December 18 . 1967
Regular meeting of the Kent City Council called to order at- 8 :00 p.m-
Present : Mayor Thornton , Councilmen : Armstrong Baffaro , Barnier ,
Lee,, Masters , Pozzi and Woodworth , City Attorney Bereiter, City
Engineer Sherwood.
Minutes of the last meeting approved as printed with the following
correction which was authorized by motion : Regarding the consideration
of granting a spur track crossing at 84th Ave. S . to NPItR• Woodworth
out that the ordinance
pointed lists certain restrict:ons and would
not permit rail traffic from 6 :00 a-m, to 9 :00 "111 and 3 :00 p.m. to
6 :00 P.M.

STREETS Railroad Spur - EVH• A letter from Denver Grigsby , �I
President of the Chamber of Commerce , was read
recommending that the council consider the postpone►nent
of a decision regarding the granting of a railroad spur
track across the EVII until further study can be made
and that the final consideration of the matter be post-
poned until the council meeting of February 6th. Pozzi
moved to place the letter on file . Armstrong seconded ,
motion carried.

Kent and expressed surprise that a progressive city
like Kent did not exert more contro-1 at railroad inter-
sections . Barnier requested that the City Attorney draft
amendments to the railroad crossing ordinance in question
and to the ordinance previously passed granting a spur
track crossing at 68th Ave , to include requirements for a
grade separation . Pozzi stated that he did riot think
there was room for a grade separation . Barnier opined.
that there should be an overpass or an underpass and
Mayor Thornton stated that this was not practical.
Paul Barden stated that maybe with the participation
of all parties concerned railroad, state , city , etc .
the problem could be resolved. Bob Fennell of Benaroya
stated that they are willing to cooperate in this project .
Woodworth stated that he had no objection to the delay
the chamber has asked for . but noted that if such an
amendment were added to the ordinances in question .

Woodworth moved to table the motion until the Feb. 5th
meeting and that the affected parties be notified by
letter , Baffaro seconded motion carried over Pozzi ' s nay.
Barnier requested that the street committee look into
the possibility of having crossarms installed on our
downtown railroad crossings . Pozzi stated that he will
check into the matter.
Street Vacations . Ordinance 1495 , amending the street
vacation ordinance and incresing the filing fee from
$50 to $100 was read by the City Attorney. Pozzi moved
for passage of the ordinance Baffaro seconded. Under
discussion Woodworth stated that he felt -the figure
$100 was insufficient and moved to amend -the ordinance ,
to increase it to $150.00 Barnier seconded the amendment .
Amendment and motion carried unanimously-
So. 228th - LID 255 . Resolution 585 , declaring the city ' s
intention to form LID 255 for improving So. 228th from
the East Valley highway to the West Valley Ilighway and
setting the public hearing for February 5th was read
by the City Attorney. Pozzi moved for passage of the
resolution Woodworth seconded motion carried.

The City Engineer presented an easement from the Chicago
Milwaukee St . Paul & Pacific Railroad for the west end
of Gowe Street and 6th Ave. and recommended that the Council
authorize payment of S100.00 contingent upon the City
Attorney' s approval of the document. Pozzi so moved Armstrong
seconded, motion carried.
Pozzi noted that the City Engineer has written to the -Peter
Kiewit Co. regarding streets that they have damaged in con-
struction of the Valley Freeway and that no action has been
taken. He moved that a letter from the Mayor be sent requesting
that they replace and restore the streets immediately as
outlined in the City Engineer ' s letter Barnier seconded motion
carried.
LIGHTS Masters noted that insufficient lighting is creating a
traffic hazard in the Kent Des Moines Road west of the
Russell Road to approximately 1/4 mile beyond the Happy
Canyon Tavern . She stated that this is a portion of
state highway and that Puget Sound Power & Light will
explore the problem. The Mayor pointed out that this
road will be four laved and a new bridge across the
river will be built in 1969 and that the matter will be
brought to Mr. iFoster' s attention At a meeting scheduled i
for tomorrow evening. Woodworth moved that the lighting
committee Chairman be given power to act . after proper
consultation With PSP&L, Pozzi seconded. motion carried.
HEALTH & Barnier noted that the treatment plant is completed
SANITA- except for seeding and the addition of one circuit breaker
TION and that certified checks have been deposited with the city
to assure compliance. lie moved for change order $4 to be approved
for Mottner & McCutcheon . subject to the completion of these
two items by June 1 , 1968 Woodworth seconded ; motion carried.
Barnier stated that it was brought to his attention that
there is a rat problem in the area east of the Kent Junior
High and noted that individuals should keep the lids on their
garbage cans and keep the yards cleaned up to prevent the
problem.
POLICE & Woodworth noted that a meeting had been held regarding the
FIRE retirement program for employees and. an agree►gent had been
reached to reaffirm the city policy of mandatory retirement
at age 65 . Pozzi so moved , Barnier seconded , motion carried.
Woodworth stated. that the license committee met with TV
cable applicants and are waiting pertinent information necessary
for drafting the ordinance.
A letter from the Tukwila Fire .Chief was read thanking the
Kent Fire Dept . for their aid on a fire call on December 3.
Woodworth moved to place the letter on file , Armstrong
seconded , motion carried.
PARKS & A letter from Barney Wilson was read requesting permission to
RECREA- lease property adjacent to the treatment plant,west of Kent for
TION park use. Pozzi moved to refer the matter to the Health &
Sanitation , Finance Committee and Park Liaison Officer, Lee
seconded . motion carried.
A letter from Peter Baffaro was read submitting his resignation
as a member of the Park Board. Woodworth moved that the letter
be accepted and placed on file . Barnier seconded ., motion carried.
Barney Wilson noted that the Interagency Committee has approved
the •funding for the Mill Creek Canyon property. He noted that
the park plan portion of the John Graham plan was accepted by
council motion and asked if a resolution was necessary. The
City Attorney opined that the Council action was sufficient , but
that if necessary he would draft a resolution .

CITY Ordinance 1494 , defining the duties of City Supervisor
SUPERVISOR was read by the City Attorney. Pozzi moved for passage
Armstrong seconded . Under discussion Woodworth stated
that he would like time to study the ordinance before
voting. James Curran stated that he felt that the public
should be aware of the contents of the ordinance before
action is taken . Upon roll call vote , the motion passed.
Armstrong� 'Baffaro Masters and Pozzi voted aye Woodworth
Barnier and Lee voted nay.
SUNRAY The 10% petition for the Sunray Annexation was presented
ANNEXATION along with a letter from the City Engineer certifying that
signatures thereon represent owners of property aggregating
more than 10% of the assessed valuation . Pozzi moved to
refer t'he mattter to the annexation committee -Barnier
seconded motion carried.
GOODNEWS BAY The 10%, petition for the Goodnews Bay Mining Co. Annexation
MINING CO. was presented along with a letter from the City Engineer
ANNEXATION certifying that signatures thereon represent owners of
property aggregating more than 10510 of the assessed valuation .
The matter was referred to the annexation committee by
motion .
KENTWOOD By motion public hearings were set for January 2 on the
HILLS #2 plats of Kentwood Hills #2 and Kentwood Hills #S-
AND #3
ZONING Monarch Investment . The public hearing deferred on November
2 th, to this date was reopened can the application for a
rezone. from R-1 to R-3 for Monarch Investment for approxi
mately 16.5 acres situated south of S . 252nd between Military
Road and 38th So. It was noted that the Planning Commission
recommended approval , under conditions outlined in their
minutes. Mr. Briggs explained the proposed garden court
complex plan containing units which would rent from $100
to $150 a month, with 53% open space and recreation facili-
ties , and two parking places for each unit . Pictures. of
the proposed development were shown . ' r. Briggs then read
a letter from Ward Smith Inc . and stated that Dick Cady of
Coast Mortgage and the financer of the Yorkshire Addition
were in favor of the proposed complex. A petition against
the rezone, containing 237 signatures was submitted to the
City Clerk. Irvin Haugland, John Taylor, Don Knapp, Lou
Koszarek, Mr. Jones , Janet Smith and Mr. Sundsted all pro-
tested the proposed zoning change. Among their objections
were : increased traffic on Military Road - the possibility
of using 38th S. as an access , thus increasing traffic on
that road, the water pressure problem in that area, the .
establishment of a multiple zone in a single family resi-
dence area and increased loading of the schools. The City
Engineer noted that the improvements to the water system
would be completed within the next few months . Mr. Briggs
was asked if he had an option on the 16 acres across the
street from the proposed development . He replied that he
had no interest in that site whatsoever. The opponents to
the rezone expressed concern that if the Monarch rezone was
approved another similar development would be proposed
for this adjacent site. Pozzi asked if the residents of
the area would like the city to initiate an LID for improve-
ment of 38th S. There was no interest shown in this pro-
posal. . After extensive discussion and comment by those
present , the public hearing was closed. Pozzi moved that
the recommendation of the Planning Commission be upheld and
the rezone be granted for reasons outlined in their minutes ,
Armstrong seconded. Under discussion , Armstrong asked the
City Attorney if this rezone would meet with requirements
of our present comprehensive plan . The City Attorney stated
that he could see nothing in this proposal that is incompatible
to our comprehensive or zoning plans. Woodworth commented
that lie felt this was a fine proposal, but that the R-1
zoning must be preserved and that there were numerous vacant
multiple zoned sites available . Baffaro agreed. Upon roll0h
call vote , Armstrong, Pozzi and Lee voted aye , Baffaro,
Woodworth, Masters and Barnier voted nay. Motion failed.
Woodworth moved that the rezone request be denied in the best
interest of the health & welfare of the citizens of Kent ,
Barnier seconded. Upon roll call vote , Armstrong, Pozzi and
Lee voted nay and Barnier, Masters , Woodworth and Baffaro
voted aye. Motion carried.
BIDS Publishing. The following bid was read for printing of the
city' s legal publications : Valley Publishing Co.
For publication in the ISent News Journal :
3 point type : $3.00 per 100 words for 1st publication
$2.20 per 100 words for addt ' 1 publication
Alternate bids were submitted for 5-1/2 or 6 point type
and .for publishing in the Valley Times .
By motion , the bid for 8 point type for the Kent News Journal
was accepted with the option to publish in the Valley Times ,
if necessary.
