November 5 , 1969
At 7: 35 p.m. , Mayor Thornton called to order a meeting of the City
Council sitting as Committee of the Whole for the purpose of holding
a final hearing on the assessment roll for the improvement of James
Street (LID 257) .
Present: Mayor Thornton, Councilmen: Barnier, Hogan, Masters, Pozzi and
Woodworth, City Administrator Street, City Attorney Bereiter, City Engineer
Sherwood and Walt Ramsey, Bob Hawkins and Dennis Scott from the Hill, Ingman
& Chase office.
The public hearing was opened on the final assessment roll of LID 257,
for the improvement of James Street. A letter was read from John C. O'Rourke
Attorney representing Howard Manuf acturirg Co. stating that the property
would not be specially benefited by the improvement and objecting to the
fact that the residential property was not assessed. Mr. O'Rourke also
submitted • a statement from William Hancock containing an appraisal of the
property.
A letter was read from J. Fred Simpson, Assistant General Attorney for the
Chicago, Milwaukee, St. Paul and Pacific Railroad Co. , stating that the
property assessed is used exclusively as railroad operating property and
was not therefore benefited by the improvement. The letter further stated
that under an agreement dated July 6, 1965 , the railroad granted to the
city the right to locate and construct James Street across the railroad' s
right-of-way, and* in return, the city agreed that no assessment would be
made against the railroad for any work that might be performed in connection
with the improvement of James Street.
A letter was read from Mr. Peretti of Rentonites. Inc. & Wefore Co. , pro-
testing that the legal descriptions were incorrect on Items 14 and 15, and
therefore the assessments were too high. Mr. Peretti was present, and also
noted that the parcel described in Item #17 was now owned by the Bank of
the West.
A letter was read from William C. Nelson, on behalf of the Texaco Station
located at James and Central, stating that no only would the property not
be benefited, but that the value of the property might be lowered by the
improvement.
A letter was read from John Kovarik, Attorney for Korry Manufacturing Co.
stating that the property would not be benefited and objecting to the fact
that the residential property was not included in the assessment roll.
After it was determined that all who wished to speak were aff ored that
opportunity, Woodworth moved to close the public hearing, Pozzi seconded,
motion carried. Street noted .that the protests would be considered by
the Street and Finance Committees, who will make their recommendations
at the next council meeting, on November 17th at 3 :00 p.m.. At this time
the Council will consider correcting, revising, lowering, changing or
modifying the assessment roll . Consideration of the ordinance approving
the final roll will then be _iy,�n.
