February 16, 1970
Regular meeting of the Kent City Council was called to order at 7:00 p.m.
Present: Mayor Hogan, Councilmen: Baffaro, Barnier, Clements, Elliott,
Martell and Masters, City Administrator -Street, City Engineer Sherwood,
City Attorney Mirk and Planning Director Harris
Minutes of the last meeting were approved as printed and accepted by motion.
Treasurer ' s report submitted, accepted and placed on file by motion.
BIDS Bids were received to furnish a "cub" tractor for
the Equipment Rental Fund :
Ray Bock $1 , 992 . 37, inc. tax & trade
Int ' l. Harvester 2, 153 .60, inc. tax & trade
CLEMENTS MOVED to accept the best bid of Ray Bock,
Barnier seconded, motion carried.
STREETS LID 257 James Street. Masters noted that at the work-
shop held February 9th, acquisition of the properties of
Moll, Marovich and `1'ippett were discussed and MOVED to
. refer the matter to the Street Committee with authorization
to negotiate with the three owners, Barnier seconded,
motion carried.
UTILITIES Drainage Complaint. Mr. Frank Nowak, owner of a home at
& 732 No. 2nd Avenue, stated that an old wooden catch basin
SANITATION in front of the house was no longer functioning and asked
that an adequate catch basin be installed. He noted that
each rainfall resulted in a 6" pond of water in front of
the house and that although he had explained his problem
to a city employee, nothing had been done. BARNIER MOVED
to refer the matter to the utilities committee, Elliott
seconded, motion carried. *(Councilman Baff aro was excused
from the meeting at this point, and therefore did not vote
on any of the remaining motions ) .
Des Moines Sewer District. Mr. Street read Des Moines Sewer
District Res. 1970-1, which adopts a plan of additions in an
area which logically should be served by the District. BARNIER
MOVED to approve the District ' s Resolution for extension of
sewer service to the area described therein, Elliott seconded,
motion carried.
UTILITIES Mr. Street read Resolution 663 , approving the PSP&L renewal
& contract for power to run a sewer pump located 900 ' east of the
SANITATION River Road, off the Russell Road. MARTELL MOVED to adopt the
resolution and to authorize the Mayor and City Clerk to sign
the 10 year contract, which is effective Ilarch 17, 1970 ,
Barnier seconded, motion. carried.
' A letter was read from Mrs . J . Mauritsen requesting that the
City correct her sewer charges, stating that she should not
have to pay until everyone is required to do so. MASTERS
MOVED to place the letter on file, Elliott seconded, motion
carried.
WATER So. 212th Reservoir Site. It was noted that Iddings Farm
Service has contracted with the City to remove material
ORRECTED • REFER T� from the So. 212th Reservoir Site by December 31 , 1969, and
had posted a bond of $1,000 with the City Treasurer to
IIN TES aF guarantee removal by that date, which has not been complied
with. MARTELL MOVED for the City Treasurer to be directed
to exercise her authority to take such bond and credit the
$1 ,000 to the water fund, Clements seconded, motion carried.
FINANCE It was noted that Jack West has restored a street cut on So.
262nd to the satisfaction of the engineering department.
MARTELL MOVED that the City Treasurer be authorized to refund
the $500 cash bond posted by Mr. West, Elliott seconded,
motion carried .
FINANCE Segregation LID 253 . It was noted that a request has
been received from S . Kato to segregate a portion of
LID 253 Assessment 441 , which has been reviewed by the
City Engineer and found to have no adverse affect upon
the LID. MASTERS MOVED for the City Treasurer, City
Engineer and City Attorney to prepare the necessary informa-
tion and resolution for said segregation, Martell seconded,
motion carried.
BUILDING New City Hall . Richard Ilaag presented a detailed planting
plan for the new City Hall , noting that approximately 60
trees, 300 shrubs and 1000 ground cover plants are proposed,
in addition to an inexpensive irrigation system. IIe noted
that this plan would cost approximately $17, 250. Don Briener
noted that 23 contractors have already secured plans and
specifications and stated these prevaling sq. ft. rates:
City Halls: $27 to $51 , Police r_tations: $34 to $46 and Court
IIouses $35 to $44, he noted that Kent is planning for $30 per
sq. ft. on the average. Discussion was had regarding indenta-
tion of the curbs to allow cars to pull off for loading or
unloading on 4th 1P've. and on Gowe Ltreet. The City Engineer
explained that this indentation would cut into the sidewalk
area, leaving a walk which is less than the required 61 . Part
of the sidewalk would then be on private property, (in this
case, the city' s property, ) which is in conflict with city
ordinances. It was suggested that the city could dedicate
some additional right-of-way to accomodate the indentation.
Barnier was in favor of making provision for the parking
indentations . Discussion ensued on the proposed brick side-
walk. The City Engineer stated that the City' s ordinance
requires that sidewalks be concrete, no less than 6 ' wide,
but that brick could be used inside of the sidewalk area.
Mr. Harris noted that Lowe Hall at the University of Washing-
ton had a brick wall-, which has presented no problems. Mr.
Haag noted that the bricks could be set in a mortar base,
instead of sand to insure stability.
RAILROAD Crossings of 4th Ave. N. It was noted that at a work session
CROSSINGS held February 9th, the City Attorney was directed to prepare
an amended answer to Petition 175 of the Milwaukee Railroad,
for a crossing of 4th live. N. The City Attorney read the
amended answer, stating that the city had reviewed additional

the area of the proposed crossing due to the general topography
At' �E� O D and due more particularly to the fact that trains would emerge
(''UU from an underpass approximately 60 , prior to reaching the cross-
ing, causing a danger of collision with motor vehicles. It was
also pointed out that due t.o the proximity of the proposed
crossing to the Chicago, Milwaukee ' s main track, it is doubt-
ful that trains would be able to activate warning signals in
time to provide for the safety of automobile traffic at the
proposed crossing. For these reasons, the amended answer to
Petition 175 of the Milwaukee Railroad changes the city ' s
position and the city now requests that the petition be denied.
MASTER' MOVED that the amended answer be signed, served on Uic
railroad and forwarded to the State of Washington Utilities
& Transportation Commission, Elliott seconded, motion carried.
ZONING Gaviglio. Ordinance 1645 , approving the Gaviglio rezone from
MHR to C-3 was read by the City Attorney. BARNIER MOVED for
passage of the ordinance and to instruct the City Clerk to file
same with the County 21-uditor, Martell seconded, motion carried.
Strain-Wingert. It was noted that Lamar Strain has agreed to
an easement 10 ' wide along the west side of his property and
adjacent property owners expressed interest in this easement
to an extent that another 10 , can be acquired. Ordinance
1644 approving the rezone from R-3 to C-3 was read by the City
Attorney. CLEMENTS MOVED for passage of the ordinance and to
instruct the City Clerk to file same with the County Auditor
after receipt of the easement, Elliott seconded, motion carried.
ZONING Tax Lot 15 . Ordinance 1646, approving the rezone from
R-1 to M-1 for Tax Lot 15 , -uhinn ' s Cloverdale Addition,
was read by the City Attorney. MARTELL MOVED for passage
of the ordinance and to instruct the City Clerk to file
same with the County Auditor, Barnier seconded, motion
carried.
Medd-Samuel Initial Zoning. Crdinance 1647 was read by
the City Attorney, approving R-1, R-4 and C-3 zoning for
the Mead-Samuel Annexation. BARNIER MOVED for passage
of the ordinance and to instruct the City Clerk to file
same with the County Auditor, Elliott seconded, motion
carried.
Spears Annexation. Ordinance 1648 approving zoning of
R-1 for the Spears Annexation, was read by the City Attorney.
CLEMENTS MOVED for passage of the or dinance and to instruct
the City Clerk to file same with the County Auditor, Martell
seconded, motion carried.
KENTWOOD BARNIER MOVED to accept and file the bill of .sale from the
HILLS #2 & G. P. I:ent Construction Co. , covering street and utility
#3 improvement for Kentwood Hills #2 and 43 , subject to the
City Attorney ' s approval, Martell seconded, motion carried.
