Regular meeting of the Kent City Council called to order at 8 :00 p.m.
Present : Mayor Thornton , Councilmen : Armstrong , Buxton , Durand, Mooney,
Pozzi , Strain and Woodworth, City Attorney Bereiter, City Engineer

Treasurer ' s report submitted, accepted and placed on file by motion . I
HEALTH & Mooney stated that the Health & Sanitation Committee
SANITATION and City Engineer had met with Bill Davidson , property
owner living on the "S" curve of the Benson Highway who
requested to connect to sewers . Mooney moved to allow
this , on a temporary basis , until the Garrison Creek
Canyon line is constructed, as discussed with the City
Engineer. Strain seconded , motion carried. Mooney
stated that the committee recommended that if the City
is to serve this area, a program should be developed
whereby they either annex to the city or form a ULID.
He also stated that the committee had referred interested
parties to the annexation committee.
STREETS Comprehensive Plan - 72nd Ave . The public hearing was
opened on the desirability of incorporating into the
Comprehensive Plan an 80' right-of-way for 72nd Ave.
from S. 180th to S. 228th. It was noted that the
Planning Commission recommends approval. Mr. Toddhunter
of PSP&L objected, stating that this proposal would bisect
their property purchased for a switching station for
serving the valley, and would necessitate fencing and a
tunnel , thus increasing PSP&L' s costs approximately $25 ,000.
Mr. Niewenhuis of Western Processing Co. stated that this
proposal would reduce his already narrow property by about
10%' Ile suggested that the proposed arterial run parallel
to and West of the West Valley Highway. Objections were also
heard from Mr. Tom Montgomery. Noel Bicknell stated. that
there were a number of objectors at the Planning Commission
meeting , all of which were considered before the Planning
Commission made its recommendation of approval. Herb Reed ,
representing Kent Industrial Center and Cohen noted that
this proposal would afford good access for PSP&L. Bill
Chase stated that there are only small sewers in the area.
A lengthly discussion followed wherein it was pointed out
that the legal description did not include the area from
180th to 182nd. The City Engineer opined that the legal
notice implied an 80, strip for the entire piece , from
180th ,through to 228th, and that there was already a 50'
right-of-way from 180th to 182nd. The City Attorney noted
that the area in question should be clarified. Bicknell
pointed out that the matter would be heard again as part
of the new comprehensive plan , prior to its adoption.
There were no further comments or objections and the hear-
ing was closed by motion . Durand moved to refer the matter
back to the Planning Commission for clarification of the
legal description , seconded and carried.
Bouldron . The City Engineer noted that a private party is
blocking Bouldron Way and opined that that portion has
become a public right-of-way by prolonged continuous use.
He noted that loads of material have been dumped there to
prevent access . The City Attorney asked if it was necessary
for public use and Mr. Bouldron stated that he used Prospect
Ave. but that the garbage and delivery trucks use Bouldron
Way. Armstrong moved to refer the matter to the City
Engineer , Police and Street Committees , Woodworth seconded,
motion carried.

Arterial—St .--Plan. Mooney moved to set the hearing
for October 2 to revise the 6 year arterial street plan to
include So. 212th from the Valley Freeway easterly to So.
208th and for a portion of Pacific Highway, from Des
Moines Rd. to So. 240th St . , Armstrong seconded, motion
carried.
The City Engineer recommended against accepting the deeds
submitted by Bert McNae for a 60' right-of-way, for 65th
Ave. So. , as to do so would create a 30 foot jog on Meeker i
Street . Mr. Deal , representing Bert McNae , stated that
Benaroya Co. was unwilling to donate the 30' which would
line u the streets and eliminate the job. Woodworth

noted that at a preliminary meeting , the street committee i
had elected to reject the deeds. Strain moved to refer
the matter to the Street Committee and Mooney seconded.
Motion carried over Woodworth' s nay.
The public hearing on the Teter request
STREETS Teter Vacation.
'I for vacation of a portion of alley in lower Scenic Loop
was opened. It was noted that the Planning Commission
recommends approval. Bob Frost of 421 Scenic Way voiced
an objection which was withdrawn after the City Engineer
clarified the exact location and limitations of the pro-
posed vacation . There were no further comments or ob-
j jections and the hearing was closed by motion . Woodworth
moved to approve the vacation and to instruct the City
Attorney to draft the necessary ordinance , Strain seconded ,
motion carried.
A letter from Norwood Cunningham was read expressing his
appreciation for the blacktopping on James St. The City
Engineer noted that Kendall ' s crew and the Street Committee
had worked very hard on this project . Woodworth moved to ;
place the letter on file . Buxton seconded, motion carried.
WATER Strain moved that the Mayor and City Clerk be authorized
to sign an agreement with Hill , Ingman and Chase updating i
our comprehensive water plan and basic engineering terms , i
subject to approval of form by the City Attorney, Durand
seconded , and motion carried.
Bids . The following bids were read on the Clark Springs

L. R. Gaudio Schedule A 19,670.00
Tacoma Schedule B 3 , 140.00
Strain moved to award the bid to Richardson Well Drilling
low bidder , subject to EDA approval , Armstrong seconded,
motion carried.
Strain statedthat it has come to his attention that i
contractors are using water from fire hydrants without
city approval , and the City Attorney noted that this was
prohibited by ordinance. Woodworth moved to refer the
matter to the Water Committee and City Attorney to in-
vestigate and report back, Durand seconded, motion carried.
POLICE & A letter from King County Fire Protection District #43 was
FIRE read thanking the Kent Fire Dept . for their aid on a fire
call on August 18th. Woodworth moved that a copy be sent
to the Fire Dept. and the original placed on file , Strain
seconded , motion carried.
Woodworth moved to allow expenses for Police Chief McQuery
to attend the Statewide Police Management School at Yakima,
October 3 through 5 ,Pozzi seconded , motion carried.
Fire Chief Foster reported on the International Association
of Fire Chiefs Meeting held in San Francisco . September 8
through 14th , stating that it was very informative.
Woodworth announced that Patrolman Hancock has been promoted
to Class A Patrolman .
PROPOSED Ordinance 1479 was read, providing for three bond
BOND ISSUE issues to be placed on the November ballot as follows :
1) Library Bonds - $110 ,000.001 2) Recreational
Facilities Bonds - $60 , 000.00. 3) City Hall , Civic
Center Bonds - $1 ,830, 000.00. Woodworth moved for
passage and adoption of the ordinance , Pozzi seconded,
motion carried.
FINANCE A letter from the City Treasurer was read requesting
reinvestment of $400,000 U. S. Government 60-day Treasury
Bills to credit of Metro-Sewer Revenue for a period of
30 days. Armstrong so moved , Strain seconded, motion
carried.

i APPEAL A letter was read from Thomas Archey appealing the
Board of Adjustment ' s decision to deny his request for
a variance on parking regulations . By motion , the
hearing was set for October 16th.
PARKS & The Mayor requested a motion for the City Attorney to
RECREATION draft a resolution to transfer $2 , 200.00 within the
Park Budget . Armstrong so moved , Buxton seconded,
motion carried.
A letter from the U. S. Department of Interior was
read advising that the city' s plans to acquire addi-
tional recreation lands at Clark Springs , Kent Springs
& Icy Creels areas will be incorporated into the Recreation
Appendix. By motion , the letter was placed on file.
SS&M Strain stated that SS&M Co. are violating their restrictions
and were operating until 11: 30 on Friday evening. Mooney
moved that the City Attorney be instructed to inform them
that if there is one more violation , the city will take
action . Armstrong seconded, motion carried.
ANNEXATIONS A letter from the King County Engineer was read advising
that the Board of Review which formerly passed on annexa-
tions , is no longer in existence , but will beieplaced
by the Boundary Review Board. By motion , the letter was
placed on file .
Kaltenbach. The revised 10% petition for the Kaltenbach
Annexation was presented, to include a greater area, along
with a letter from the City Engineer certifying that
signatures thereon represent owners of property aggregating
more than 10% of the assessed valuation . By motion , a
meeting with the proponents was set for p A 7 : 15 p.m. October 2. .
Ortiz. The 10% petition for the Ortiz Annexation was
presented along with a letter from the City Engineer
. certifying that signatures thereon represent owners of
property aggregating more than 10% of assessed valuation .
Mr. Ortiz of Trans Pacific Industries requested a letter
from the City stating that water and sewer are available
for this area. The City Attorney stated that the old
annexation rules do not apply and that the newly formed
Boundary Review Board will rule over all annexations.
Woodworth suggested that we proceed in the usual way as
far as the 75"o petition . Mooney moved that the 10%
petition be accepted and October 2 at 7: 30. p.m. be set
to meet with the proponents of the annexation , Armstrong
seconded, motion carried. Denver Grigsby asked if this
property was contiguous to the City and the Mayor replied
that it was. Strain moved that the City Engineer send
Mr. Ortiz a letter assuring water and sewer availability,
Mooney seconded , motion carried.
BUDGET It was noted that the preliminary budget is prepared
and that the public hearing on the final budget will be
held at the October 2 meeting.
CONDOLENCE Mooney commented on the untimely death of Dr. James
Hogan , City Health Officer and a 30 second silence
was observed in memoriam. A motion was passed for
a letter of condolence to be sent to Mrs . Hogan.
