has
requested a leave of absence of approximately 3 months. Mr.
Wilson and Mr. Street recommend approval of her request.
MARTELL MOVED to grant the leave without pay, Elliott seconded,
motion carried.
BUSINESS It was pointed out that on May 1st, the City will be host to
EDUCATION 10 teachers in participation of the Chamber of Commerce Business
DAY Education Day.
