Regular meeting of the Kent City Council was called to order at
Barnier,
8 :00 p.m. Present : Mayor ThorntonCltouporne• Bereiter �City
Lee, Masters , Pozzi and Woodworth, y Y
Engineer Sherwood and City Administrator Street . Councilman Baffaro
was not present for roll call, but came in at 9 : 30 p-m-
Minutes of the last meeting were approved as printed and accepted
by motion .
Budget report submitted, accepted and placed on file by motion .
HEALTH & The City Engineer stated that the sewer committee
SANITATION and engineering department reviewed the submittal
of Aero Mechanics Union regarding development of
a 350 unit housing project on the Kent Kangley
Road and 132nd S.E. He noted that the council
had given approval for this property to connect
to the city' s system at the Sequoia School. The
City Engineer recommended that the council auth-
orize him to write' a letter stating that the city
will maintain and operate the system, providing
the installation meets city requirements and that
the necessary deeds and easements are secured.
Armstrong so moved, Barnier seconded, motion carried
Woodworth moved to retain IIill, Ingman & Chase to
review plans and provide inspection service on this
project , if necessary, according to their existing
contract with the city, Barnier seconded, motion
carried.
Ed Pike asked if provision had been made to in-
clude any property to the South of this sewer pro-
ject . The City Engineer declared there had not ,
but if property owners were interested in larger
sewer lines or in relocating the pump station to
the East boundary and would pay such costs ; there
would be no objection .
Upon the City Engineer' s recommendation , Masters
moved to accept an easement from the Kent Medical
Center for the sanitary sewer, Armstrong seconded ,
motion carried.
Barnier stated that the Health & Sanitation Committee
met with people from the Turn Key housing and have
presented their views on the subject for the City
Attorney' s opinion.
A letter from Hugh G. Goldsmith, Engineers repre-
senting J. W. Morrison , developers of Cambridge #6
was read, stating that Mr. Morrison is willing to
bear the expense of lowering the sewer system to
accomodate a gravity flow from Star Lake Elementary
School , provided that he recovers half the cost of
the sanitary sewer line in the amount of $4000.00,
plus the cost for lowering the system, in the amount
of $4000.00, totaling $8000.00. Mr. Goldsmith re-
quested that the City of Kent recover this amount
from the school district , by a connection charge when
the school makes the connection to the system. Arm-
strong moved to refer the matter to the Health &
Sanitation committee , Barnier seconded, motion
carried.
A letter was read from Donald Evans of the Department
of Public Health, proposing an informal meeting at a
date to be announced to make a mutual determination
of needs , wants and resources. Woodworth moved to
place the letter on file , B'affaro seconded, motion
carried.
HEALTH & Barnier stated that during the four days the North-
SANITATION west Rolling Mills has been shut down , the north end
air pollution problem has improved considerably. IIe
further stated that dust clouds are corning from the
SS&M project . The Mayor stated that he would contact
the firm by phone.
Barnier moved that a sanitation problem at a trailer
park be referred to the IIealth & Sanitation committee ,
Armstrong seconded, motion carried.
ULID #1. Barnier moved to authorize the City Attorney
to draft an emergency ordinance in the amount of 032, 943.46
to pay assessments against Sewer Department property for
ULID #1, to be paid back out of next years sewer funds ,
Masters seconded, motion carried.
Resolution 593 , was read by the City Attorney, authorizing
transfer of 53000.00 within the Sewer Department 196£3
budget to cover cost of truck & equipment to replace the
one totally damaged in an accident. It was noted that
funds eventually collected in connection with this acci-
dent would be deposited into Sewer Funds . Pozzi moved
for passage of the resolution , Masters seconded, motion
carried.
Olympic View Estates. The City Engineer recommended
that the Bill of Sale for sanitary sewer and water im-
provements for the Olympic View Estates development be
accepted, along with an easement for a water main within
the development. Pozzi so moved, Armstrong seconded,
motion carried.
WATER LID 252. The City Attorney noted that at the last council
meeting, the public hearing was held on the final assessment
roll for LID 252., written protests were received and the
public hearing was closed. The protests were then referred
to the water committee and the consulting engineers for
consideration. Lee moved for adjustments for assessment
9, items #87 and 16 and to make these adjustments a part of
the ordinance , Armstrong seconded, motion carried with
Barnier abstaining. Ordinance 1522 , confirming the final

was read by the City Attorney. Armstrong moved for passage
of the ordinance , Pozzi seconded, motion carried.
Z Lee moved that the bids on LID 252 , presented at the May
6th meeting, be awarded to Austin Construction Co. , low
bidder at $566 , 514.00, Barnier seconded, motion carried.
A letter was read from Robert Kuvara, Attorney representing
Nathan Baird, noting that his water meter is located on a
30 foot strip of property owned by the State and that vehicles
crossing that 30 foot strip broke the water line , causing
water to escape, thus increasing his water bill. He requested
that the city consider subtracting this loss from his water
bill or enter into a sharing basis with him on this loss .
Pozzi moved to refer the matter to the water committee with
power to act , Barnier seconded,motion carried.
Lee reported that Hill, Ingman & Chase and the water committee
will meet with property owners tomorrow at noon regarding
extending water service to the north end.
STREETS East-West Route. A letter from W. C. Bogart of the State
Highway Department was read, stating that the department
now feels it would be desirable for the city to go on record
favoring the route selection which was recently tentatively
adopted by the Highway Commission . The matter was referred
to the street committee , Joe Street and the City Engineer
by motion and a meeting was scheduled for Tuesday, July 9th
at 7 : 30 p.m.
STREETS A letter from Kenneth Yahn of Ulrick Investments ,
Inc. was read indicating a need for access to the
East Valley Highway from the portion of 80th Ave. S.
lying between 202nd St . So. and 208th St . S. Pozzi
moved to refer the matter to the City Engineers
department. Barnier opined there was an urgent need
for this and seconded the motion . Motion carried.
LID 253. Woodworth moved to set the public hearing
for July 15th for the final assessment roll for LID 253 ,
So." 212th, Phase II . Masters seconded , motion carried.
SS&M. Pozzi reported that the SS&I�i project has had
33 working days to date , of which 26 days were worked,
noting that 47 working days remain.
LIGHTS A letter was read from Mrs. Edwin Dysert requesting
that street lights be installed on S. 268th St . Pozzi
moved to refer the matter to the lighting committee ,
Barnier seconded, motion carried.
PARKS Resolution 594 , approving execution of a contract for
a grant between the U. S. Government and the City of
Kent , to acquire land for open space property was read
by the City Attorney, who explained that the formal
resolution was required as part of the formal contract
authorized at the last meeting. Baffaro moved for
passage of the resolution , Pozzi seconded,motion carried.
Mill Creek Canyon . Woodworth moved t lint appraisnls be
made on other parcels in the canyon , Armstrong seconded,
motion carried. Barney Wilson noted that HUD has re-
quested two appraisals on the Rugg property, along with
a letter from Dr. Rugg stating his price.
A letter from Mrs. Hogan was read requesting permission
to make official application to the State Interagency
Committee for Outdoor Recreation , to initiate a matching
fund contract regarding Lake Fenwick property acquisition .
Pozzi moved to grant the request , Baffaro seconded, motion
carried.
ANNEXATIONS Sunray. A notice from the Boundary Review Board was
read announcing that a hearing on the proposed Sunray
Annexation would be held on July 25th after 7 :00 p.m.
in the King County Courthouse and indicating that the
boundaries had been modified to include more property.
It was determined that the Mayor should appoint a re-
presentative from the City to attend this hearing.
OPEN The public hearing was opened on the open housing ordinance.
HOUSING It was noted that the proposed ordinance was read in its
ORDINANCE entirety at the June 3rd council meeting. Changes to the
proposed ordinance have been made as follows : Sec. 8 ,
the fine for violation of the ordinance shall be "not more
than $300. . . " (underscored words have been ADDED) , Sec. 6 ,
"Any destruction , defacement , alteration or removal of
said notice .by the':owner.' or his a ents servants or
employees shall be punished . . . " underscored words have
been DELETED) . The City- Attorney read a letter from the
State Board Against Discrimination reporting that the Board
is prepared to assist in investigation of complaints which
may be filed under the ordinance. Mr. Ed Pike stated that
the proposed ordinance would take away his constitutional
rights , and opined that the matter should go to the vote
of the people. Mr. Warnock stated he had. experienced
very little opposition to the measure when he carried
petitions in favor of the ordinance. Larry Clements opposed
the ordinance , but stated he was not opposed to open housing.
He stated that the proposed ordinance might cause discrimi-
nation of another nature. James Snow referred to Sec. 5,
which states that any complaints must be filed within 15
days , . stating that he thought 7 days would be sufficient .

HOUSING had agreed on 15 days , which is considerably shorter than
ORDINANCE the ordinances of most other cities . Vera Fredrickson ,
Barbara Pistoresi and Mrs.Mead spoke in favor of the ordi-
nance. It was noted that many letters supporting an open
housing ordinance were on file with the committee, and had
now been delivered to the City Clerk for the city files.
There were no further comments from the floor and the public
hearing was closed by motion . Woodworth moved for passage
of the -ordinance , as read on June 3rd, with the changes as
noted above. Barnier seconded. Under discussion*, Armstrong
moved to amend the motion to include a change in the time
period in Sec . 5 from 15 days to 5 days. The proposed
amendment failed for lack of a second. The original motion ,
to pass Ordinance 1521 , prohibiting unfair housing practices ,
carried unanimously.
VALLEY A letter from the Valley Regional Planning Commission was
REGIONAL read, inviting the Council and Mayor to attend a joint meet-
PLANNING ing with the cities of Algona, Pacific and Auburn on the
COMMISSION evening of July 8 in the Council Chambers of the Auburn City
Hall at 8 :00 p.m. to preview the plans and goals of the VRPC
for 1969. By motion , the letter was placed on file.
ARMSCREST Appeal, Hauge. The public hearing was opened on the appeal
#4 filed by Mr. Hauge against the action of the Board of Adjust--
APPEAL ment in denying a variance to allow construction of a house
on an undersized lot . The Board of Adjustment minutes of
June 4th, pertaining to the subject were then read. The City
Engineer noted that the lot requirement for a building is
7000 square feet , and that the lot in question was 5900 square
feet. The Mayor noted that the lot is unsightly as it is and
Hauge opined that the best solution would be to build a small
home on the lot. Mr. Hauge recited a history of the background
of the lot in question , explaining that he had divided a larger
lot at the request of a purchaser, which left this smaller
lot . The City Attorney pointed out that the Board of Adjust-
ment had denied the application under Sec. 10.15.09 of the
zoning code, finding that the plight of the applicant is the
result of his own action and that the city could not legally
grant this application . The restrictions for the plat of
Armscrest #11 were read in part , stating that no building other
than one detached single family dwelling shall be erected on
any lot . Objections to the proposed variance were heard from
Mrs. Stromberg , Mr. Radke , and Mrs. Ball. After all who
wished to speak were afforded the opportunity, Barnier moved
to close the hearing, Armstrong seconded, motion carried.
Lee ffioved to uphold the action of the Board of Adjustment in
denying the variance., for the reasons previously stated by
the Board and outlined in detail under Sec. 10.15.09 of the Zonin
Code. Motion carried. Mrs. Hogan stated that the John Graham
study calls for a tot lot in this neighborhood, and suggested
thatthe lot could be used for that purpose.
Bruns. The public hearing was opened on the appeal filed by
Mr. Bruns against the action of the Board of Adjustment in
refusing to grant a variance to allow access over existing
driveways from lst Ave. and from Crow St . with 13 ' entrance
from.Willis St. Mr. Lyle Schneider, .Attorney representing
1-1r. Bruns stated that they now have a new plan and requested
that this matter be referred back to the Board of Adjustment
for reconsideration. Pozzi moved to close the public hearing
and to refer the matter to the Board of Adjustment , Armstrong
seconded, motion carried.
UNION The City Attorney noted that a meeting has been scheduled
for 10 :00 a:m. on July 2 with representatives of Teamsters
Local 910, and that the Department of Labor& Industries
had denied the citys petition for a; rehearing.
ZONING Blevins. Masters - moved to continue the Blevins rezone hearing
to the August 5th meeting, Armstrong seconded, motion carried.
KENT It was noted that the Kent Estates Plat was part
ESTATES of the Ortiz Annexation and the City Attorney ex-
PLAT plained that the ordinance zoning the annexation
had not been prepared because pertinent documents
had not been filed as yet . The public hearing
was opened on the final plat of Kent Estates.
There were no objections regarding the plat and
the hearing was closed by motion . Masters moved
to approve the plat and to have the ordinance
prepared, subject to the City Engineer and City
Attorney' s approval, Barnier seconded, motion
carried.
CITY Mayor Thornton introduced the new City Administrator,
ADMINISTRA- Mr. Joe Street from Pullman and welcomed him on behalf
