Regular meeting of the Kent City Council called to order at 3 :00 p.m.
Pro Tem Pozzi , Councilmen : Armstrong , Buxton , Durand.
Present : Mayor
Mooney, Strain and Woodworth, City Attorney Bereiter , City Engineer
Sherwood
Minutes of the last meeting approved as printed and accepted by
motion , with the following corrections , which were passed by motion :
Page 5 , the minutes state that Noel Bicknell noted that the city should
take steps to become members of the PSGC and the King County Air Pollution
Commission , it should be corrected to read Mayor Thornton noted . . .
also Page 5 , regarding the proposed Ortiz Annexation . the minutes state
that the City Engineer noted that water and sewer extensions are in the
city now, . . . . should be corrected to read "are under city jurisdiction
now" .

WATER Water Main - So. 218th. Strain noted that final engineer-
ing is complete on this project and that hearings on the
related condemnations are set for October 24th.
Fire Control. Mooney commented on the recent $750 ,000.00
fire loss at an Auburn school and noted that this could
occur in Kent due to the lack of water and insufficient
fire hydrants . Ile stated that Scenic Hill , Sequioa , Kent
Meridian High and East Hill Elementary are all too far
from the existing hydrants . Mooney moved that the Fire
Chief and City Engineer be instructed to make a survey of
the existing fire fighting services for the schools and
to make report as to what steps should be taken , with
notification of this action to be forwarded to Mr. Iles
and Don Orr. Strain seconded , motion carried. Mooney
noted that , if necessary, the city should take steps to
initiate an LID for additional hydrants .
Strain reported that the six million gallon reservoir is
67% complete.
LID 252. Strain noted that ordinances authorizing con-
demnations for easements required for the water main
right-of-way is prepared and plans & specifications are
being checked and prepared for submittal to EDA. Strain
stated that all efforts should be made to negotiate for
easements before condemnation is enacted. The City
Attorney explained that because of a time factor , the
City could pass the condemnation ordinances in case an
impasse is reached in negotiations , and that all reason-
able effort will be employed to secure the easements both
for this project and for street and_ sewer projects now
pending. Armstrong agreed with Strain . stating that lie
was not in favor of condemnations without sufficient
negotiations with the property owners involved . Ramsey
explained that the ordinances prepared for these projects
should be passed tonight so the matters could be placed
on the spring court calendar if all negotiations fail.
Ordinance 1487 , providing for condemnations for easements
for the North rater System was read by the City Attorney.
Durand moved for passage of the ordinance , Buxton seconded ..
motion carried. Armstrong voted nay.
Strain moved that James Gay be authorized to prepare a
plans and system ordinance amendment covering the test
drilling work at Icy Creek, the 16" water main extension
on East Valley Highway . the line extension from approxi-
mately 250th South to the elevated tank on Military Road
and the preparation of the comprehensive water report .
Phases 1 and II . Buxton seconded, motion carried.
HEALTH &
ULID >�{1. Ordinance 14f36 , providing for condemnations
SANITATION for easements for the North Sewer System (ULID #1) was
read by the City Attorney. Strain moved for passage of
the ordinance, Mooney seconded , motion carried. Armstrong
voted nay.

Resolution 581, authorizing the City Clerk and City
reasurer to transfer $10 ,732.60 budgeted for 1967
for Sewer Dept. - Capital Outlay Sewer Repair (Smith-
i NP Crossing) into Sewer Dept . - Capital Outlay - Sewer
Repair (James St. Emergency Repair) was read by the City
Attorney. Strain moved for .passage of the resolution ,
Mooney seconded , motion carried.
Mooney moved to authorize IIIC, in accordance with their
agreement dated September 18 . 1967 , to do the engineering
and prepare the necessary information to submit to James
Gay for preparation of a plans and system ordinance for
the proposed sanitary sewer ULID to serve the Garrison
Creek Area east of Kent , Strain seconded, motion carried.
Metro. The City Engineer recommended that the city grant
a permit for Metro to install their North end trunk across
the intersection of 80th Avenue and So. 138th. provided
jthat restoration requ irements of the city are root.
Mooney so moved , Armstrong seconded , motion carried.
Des Moines Sewer District . The City Engineer recommended
that the request from the Des Moines Sesser District to
place a sewer line in a portion of South 24Oth in order
to serve the Midway Drive-In Theatre be granted , subject
to receiving an adopted resolution providing for the extension '
of the boundaries for the sewer district . Woodworth so
moved, Buxton seconded, motion carried.

A request from Frank Chinella was read relative to
connecting to the Kent sewer and water systems for 25
acres east of the Park Orchard school. By motion , this
was referred to the IIealth & Sanitation and Water Committees.
Mooney noted that a study should be made on the best route
for the Garrison Trunk so that in the future , small
parcels will not have to request sewer connections.
STREETS So. 212th. Ordinance 1484 , providing for condemnations �
for the So. 212th project was read by the City Attorney.
Strain moved for passage of the ordinance , Durand seconded,
motion carried. Armstrong voted nay.
So. 228th. Ordinance 14II5 , providing for condemnations
for the So. 228th project was read by the City Attorney.
Woodworth moved for passage of the ordinance , Mooney
seconded, motion carried. Armstrong voted nay.
Durand moved that HIC proceed with engineering and pre-

paration of required maps and preliminary assessment-
information for the purpose of presenting information to
the people at a public meeting relative to improvement of
So. 228th St . & James Street . Strain seconded , motion
carried.

Durand moved for approval of necessary funds for the
engineering and design for channelization and a traffic
light at So. 2110th and Highway 99 , Mooney seconded, motion
carried.

--- Lou Peretti stated that last year Rentonites , Inc. presented
CO RECTED • REFER TO a deed to the City for a 60, wide strip for S.E. 239th, noting
MINUTES OF that the deed has never been recorded. Ile requested that
the deed be returned if the city doesn 't want it . Strain
moved to refer the matter to the street committee , Durand
seconded, motion carried.

STREETS The City Attorney noted that the Assistant City
Engineer has informed him that illegal cuts had
been made into an alley in the Knob Hill Addition
and that orders to desist from the Engineering
Dept . had been ignored. The City Attorney was
instructed by motion to take appropriate legal action .

A letter from J . Arthur Stewart , Principal of Kent-
Meridian High School was read expressing gratitude
to the City for the street lights installed in front
of the school and requesting a traffic control signal
on the highway at the main entrance to the school.
i Mooney moved that the matter be referred to the Street
Committee . Strain seconded , motion carried.
POLICE & Bids. The following bids were read for two cars
FIRE for the Police Dept . all with trade and including
tax : Bowen Scarff $3 , 149.64 . Strain ' s $4 , 197.10,
'Bill Hazelett $2 . 560.17. Strain moved to award the
bid to Bill Hazelett Chevrolet low bidder , Mooney
j seconded , motion carried.
Resolution 582 , authorizing the City Clerk and City
Treasurer to transfer $2000.00 within the Police Dept.
19 67 Budget was read by the City Attorney. Woodworth
moved for passage of the resolution , Durand seconded .
motion carried.
Woodworth noted that he met last week with Mr. Buckley
.of the NP Railroad regarding Mrs. Bower ' s complaint
regarding the excessive train whistles . Woodworth read
a letter from Mr. Buckley in which he assured the city
that he would do whatever could be done to relieve the
situation . Woodworth moved that a copy of this letter
be sent to Mrs. Bower Armstrong seconded , motion carried.
FINANCE A letter from the City Treasurer was read requesting
approval of transfers of funds in Sewer Construction
and Bond funds as outlined in a report attached thereto.
On Armstrong' s motion , the matter was referred to the
Finance Committee and Mayor, with power to act .
A letter from the City Treasurer was read requesting
reinvestment of $400 ,000.00 U. S. Government 60-day
Treasury Bills to credit of Metro Sewer Revenue for a
period of 30 days . Armstrong so moved, Durand seconded ,
motion carried. j
BUILDING Buxton reported that the Mayor , Finance Chairman and
he had met with school officials regarding the proposed
purchase of the Valley Elementary School and that
negotiations will be continued.
PLANNING A letter from Noel Bicknell , Chairman of the Planning
Commission was read recommending Mr. Mr. M. G. Poole for
the position of Planning Director. Mooney moved that
the matter be referred to the Mayor , Buxton seconded
motion carried.

PARKS & Resolution 584 , authorizing application for open space
RECREATION funds to the Interagency Committee for Outdoor Recreation
was read by the City Attorney. Mooney moved for passage
of the resolution . Strain seconded , motion carried.
CITY HALL Pozzi noted that the Kent Citizens Committee had arranged
a public meeting at the Kent City Hall on Wednesday,
October 18 at 8 :00 p.m. to present facts concerning the pro-
posed bond issues. IIe urged all voters to attend.
PUGET SOUND Resolution 5831 establishing the City of Kent as a
GOVERNMENTAL member of the PSGC was read by the City Attorney. Buxton
CONFERENCE moved for passage of the resolution , Woodworth seconded
motion carried.

CITY Ordinance 1433 , establishing a sick leave policy for all
EMPLOYEES non-civil service employees of the city wa.s read by the
City Attorney. Armstrong moved for passage and adoption
of the ordinance , Woodworth seconded . motion carried.
ARCHEY The public hearing was opened on the Archey appeal on the
APPEAL Board of Adjustment ' s decision to deny his request for a
variance on parking regulations for a proposed office
building in the downtown area. The City Attorney read a
letter from Mr. Baldwin , quoting from Section 10.11.03 of
the zoning ordinance , stating that if 50% or more of a
given block already has structures on it for which no off-
street parking provision has been made , the remaining pro-
perty owners shall not be required to provide off-street
parking facilities. The letter further stated that the City

plan does not show adequate parking facilities . The City
Engineer noted that the application for the building permit
was filed after the Board of Adjustment had made their
decision . Mr. Baldwin noted that the proposed plan included
i 24 parking spaces and that this would be supplemented by
additional parking space in the Catholic Church parking lot ,
for which he already has an oral agreement . Resolution
of the Board of Adjustment was read aloud, at the request of
the City Attorney who then stated that a factual determination
as to what constitutes a "block" will have to be made to clarify
the intent of the ordinance. Bereiter further explained that
two appeals are involved here , one on the decision of the
Board of Adjustment to deny the variance which should now be
decided by the council and one appealing the action of the
City Engineer in denying the building permit . which should be
filed with the Board of Adjustment . Both Tom O' Connell ,
Postmaster and J. P. Curran , objected to the request for the
variance on the grounds that there was already insufficient
parking downdown . After all who wished to speak were afforded
the opportunity , the public hearing was closed. Mooney moved
for the Board of Adjustment ' s decision to be upheld and for
the variance to be denied for the same reasons outlined in
their Resolution #6£3, Woodworth seconded. Under discussion ,
Durand stated that he felt that all of the facts were not
brought out at the Board of Adjustment meeting. Armstrong asked
the City Attorney if Baldwin had correctly quoted the zoning
ordinance and was answered in the affirmative. Upon a tie vote
with Armstrong , Durand and Buxton voting nay, Mayor Pro Tem
Pozzi voted in favor of the motion . Motion carried.
CONFERENCES & Authorization was granted by motion for Bob Kristofferson to
CONVENTIONS attend the Pacific Northwest Pollution Control Association in
Yakima, October 25 through 28th and for the City Clerk to attend
the Washington State Finance Officers meeting in Yakima,
October 18 through 21st.
Strain ' s motion , seconded by Armstrong was passed approving
the following claims :
