June 3 , 1968
Regular meeting of the Kent City Council was called, to order at 8 :00 p.m.
Present : Mayor Pro Tem Pozzi , Councilmen : Armstrong, Baffaro, Barnier,
Lee, Masters and Woodworth, City Attorney Bereiter, City Engineer Sherwood.
Minutes of .the last meeting approved as printed and accepted by motion .
HEALTH & ULID #1. The public hearing was opened on the final
SANITATION assessment roll for ULID #1. Thirteen letters of pro-
test and/or requests for corrections were read from
the following: Ferdinand Colla, Louise Sainati, Kent
Industrial Center and Kent Center, by N. W. Clein ,
Northern Pacific Railway, Williams & Turner .on behalf
of Western Gear, Joyce Barnier for herself and on be-
half of Ethel D. Root , Harlan Bull, Mrs. Otis D. Little,
Paul Wieser, Geraldine R. Stone , James H. Rust , Carrie
Costello and Northwestern Mutual Life Insurance Co.
Verbal objections were heard from Jerry Appleton , re-
garding the route of a sewer extension . Mr. G. S. Dunn ,
1034 -West Valley Hwy. , while not objecting to the pro-
ject , noted that the contractors had damaged his water
lines , thus increasing his water bill. James Turner,
Attorney representing Western Gear, requested informa-
tion regarding the assessment amounts . Harry Blange,
of the Boeing Co. , noted that the ownership lines shown
on the tax rolls are incorrect regarding the Benaroya
complex and stated that he would like to have these
adjusted. Mr. Robert Crow, Northern Pacific Railroad
requested verification of property lines of the railroad.
John Stone questioned. the depth of the trunk sewer lines
proposed. Mr. Ramsey noted that they vary and that he
would check into the matter. Mrs. South .asked if the
sewer line would go down So. 196th. Ramsey. stated that
it would not and that she would be liable for the area
charge only, but noted that when sewers are installed on
196th, she would have to pay for later al sewer and
monthly sewer charges. After all who wished to speak
were afforded the opportunity, the public hearing was
closed by motion . Baffaro moved to refer all the queries ,
both verbal and written , to the sewer committee , con-
sulting engineers and bond counsel to report back at the
next meeting with their recommendations for adjustment ,

asked if the protestants can meet further with the
engineers to request adjustments or deletions. The
City Attorney stated that protests can no longer be filed,
but that the people can consult with the engineers prior
to the next meeting, at which time the committee will re-
port . Paul Flint , McLean & Co. , financial advisors to
the city, asked for a fourth council member to be appointed
to the committee in addition to the usual three member
Health & Sanitation -committee , in order to have a council
quorum. Bob Lee was appointed to this committee by Mayor
Pro Tem Pozzi over Armstrongl-s objection to a quorum
committee. Motion carried.
The City Engineer recommended that approval be given for
the installation of the Garrison Creek Interceptor on
portions of the East Valley Highway and So. 218th Street .
Masters so moved, Barnier seconded, motion carried.
The City Engineer recommended approval of Change Order #3
on ULID #1, Contract 1 for Tri-State Construction in the
amount of $2,645. 25 , for relocation of 445 feet of fence
along the West Valley IIighway and So. 212th, relocation of
a manhole and extension of steel casing. Barnier so moved,
Woodworth seconded, motion carried.
HEALTH & The City Engineer recommended that authorization be
SANITATION given to Hill, Ingman & Chase for the study .of the
upper Mill Creek drainage basin , at a cost of $1500.00.
Barnier so moved, Armstrong seconded, motion carried.
Woodworth moved to confirm the Mayor ' s appointment
of Dr. Dona as Health Officer, Lee seconded, motion
carried.
WATER Bids. Woodworth moved to reject bids received on pipe
and hydrants for the water department and for the Clerk
to recall for same , Baffaro .seconded, motion carried.
Lee noted that the water committee met last week to
consider several installations and that a petition for
service for the north end was expected. I
STREETS The City Engineer requested authorization to call for
bids for improvement of So. 228th Street, to be opened
on June 28th. Armstrong so moved, Woodworth seconded,
motion carried.
Barnier recommended that the traffic problem at Smith
and Jason Streets be referred to the street committee
and that the street committee investigate the condition !
of West Gowe Street , Masters seconded, motion carried.
A letter from the First Baptist Church was read asking
the city for clarification as to when a decision would
be made on the East-West route. Woodworth moved to place
the letter on file, Barnier seconded. Under discussion ,
the City Engineer stated that a letter was received on
the 28th of May from the highway Dept. , along with a map
which indicates the southerly route on a preliminary plan .
Woodworth withdrew his motion , Barnier withdrew his second.
Woodworth moved to refer the matter to the street committee
and City Engineer, Barnier seconded, motion carried.
FINANCE Armstrong noted that the finance committee met with the
City Treasurer regarding a proposed 3/ inside tax on
utilities. He stated that the City Treasurer is not in
favor of the ordinance as such. Armstrong moved to forego
the ordinance at the present time and to suggest that if
at any time in the . future funds are needed for the Current
Expense Fund, a loan be made from any utility fund to be
paid back out of the next years budget . Barnier seconded,
motion carried.
POLICE . & A petition , signed by approxiaately 39 residents of the
FIRE Bonel Trailer Park was read, requesting action be taken
to control noise and disturbance created by the Roadside
Tavern on W. Meeker Street . The City Attorney noted that
a copy of the petition had been sent to the Washington
State Liquor Control Board and suggested that the city
coordinate with them regarding this matter. The matter
was referred to the City Attorney by motion .
BUILDING Baffaro stated that the committee is finished interviewing
nine architects and will narrow this down to 2 or 3 and
visit various buildings before making a final decision .
PLAT Highlander_ The public hearing was opened on the high-
lander Plat . At his request , Armstrong was excused from
participating in discussion or voting on the matter. There
. were no comments or objections and the hearing was closed
by motion . Lee moved to approve the plat and to instruct
the City Attorney to draft the necessary ordinance , Masters
seconded, motion carried.
COUNCIL The proposed resolution regarding procedures for council
PROCEDURES meetings was left on the table at Master's request.
PARKS Mrs. Hogan noted that an article in the Seattle Times
indicated that the funding for the Mill Creek Canyon pro-
ject is going through.
ANNEXATION Goodnews Bay. A letter from the Boundary Review
Board was read giving approval to the proposed
annexation . Woodworth moved to set the public hearing
for June 17th, Masters seconded,motion carried.
ZONING Majestic Homes. Ordinance 1517 , approving the Majestic
.Homes rezone from R-1 to C-3 was read. Woodworth moved
for passage of the ordinance, Armstrong seconded, motion
carried.
KGP Investment . It was moved by Baffaro that the public
hearing on the application' submitted by KGP Investment for
a rezone from R-2 to R-3 be continued to June 17th, at
the request of the applicant . Masters seconded, motion
carried.
FORWARD A letter was read from John Porter, County Administrator
THRUST submitting King County Resolution #35366 which establishes
a King County Design Commission to ireview Forward Thrust
projects . Armstrong moved to place the letter and resolu-
tion on file , Masters seconded, motion carried.
OPEN Woodworth reported that the committee appointed by the
HOUSING Mayor to draft a proposed open housing ordinance met at
ORDINANCE 7: 15 this evening at a public meeting and had recommended
that the ordinance be referred to the council for action .
He noted that some typographical errors are to be
corrected and that copies of the ordinance are available.
Woodworth moved that a letter of thanks be sent to the
committee from the city, Masters seconded, motion carried.
The proposed open housing ordinance was read in its
entirety by the City Attorney, including corrections .
There was no discussion from the floor, as all who wished
to speak had been heard at the 7 :15 meeting. Woodworth
stated that lie felt that the full committee should be
allowed to answer any questions that the council has.
Woodworth moved to pass the ordinance. Motion failed for
lack of a second. Lee moved for the next order of .business .
Motion failed for lack of a second. Barrier moved that
action be tabled to the June 17th meeting to allow the
committee to reconsider questions presented at the committee
'discussion , Woodworth noted that the committee voted to
recommend to the council to pass the ordinance at the
regular meeting tonight. Armstrong stated that lie would like
to discuss some points with the committee. Lee opined
that portions of the ordinance should be more clearly de-
fined. Motion carried unanimously. James Curran suggested
that if the council intends to have a public hearing on
the. proposed open housing ordinance, the date should be
set now. Barnier moved' to set such a public hearing for
June 17th, Armstrong seconded. Under discussion , the
City Attorney suggested that the City Clerk be instructed
.to confer with him, regarding public notices . Upon roll
call vote , Armstrong, Barnier, Masters and Baffaro voted
aye. Lee voted nay. Motion carried. (Councilman Woodworth
was not present for this action , having asked earlier to
be excused -at 9:50 p.m. ) .
