March 18, 1968
Regular meeting of the Kent City Council called to order at 8 :00
p.m. Present : Mayor Thornton , Councilmen : Armstrong, Baffaro,
Barnier, Lee, Masters , Pozzi and Woodworth, City Attorney Bereiter,
City Engineer Sherwood
Minutes of the last meeting approved as printed, with the following
corrections authorized by motion : Page 2, bottom of the page , should
read ) easements , to include one for James St. and, Page 5 , under
Car Bids , Strain ' s bid should read S4 , 508.83 .
Treasurer and Budget Reports submitted, accepted and placed on
file by motion.
STREETS Pozzi noted that the street committee and police
committee .met regarding the 6 recommendations re-
ceived from the Chamber of Commerce. He noted that
arrows will be painted on Smith and on 4th Avenue
and that the crosswalk by the Valley Elementary
School will be painted and marked.
1. The Chamber recommends that the existing
ordinance #1329, be enforced and that park-
ing be eliminated on Smith St . from Central
Ave. to Kennebeck Ave.
Pozzi moved that parking be eliminated on the
South side of Smith from Central to Kennebeck
from 3 :00 to 6 :00 p.m. , Woodworth seconded,
motion carried. Pozzi noted that parking would
. be eliminated completely if the traffic counts
warrant it.
2. Proposed by the Chamber:. in order to alleviate
traffic flow problems for traffic traveling
east and west on Smith St : at the intersection
of Central & Smith, it is recommended that the
no left turn sign be eliminated at that inter-
section for east bound traffic , thus permitting
left turns onto Central by both east and west
bound traffic . Pozzi noted that a letter had
been received from the Highway Department , stating
the proposal was not recommended.
The Committee recommended that no action be
taken on this.
3 . The Chamber recommends that all parking be
eliminated on the north side of Smith Street
between Central Avenue and 1st Avenue .
Pozzi moved that all parking be eliminated
on the north side of Smith from Central to the
first alley (west ) , Woodworth seconded, motion
carried.
4. The Chamber .recommends that parking be pro-
hibited on Central Avenue from James 'St. south
to the Green River.
pozzi noted that the committee recommends no
action at this time , but suggests that parking
be restricted for all new construction from
Titus St . south to the Green River.
STREETS 5. The Chamber recommends that parking be eliminated
on Meeker St.from 4th Avenue west to the
Milwaukee tracks and that this action coincide
with the opening of the Willis St . interchange.
Pozzi moved to approve this recommendation ,
Woodworth seconded, motion carried.
6 . The Chamber recommends that on-street parking
be eliminated from Willis St . north to James on
4th Avenue and for the installation of .the safest
type of pedestrian signals across 4th Avenue at
the Kent Elementary School.
Pozzi moved that all parking on 4th Avenue on the
west side of James St. to Willis St . be eliminated,
Woodworth seconded, motion carried. Pozzi moved
that the City Engineer write to the State Highway
Department requesting a flashing caution light at
the crosswalk at Titus and 4th Avenue at the
elementary school, Woodworth seconded, motion carried.
Pozzi moved that parking be eliminated on the east
side of Fourth from James to -Titus , including the
south property line where Dr. Dona' s office is
located, Woodworth seconded, motion carried.
A letter from Mr. Foster of the Highway Department .was
read reporting that they will place shoulder stripes
and delineators through the Happy Canyon vicinity, and,
if possible , reflectors:zed buttons along the center line.
Woodworth moved that a letter of thanks -be sent to Mr.
Foster , Pozzi seconded, motion carried.
Off-Street PaELjRZ. Ted Strain noted from the
audience that his family would like to meet with the
Chamber regarding the proposed off street parking pro-
ject. Jim Curran stated that the Chamber would arrange
such a meeting.
Traffic Control. The Mayor asked about the possibility
of getting a road in on S. 208th to relieve the bottleneck,
west of the tracks . Pozzi stated that attempts to secure
right of way had failed. It was noted that the Planning
Commission suggested a road between Rainier Pallett and
Aero Structures or the possibility of tying 80th Avenue
into S. 200th coming out by Heath.
The Mayor requested the City Engineer to check to see
if approval had been received to use 1/20 gas tax money
for the light on So. 240th and Pacific Highway S.
72nd Avenue . Pozzi moved to accept a right of way offered
by Puget Power for the proposed 72nd Avenue and that a
letter be sent to them stating that at this. time , the
city will not require that lines be bu.r ied at their new
substation site, but that at such time as it becomes
econimically feasible , the lines be buried, Masters
seconded, motion carried.
HEALTH & The City Engineer presented a Bill of Sale from Mr.
SANITATION Dehnert for 'the sewers , water mains , storm sewers and
street improvements in Dehnert ' s Addition and recommended
that it be accepted by the city and that the city assume
full jurisdiction of the improvements. Pozzi so moved,
Armstrong seconded, motion carried.
The City Engineer presented copies of easements from
Northern Pacific Railroad. for two crossings of their
main line tracks , one with a 72" line for the Valley
Interceptor sewer at So. 194th, and the other a 27"
sewer line at Novak Lane. The permit fee is $400.00
and the City Engineer recommended that the easements be
accepted and the fee paid. Barnier so moved, Masters
seconded. Under discussion , the City Engineer stated fees
had been paid for the last several easements. It was
noted that the term of the permit was not specified in
years. Upon the City Attorney' s recommendation , Woodworth
moved to refer the easements back to the NPRR for re-
drafting, noting that they should be queried, as to how the
fees were determined, Masters seconded, motion carried.
HEALTH & The City Engineer presented two easements from
SANITATION Puget Power for sewer lines and water mains at
So. 192nd and recommended that they be accepted.
Pozzi so moved, Woodworth seconded, motion carried.
A letter was read from Mr. Gibbs of Metro ad-
vising that a meeting will be held on April 2,
at 8 :00 p.m. in the Metro Conference Room to •
discuss proposed changes to the penalty pro-
visions of Metro ' s Rules & Regulations. It was
noted that Councilman Barnier will attend.
Resolution 589, regarding appropriations for
health services was read by the City Attorney.
Woodworth moved for passage of the resolution ,
Barnier 'seconded, motion carried.
Bids. The City Engineer noted that the city
received bids today on the Central Valley Inter-
ceptor sewer project , which would be tallied and
presented at the next meeting.
Beautification. Mayor Thornton proclaimed the
week of March 24 through 30 as official Clean-up
Week in Kent . Pozzi noted that no rocks would
be picked up by the city crews. Harry Williams ,
Chamber committee chairman explained the details
of the project .
Barnier stated that he felt that the political
posters should be posted no more than 30 days .
Pozzi suggested that a committee be formed to
meet with the City Attorney to discuss enforcing
this. Barnier , Woodworth, and Pozzi were appointed
to the committee .
The Mayor suggested that three homes be disposed
of as unfit for habitation , noting that the owner
had concurred. Pozzi moved that the Mayor and
City Attorney write a letter to the owner of these
buildings , after the Engineering Dept. had filed
an "on site findings" report , Armstrong seconded,
motion carried.
WATER Lee noted that the sewer and water committees met
with Mr. Henning regarding the request for city
sewer and water service and had explained the pro-
cedure 'to follow under these circumstances.
A letter from Edgar R. Rombauer, Attorney was read
requesting information regarding the sale of a
water contract for a proposed new development in
Kent. Pozzi moved to refer the matter to the City
Engineer and water committee , Armstrong seconded,
motion carried.
FINANCE The Mayor introduced the Price-Waterhouse report
regarding updating the city' s accounting system.
Pozzi moved for the City Attorney to draft an emergency
ordinance to provide the necessary funds for engaging
a programmer and leasing equipment , Barnier seconded,
motion carried. Lee moved that the report be referred
to the Finance Committee for study in the interim,
Armstrong seconded, motion carried. The Mayor stressed
the importance of prompt action on this project ,
pointing out that the state auditor had reported that
the city had not invested some surplus funds , thereby
losing the interest such an investment would have earned.
BUILDING Baffaro reported that a meeting was scheduled for
March 19 at 7 : 30 P-m. to review proposals of various
architects regarding the new city hall.
APPEAL By motion , the public hearing was set for April 15th
on the appeal filed by Mr. Wasnick on the action of the
Board of Adjustment in refusing to grant a variance to
allow construction of a 7 uriit apartment in an R-2 zone.
Pozzi voted nay.
CITY HALL Ordinance 1501, providing fot the issuance of #1,130,000.00
BONDS of "City Hall General Obligation Bonds, 1968" was read
by the City Attorney. Pozzi moved for passage of the
ordinance , Armstrong seconded, motion carried unanimously.
BIDS Garbage Consinners. The following bids were read for
50 two yard containers for the garbage department :
Capital Industries $6 ,897.50 + tax, FOB Kent
Worthington Container 7, 250.00 + tax, FOB Kent
Paul Haggard 7 , 500.00 tax, . FOB Kent
DeWald Northwest 7 , 580.00 1- tax, FOB Kent
McElhose Welding 9 ,620.00 + tax, FOB Klcnt
Woodworth moved to award the bid to Capital, low bidder ,
Masters seconded, motion carried.
Trucks - Street Dept . The following bids were read
for two trucks for the street department :
Bill Hazelett $3 , 864.68, plus tax
Bowen Scarff 3 , 994.00, plus tax
Valley Garage 4 ,011.02, plus tax
Bazrnier moved to award the bid to Bill Iazelett , low
bidder, Pozzi seconded,motion carried.
PLANNING Resolution 588, authorizing transfer of $1, 500.00 of
OOMMISSION Planning Commission funds from Maintenance & Operation
to Salaries & Wages , was read by the City Attorney.
Woodworth moved for passage of the resolution , Pozzi
seconded, motion carried.
ZONING R-5. Mr. Poole noted that the Planning Commission had
two details to resolve regarding consideration of deleting
R-5 zoning from the present zoning ordinance. Woodworth
suggested that public notices be placed in the newspaper
prior to further discussion of this matter at a council
meeting. Poole stated he would attend to it .
A letter was read from Mr. Henning requesting confirmation
of the zoning of property owned by him at 26441 104th S.E.
Woodworth moved that the letter be referred to the City
Attorney for appropriate answer, Masters seconded, motion
carried.
COUNCIL The proposed resolution regarding procedures for council
PROCEDURES meetings was left on the table to be considered at the
next meeting.
KENTWOOD Ordinance 1502, approving the plat of Kentwood Hills #2
HILLS #2 was read by the City Attorney. Armstrong moeed for
passage of the ordinance, Lee seconded, motion carried.
KENTWOOD Ordinance 1503 , approving the plat of Kentwood Hills #3
HILLS #3 was read- by the City Attorney. Armstrong moved for passage
of the ordinance, Lee seconded, motion carried.
GREEN VALLEY Ordinance 1504 , approving the plat of Green Valley Heights
HEIGHTS #6 and repealing Ordinance 1468 was read by the City
Attorney. Woodworth moved for passage of the ordinance ,
Armstrong seconded, motion darried.
ANNEXATIONS Ortiz. The public hearing was opened on the proposed
Ortiz annexation. . There were no comments or objections ,
and the hearing was closed by motion. Pozzi moved to
accept the annexation and to instruct the City Attorney
to draft the necessary ordinance, Woodworth seconded,
motion carried.
Lorentson . The public hearing was opened on the pro-
posed Lorentson Annexation . The Mayor excused Armstrong
from the discussion , at his request , as his wife ' s family
are proponents of the annexation . Mr. Zacharias asked
if he was included in the annexation and was told that
he was. There were no further comments and the hearing
was closed by motion . Woodworth moved to accept the
annexation and to instruct the City Attorney to draft
the necessary ordinance , Masters seconded, motion carried.
Kaltenbach. The public hearing was opened on the pro-
posed Kaltenbach annexation . The City Attorney stated
that one of the attorney's in his office represents a
seller in connection with this property. Mr. Bastian ,
attorney representing some owners in the area stated he
was satisfied that there was no conflict of interest in
the matter. At Mr. Brewer ' s request , the City Engineer
explained that if there is an LID formed to extend sewers
in -that area and Mr. Brewer ' s property was involved, he
would share in the expense. Barnier stated that he felt
that all of the people involved in annexations should be
notified personally. Pozzi moved to close the hearing,
. Woodworth seconded, moti.on . carri.ed. Woodworth moved to
accept the annexation and to instruct the City Attorney
to draft the ordinance, Lee seconded, motion carried.
ARMSCREST #5 A bill of sale from Hauge Construction Co. for street
improvements and water mains on Woodland Way in Armscrest
#5 was presented by the City Engineer . Masters moved to
accept the bill of sale, Barnier seconded, motion carried.
CONFERENCES & Pozzi moved to authorize the City Engineer and Assistant +,
CONVENTIONS City Engineer to attend the APWA Conference in Longview
on April 10, ll and 12. Lee seconded, motion carried.
