September 2 , 1969
Regular meeting of the Kent City Council was called to order at
3 :00 p.m. Present : Mayor Thornton , Councilmen : Baffaro, Barnier,
Hogan , Lee , Masters , Pozzi and Woodworth , City Administrator Street ,
City Attorney Bereiter, City Engineer Sherwood and Planning Director
Harris .
Minutes of the last meeting were approved as printed and accepted
by motion .
Clerk' s and Treasurer ' s reports were submitted , accepted and placed
on file by motion .
WATER Armstrong Springs . Mr. Street reported that Anderson
& Kelly, geologists , conducting the study at Armstrong
Springs , have recommended that the City extend its option
on the property for an additional two months , to October
31st . Mr. Armstrong met with the water committee and
agreed to the extension at $750 per month, with all
terms to remain the same . Street recommended the City
accept this proposal. The City Attorney stated that
he had prepared an amendment to the option . Barnier
moved for the City to accept the terms of the option
extension and for the City to execute the amendment ,
Masters seconded , motion carried .
Lee reported that the water committee had met to dis-
cuss furnishing water for a 70 acre development of
approximately 275 homes , located on both sides of 124th
Ave . So. between S . E. 276th and S.E. 280th. It was
pointed out that the oirners had petitioned for annexa-
tion to Water District 111 , which has the ability to
serve the development , but had tentatively set their
boundaries at 124th Ave . S. Sewer service to the area
will be by the City through the Aero Mechanics pump
station . The engineer noted that it would be necessary
for the city to:
1. Extend approximately 3 , 500 feet of 10" or
12" main to connect Derbyshire and the sub-
ject area to the east hill high tank.
2. 'This would allow the discontinuance of the
continuous run pump into Derbyshire and give
much better fire protection .
3 . A high tank to the south of both areas is
contemplated in the comprehensive water plan .
11 . Without the subject area, a considerable
length of main would have no customers when
the high tank as noted in "3'.' above is in-
stalled .
5 . ' The City prefers to serve sewer customers
with city water as billing and collection
is more satisfactory.
6 . The actual water would come from a Kent
source in either case .
Lee moved that the City Administrator be directed to
notify the developers and Water District 111 that the
city believes it is in the best interest of the total
development of the area, for the City to serve this
development with water. Hogan seconded , motion carried .
The City Engineer noted that the three million gallon
reservoir is in service now, with some restoration work
still needed before the contract is completed.
STREETS So. 182nd . The public hearing was opened on the
proposed closure of So. 182nd Street , at its
connection with the West Valley Highway. Tony
Andreas , a representative of the Highway Depart-
ment explained the proposed project . Fie answered
queries concerning the traffic patterns in the
area , noting that when the four laning of the West
Valley Highway is completed , a barrier will prevent
left turns from So. 182nd onto the West Valley High-
way even if So. 182nd is not closed . Ile stated
that the Highway Department was of the opinion that
the traffic light at West Valley Highway and So.
180th would create sufficient traffic gaps for
traffic to enter 180th to proceed East or West
from 72nd Ave . So. , but that the State would make
changes if a problem was found to exist . He ex-
plained that no barrier was planned which would
prevent left turns onto, 180th from 72nd . Andreas
noted that the traffic count on the West Valley
Highway is about 8500 daily now and is expected
to be about 14 , 000 after the four laning is com-
plete . Mr. Rehn of 7011 So. 182nd acknowledged
that during peak hours it was difficult now to
enter the West Valley Highway from So. 182nd .
He objected to the fact that owners would be ex-
pected to donate portions of their property if
So. 182nd was to be reopened at a future date ,
even though the State would bear the cost of
the improvement . Andreas opined that it would be
.advisable to open S . 182nd again for setback pur-
poses only if the area became industrialized .
Sherwood asked whether the City would be obliged
to purchase right-of-way if the owners refused to
donate it , in case the City deemed it advisable to
reopen the street in the future . The City Attorney
stated that the City could then consider condemnation .
After all who wished to speak were afforded that
opportunity, Woodworth moved to close the public
hearing, Pozzi seconded , motion carried . Woodworth
moved that the City agree to the closure of 182nd
Ave . So. and that an agreement be entered into with the
State Highway Department covering the terms under which
the street may be reopened in the future . Kogan
seconded . Barnier opined that the Highway Department
should give assurance that traffic flow at So . 180th
and 72nd Ave . S . will be adequate and he questioned the
necessity of the owners donating property if the street
was to be reopened in the future . The City Attorney
stated that he understood the intent of the motion to
be that the street closure would not take place until
the council receives the agreement from the State High-
way Department and agrees to the conditions . therein .
Woodworth and Hogan concurred. Motion carried unanimously.
Railroad Crossings . Pozzi noted that the railroad cross-
ing protective devices are in operation at the S . 212th
Northern Pacific Railroad Crossing, that the Milwaukee
Railroad is scheduled for these devices on September 15th
and that the devices are scheduled for October 31st for
the !So. 228th crossing.
Traffic Control. The Traffic Engineer presented a written
report of his findings concerning the intersection of the
Kent-Kangley and 256th. Written reports on the Chamber of
Commerce Traffic Study were submitted from the Traffic
Engineer and City Planner. Woodworth moved to acknowledge
receipt of the reports and for copies to be forwarded to
the Roads Committee of the Chamber of Commerce for review,
Masters seconded , motion carried .
HEALTH & Sewer Extension . An application has been .
SANITATION received from the Kent School District #415
to extend the city sewer system in the Aero
Mechanics area to serve a new elementary
school outside the city which is within the
area intended to be served by the nearly
complete Aero-Mechanics lift station and
force main . The engineer has recommended
that permission be granted for this extension
with the following stipulations :
1. Easements necessary to extend the sewer
along tine applicant ' s east property line
be granted the City of Kent .
2 . The sewer will be designed in accordance
with city specifications .
3 . The applicant will pay for plan checking
and if any changes in design are necessary
will pay for said design changes .
4. The applicant will pay to Aero-Mechanics
(Kent-Langley Association ) , a charge deter-
mined by the City , as his fair share of th::
costs of the lift station and force main and
truck oversizing.
5 . This authorization is to the Kent School
District ##415 covering (the E' 10 ac . of the
S 3/4 of the NW 1/4 of the NE 1/4 of Sec . 33 ,
T22N, R5E, WN) and is not transferrable to
any other owner.
6 . Said authorization is for six months from
date of notification letter and expires at
that time .
7. The City may consider a request for extension
of the authorization during the 30 days prior
to the expiration date but is under no require-
ment to do so.
8 . The applicant will certify to the City Engineer
that he has read Ordinance No. 1142 and will
comply with this ordinance .
9. This agreement will be notarized and filed with
the County Auditor.
Barnier moved that the City enter into agreement
with Kent School District as outlined above , Hogan
seconded, motion carried .
Sewer Extension - R. Guthrie. An application has
been received from R. Guthrie to extend the city' s
sewer system in the Aero-Mechanics area, to serve
approximately 70 acres of residential area outside of
t e City. This request is within the area intended
to be served by the Aero-Mechanics lift station and
force main . The City Engineer has recommended that
permission be granted for this extension with the
same stipulations as were outlined for Mr. Bolt in
the preceding action , except #4 is to read : (This
authorization is to Ralph Guthrie covering (the follow-
ing portions of Sec 33 , T22N, R5E, 101; the S 1/4 of the
NW 1/4 , except the NE two acres where buildings are
situated ; and the N 1/2 of the N 1/2 of the NE 1/4 of the
SW 1/4 , except the E 20 ft . thereof for County Roads ;
and the W 1/2 of the S 1/2 of the N 1/2 of the NE 1/4 of the
SW 1/4 , less the W. 165 ft . and less the S. 30 ft . for
County Road ; and the N 1/2 of the SW 1/4 of the NE 1/4 ,
. less County Roads , ) and is not transferrable to any
other owner . The engineer asked if water service .to
HEALTH & the area should be required also. Barnier moved
SANITATION to include this requirement as Item #10 and for
the City to enter into an agreement with R.-Guthrie
as outlined above , Woodworth seconded . Lee asked
why. the water service requirement was included in
this agreement and not in the Bolt agreement . Barnier
noted that the location of this development made the
difference . The City Treasurer stated that the developers
should be required to make a deposit to pay for design
changes , permits , etc . The City Attorney stated that
the applicant ' s agreement and contract should include
this . Motion carried , with Lee voting, nay.
Sewer Extension - Gordon Bolt . It was noted that an
application has been received from Gordon Bolt requesting
extension of the city' s sewer system in the Aero-Mechanics
area , to serve a plat outside the city. This request is
also within the area intended to be served -by the Aero-
Mechanics lift station and force main . The City Engineer
has recommended that permission for this extension be
granted with the following stipulations :
1. The sewer will be designed in accordance
with the city specifications .
2. The applicant will pay for plan checking
and if any changes in design are necessary,
will pay for said design changes .
3 . The applicant will pay to Aero-Mechanics
a charge determined by the City as his
share of the lift station , force main ,
and trunk oversizing costs .
4 . This authorization is to Gordon Bolt
covering (Lot 16 and the west 163 . 9 feet
of Lots 15 and 18 , Block 1 , Pine Tree
Farms Addition , as filed in Vol. 43 , page
30 of Plats , Records of King County, Wash-
ington , less the N. 147 .27 feet of the W.
132 feet ) and is not transferrable to any
other owner.
5 . Said authorization is for six months from
the date of the notification letter and
expires at that time .
6 . The City may consider a request for extension
of the authorization during the 30 days prior
to the expiration date but is under no obligation
to do so.
7. The applicant will pay any County permit and
inspection fees .
8 . The applicant will certify to the City Engineer
that he has read Ordinance 1142 and will comply
with this ordinance .

9 . This agreement will be notarized and filed with
the County Auditor.
Barnier moved that the City enter into an agreement
with Gordon Bolt as outlined above , Woodworth seconded ,
motion carried .
Bids . Barnier moved that a call for bids be issued for
a high pressure sewer cleaner , with the bids to be• opened
September 25th, Woodworth seconded , motion carried.
Aero Mechanics . It was noted that a sewer easement and
bill of sale from the Kent-Langley Assoc . and a contract
for late comers charges has been received today, too late
to be reviewed for action at this meeting. Woodworth
moved to table the matter to the next council meeting,
Barnier seconded , motion carried .
HEALTH & ULID ##1, Contract 5 . Barnier moved that 50%
SANITATION of retainage for Contract 5 , ULID ##1 be re-
leased to Murphy Bros . , Plasters seconded.
Under discussion , Barnier noted that there
are a few easement releases to be obtained
and some minor restoration to complete . I-lotion
carried .
Hogan noted that the City is still holding a
check from Hauge Construction to the School
District in connection with a sewer hookup
to the Scenic Hill School . She asked that
the City Attorney check to see if the money
could be released.
Barnier noted that he visited a Kent industry
with a representative of the King County Health
Department and requested that a work session be
scheduled to discuss the matter .
POLICE & The City Attorney read Ordinance 1611 defining
FIRE an "Abandoned Vehicle" and prescribing the
manner for impounding same , based upon enabling
legislation passed by the State Legislature this
year. Barnier moved for passage of the ordinance ,
Hogan seconded ,motion carried .
Woodworth stated that he had received complaints
from the Nordick Company and Canyon Homes rela-
tive to trucks parking at a nearby cafe and
recommended that the Traffic Engineer study the
situation , Hogan so moved , Pozzi seconded ,
motion carried .
FINANCE A letter from the City Treasurer was read
recommendeng that the National Bank of Washington ,
Peoples National Bank, Seattle First National Bank,
Puget Sound National Bank and The Bank of the West
be accepted by the Council as depositories of the
City of Kent . Woodworth moved that the letter be
accepted and placed on file and that the above named
banks be accepted as qualified for deposit of City
of Kent municipal funds in accordance with Chapter
193 - Laws of 1969 , 1�lasters seconded , motion carried .
Masters moved thatthe City Treasurer be directed to
notify each of the qualified banks that they may
release the existing collateral presently pledged to
cover City of- Kent deposits in accordance with
Chapter 193 - Laws of 1969 , Lee seconded , motion
carried .
BUILDING New City Ball. Mr. Street noted that the Building
Committee will be advised as soon as the cost estimates
for the new city hall have been receives'..
LICENSES Taxi Cab. Woodworth noted that the license committee
will meet Tuesd.ay, September 9th at 10 :00 a.m. with
the three firms who have applied for the one remaining
a�v'ailable taxi license in the city.
CLIFFORDS Miles Drake , engineer for the Clifford ' s Addition Plat
ADDITION submitted a letter concerning the recent action taken
PLAT by the Planning Commission . It was pointed out that the
Planning Commission had withheld approval of the final
plat , subject to the plattor adhering to certain require-
ments for improvement recommended by the City Engineer '•s
office . Mr. Drake asked that the council waive these
requirements and set the date for the public hearing
before the council. The City Attorney explained that
the city ordinances require that a final plat be approved
by the Planning Commission before it is brought to the
council. IIe suggested that Ph . Drake request the Planning
Commission to reconsider the plat and adhere to their
requirements so the plat could be presented to the Council ,
and than ask the council for consideration of the waivers
he seeks , at the council public hearing. Woodworth moved
for the Planning Commission to again consider this plat
at their next meeting, Barnier seconded , motion carried .

SCRIMINA_ The City Attorney reported he had reviewed an agree-
ment proposed by the State Board Against discrimination

TION AGREEMENT
and stated it was consistent with the City' s ordinance
prohibiting discrimination on account of race , color ,
creed or national origin . Baffaro moved that the Mayor
and City Clerk be authorized to sign the agreement ,
Lee seconded , motion carried .
UNDERGROUND Ordinance 1610 , repealing the present underground
WIRING wiring ordinance #1525 was read by the City Attorney.
ORDINANCE Lee moved for passage of the ordinance , Hogan seconded .
It was determined that the ordinance was not in conflict
with the city ' s contract with Puget Sound Power &, Light .
Mr. Street stated that the City has received preliminary
copies of the street lighting proposed program for the
next 20 years which will be reviewed by the Council .
Woodworth asked if UAB funds can be used for underground
wiring for a street which is widened . Street stated that
they could , if it is a new installation , however the funds
may not be utilized for replacements . Ile further noted
that UAB funds may be used for relocating existing under-
groundfacilities . Woodworth asked if matching money is
available to the City for this purpose . Street stated
that Renton and Bellevue are suggesting the use of Street
and LID funds . It was noted that PSP&L and Pacific N.W.
Bell will be required to provide "as built" drawings each
year. The City Engineer stated that an attempt would be
made to have the policy uniform for all cities involved .
D'Iotion carried .
PAYROLL Pozzi noted that the matter of payroll deductions for
DEDUCTIONS the Police Department had been tabled and moved to take
the subject off the table , Woodworth seconded , motion
carried. It was noted that the Finance Committee and
Administrator had studied the matter and had submitted
the following recommendations for all payroll deduction
proposals :
1. The program must be available to all city
employees .
2 . If a program is available to all employees,
and approximately a majority of the employees
desire to utilize the program, payroll
deductions will be authorized .
3 . Approval of any payroll deductions will be
by the City Council , through the Administra-
tor ' s office .
Masters moved that these recommendations be accepted
and for them to be considered a statement of policy,
Barnier seconded , motion carried .
SS M CO. Woodworth requested that at the next meeting, a complete
DEVELOPMENT report be given on the status of the SS&M Co. development .
Misters moved that the bills received on or before
September loth and approved by the Finance Committee ,
be paid , Barnier seconded , motion carried .
