June 2 , 1969
Regular meeting of the Kent City Council was called to order at 3 :00 p.m.
Present : Mayor Thornton , Councilmen : Baffaro, Barnier, Hogan , Lee , Masters ,
Pozzi and Woodworth, City Attorney Bereiter, City Administrator Street and
City Engineer Sherwood
It was noted that in the minutes of the May 19th meeting, a typographical
error was made in- the Addendum to the Comprehensive Plan. The reference
to Chapter VII, should read Chapter V.
Mrs. Hogan noted an error contained in the public hearing of the McPherson
Appeal. The minutes reflect that Barnier and Masters voted nay, and should
read Barnier and' Hogan . voted nay.
Hogan moved that the minutes of the last meeting be approved as corrected
above. Masters seconded, motion carried.
HEALTH & ULID #1, Contract II. Mr. Barlow, attorney for Pamco,
SANITATION Contractors on ULID #1 , Contract II', noted that releases
have been obtained from all but two property owners. One
owner has, moved , but a letter has been sent to him request-
ing the release and no problem is anticipated. Mr. Kolstee ,
the other property owner, has claimed damages to his pro-
perty in the amount of approximately $1 , 500. Barlow noted
that the City is retaining 10/ of the total contract which
amounts to $139, 160.61 and that he has prepared an agree-
ment stating that Pamco will indemnify the City from any
suit or any damage and will keep their bond in force. The
City Attorney noted that legally the City could refuse to
disburse the 10/. retainane until the job has been accepted
as complete . The City Engineer stated that usually, under
these circumstances , a certified or cashier 's, check from
the contractor is deposited with the City in an amount to
adequately protect the City, but he opined that keeping
the bond in force would give sufficient protection . Barnier
stated that it was unlikely that the owner would go to court
for this amount . Pozzi agreed and opined that Pamco should
settle with Kolstee. Mr. Barlow stated that Pamco thought
the amount due Kolstee was a few hundred dollars at most .
Pozzi stated that the City should not hold up Pamco ' s money.
Woodworth suggested that the City hold 10% of the retained
amount , roughly $14,000 and asked the City Attorney if the
City would be liable if this matter went to court and the suit
was for more than $14, 000. The City Attorney stated that
the possibility exists and suggested that the agreement could
be amended to state that the City will release to the con-
tractor $125, 160.00, the rest of which will be retained by
the City. Woodworth moved for the agreement to be so amended
and for the Mayor and City Clerk to be authorized to sign it ,
Barnier seconded. Under discussion , the City Engineer noted
that the City has not as yet accepted the contract as completed.
Bill Chase noted that the City cannot release more than half
of the retained amount until the Department of Labor and
Industries and Tax Commission forms are received. Street
stated that after a project is 90/ complete , up to half of the
retained amount can be released . Woodworth withdrew his
motion , Barnier withdrew his second. Woodworth moved for
50% of the retained amount to be released to the contractor ,
Pozzi seconded. Under discussion , Sherwood noted that the
City cannot release any part of the remainder of the retained
amount until we have received the releases from the State .
He further stated that the guaranty bond remains effective
for one year after completion of any project . Motion carried.
HEALTH & Agreement Between Cascade Sewer District , City of_
SANITATION Kent , and Metro. The tri-party agreement between
Cascade Sewer District , City of Kent and Metro and
the two-party agreement between Cascade Sewer Dis-
tr.ict and the City d" Kent were presented to the
Council. Pozzi moved that the Mayor and City Clerk
be authorized to sign the tri-party agreement ,
Barnier seconded. Under discussion , Woodworth
questioned Section 4 , which states : "All costs
pertaining to contract changes orders resulting from
additional work on the Mill Creek Interceptor Ex-
tension shall be paid entirely by the City" . After
condierable discussion on the matter, the City
Attorney suggested that this portion of Section 4
be changed to read, "All costs pertaining to con-
tract change orders resulting from additional work
on the Mill Creek Interceptor Extension shall be
paid' entirely by the party or parties requesting such
additional work" . Woodworth suggested that the first
sentence of Section 6 , Construction of Relief Sewer
should include the number of gallons per day. Ramsey
stated that he could determine the figure and include
it. Woodworth. suggested that these two changes be
incorporated into the motion . Pozzi and Barnier agreed
to include them and the amended motion carried.
Agreement Between Cascade Sewer District and City of
of Kent. Barnier moved that the Mayor and City Clerk
be authorized to sign the two-party agreement between
Cascade Sewer District and the City of Kent , Masters
seconded , motion carried.
Des Moines Sewer District . The City Engineer noted
receipt of Resolution 19 9-15 from the Des Moines Sewer
District adopting a plan for additions and betterments
to the district , which requires approval by the City of
Kent . Upon Sherwood ' s recommendation , Hogan moved to
approve the resolution , Barnier seconded, motion carried.
Barnier moved that the City enter into a contract to
convert the Aero-Mechanics pressure line . to gravity bet-
ween 110th and 114th at an approximate cost of $5 , 500,
Woodworth seconded. Under discussion , it was determined
that the City has an agreement with Aero-Mechanics which
specifies that the line will be turned over to the City.
Motion carried.
STREETS East-West . A request has been received from the Stat
Highway Department for written concurrence of the corridor
for SR 516 from 4th Ave. to 124th Ave. S.E. Pozzi moved
that the Mayor be authorized to acknowledge the acceptance
of the concept of the location of the corridor and to agree
to work with and review the development of ingress , egress
and aesthetic considerations as they are presented by the
State, Lee seconded. The City Engineer explained the
corridor , noting that it carries directly east of the pre-
sent end of the connection from the Valley Freeway. From
4th Avenue , it carries across Central Ave . with a structure
.over First , Railroad and Central and goes southeasterly up
the hill, parallels S.E. 264th and ties into the Kent
Kangley Road at approximately 120th Ave. S.E. The City
Engineer stated that this is not an approval of the access
features , but merely the general alignment of the highway.
Street explained that public hearings will be held. He
suggested that in the letter to the State , the City could
express agreement with the temporary utilization of Willis
Street and to the State ' s acquisition of certain properties .
Motion carried .
STREETS So. 212th - Traffic Control. Ramsey reported that
the Milwaukee Railroad does not intend to complete
this crossing until the new Cantilever-type signals
are available , which will be approximately 60 to 90
days . Pozzi moved that a meeting be held between the
City, State and the Milwaukee Railroad to attempt to
expedite this installation and also to plan a more
suitable detour if the delivery date cannot be improved
upon , Masters seconded , motion carried.
Vacation . Ordinance 1602, vacating a portion of the
J. H. Patten Road was read by the City Attorney. Pozzi
moved for passage of the ordinance , Masters seconded,
motion carried.
Sinalizat_ion . It was noted that at the December 16 ,
Meeting, approval was given to sharing cost of
signal lights at 180th and the West Valley Highway. The
estimated cost was $4,468.64. The City of Renton was not
satisfied withthe proposed signals and they were sub-
sequently redesigned to be acceptable. The formula for
dividing costs remains the same , but the lights will now
cost Kent approximately $7,065.00 to be paid from the
Arterial Street Fund. Pozzi moved for the City to enter
into an agreement with the State and City of Renton for
the above installation , IIogan seconded. Under discussion ,
the City Engineer explained the type of signalization to
be installed. Barnier stated that there would be heavy
traffic at this intersection and opined that Renton was ',
making a mistake . Motion carried ,with Barnier voting nay.
Petition . A petition signed by 44 property owners was
received requesting that parking on S.E. 236th Place and
108th Ave . S.E. be restored to both sides of these streets .
The reasons given were that the thoroughfare was unsafe
for ,children and that there was now inadequate parking space.
Pozzi moved to refer the matter to the street committee
and City Engineer for an on-site inspection , Masters
seconded , motion carried. Mr. Street noted that a traffic
speed check was made and did not show excessive speed.
One property owner asked if there would be a possibility
of opening 108th Ave. S.E. to S.E. 240th. A report will
be given at the next meeting.
WATER It was noted that the City Engineer, Water Committee and
Administrator met with representatives of Water Districts
87, 105 and Ill on May 28 , 1969 at which the following
items were discussed :
1. The City may have to restrict water usage
this summer. if approval of Clark Springs
development is not received within a short time.
2. The facts that led to this impasse were fully
discussed.
3. That the present rate may have to be revised
and that those districts with adequate storage
would probably receive a better rate .

4. That within the next few years , Kent will
probably have to buy water from Seattle , and
any districts we furnish would be thus affected .
Lee moved that Hill, Ingman & Chase be instructed to
proceed with Phase II, Water Study Resource Report at a
cost of $18,000. Masters seconded. Mr. Street noted that
this study is vitally important and necessary. Motion
carried.

BUILDING New City Hall. Baffaro reported that the completion
date for the new City Hall should be December 15 , 1970
and there will be approximately 26, 500 gross square
feet . He stated that the estimates of costs of the
building and grounds , as well as the production schedule
has been received. He moved to accept the production
schedule , Pozzi seconded. Under discussion, Mr. Street
explained the program: Schematic drawings are to be
submitted by June 30 and approved by July 7th. The
preliminary drawings are to be submitted by August loth
and approved by August 17th. The contract documents
will be available about October 25th and-approved onj
week later. The bidding period will be November 6th to
December 4th. The execution of the contract will be
about December 15th and the building should be completed
by December 1970. Motion carried.
FINANCE LID Segregation . Resolution 635 setting the City ' s
policy regarding segregation of LID assessments was
read by the City Attorney. Masters moved for adoption
of the resolution , Hogan seconded , motion carried.
Barnier moved that the appointment of Margaret Drotz
as City Treasurer be confirmed, Baffaro seconded ,
motion carried.
Masters reported that the City Treasurer had reinvested
$100,000 of Arterial Street Funds in 180-day U. S.
Treasury Bills .
SENIOR Lotto. The City Attorney read the proposed cooperation
CITIZEN agreement with the King County Housing Authority con-
HOUSING cerning the Lotto project . Lee moved to adopt the agree-
ment , Hogan seconded. . Under discussion , the City Attorney
determined that there wouldbe a separate agreement for each
such project and explained that the agreement states that
the usual city services will be furnished to the project.
Lee asked if this agreement should be signed before the
annexation is complete . Mr. Street noted that the original
5 acre annexation is before the Boundary Review Board now
and that the petition for the other 15 acres should be
received soon.' Lee moved to amend the motion for the
execution of the agreement to be withheld until after; the
property is officially annexed . Hogan seconded. Amendment
carried. Motion carried .
PLAT Randall Park Division #1 The public hearing was opened
on the Randall Park Division #1 Plat . There were no
comments or objections from the floor and the hearing was
closed by motion . Pozzi moved to approve the plat and
for the City Attorney to prepare the necessary ordinance ,
Masters seconded , motion carried.
PLANNING It was noted that the Planning Association of Washington
proposes to have their fall meeting of 1970 in Kent.
Barnier moved that the Kent Planning Commission be encouraged
to sponsor the meeting, Masters seconded , motion carried.
PARKS & Resolution 636 was read by the City Attorney authorizing
RECREATION the transfer of funds in tho Parks Dopartmont ns follows :
From: 604.01 (Equipment Rental) $5,000
From: 641.01 (Recreation Program) $5,000
To: Salaries , Part Time & Overtime $10, 000
Hogan moved for adoption of the resolution, Masters
seconded, motion carried.
Mayor Thornton appointed Mrs. Hogan to act as liaison
officer between the Parks Commission and the City Council.
Woodworth moved to confirm Mayor Thornton ' s reappointment
of John Gretz to the Parks & Recreation Commission , Masters
seconded , motion carried.
Masters moved and Hogan seconded that the bills submitted
by June loth and approved by the Finance Committee be paid.
Motion carried.
