HomeMy WebLinkAboutCity Council Meeting - Council - Minutes - 06/19/1967 345 C Kent, Washington June 19, 1967 Regular meeting of the Kent City Council called to order at 8:00 p.m. Present : Mayor Thornton, Councilmen: Buxton, Durand, Mooney, Pozzi, Strain and Woodworth, City Engineer Sherwood, City Attorney Bereiter. Mayor Thornton was excused at 9:00 p.m. and Mayor Pro Tem Carl; Pozzi presided for the remainder of the meeting. Minutes of the last meeting approved as printed and accepted by motion. Clerk's treasurer's and budget reports submitted, accepted and placed on file by motion. HEALTH & Mooney moved to accept a petition for the establishment of an LID to construct SANITATION sanitary sewers in the No. Washington Ave. area, which was submitted by property owners in the area and to set the public hearing for July 17th, Woodworth seconded, , motion carried. Metro. Mooney stated that the City/Metro contract has not yet been accepted by EDY and noted that Hill & Ingman are working with EDA on the matter. A letter from Roy J. Myklebust was read stating that the Washington State Dept. of Health will undertake a survey of solid waste handling in the state during late June, July and August. Mooney moved to refer the matter to Mr. Walker, Municipal Accountant, to prepare the necessary material and ask for a copy of the survey, Woodworth seconded, motion carried. Ordinance 1460, Amending the sewer rates and allowing the Municipal Accountant to make adjustments was read by the City Attorney. Buxton moved for passage and adoption of the ordinance, Woodworth seconded, motion carried. Metro. Emergency Ordinance 1461, making appropriations of $150,000.00 & providing for issuance of warrants for payment of Metro surcharges, was read by 'the City Attorney. Strain moved for passage and adoption of the ordinance, Mooney seconded, motion carried unanimously upon roll call. STREET Pozzi moved that the Mayor and City Clerk be authorized to sign the contract E6tti arterial improvements, which was discussed with Hill & Ingman, and that Hill & Ingman be given instructions to proceed with the engineering for arterial improve- ments to: James St. from the West Valley Highway to Benson Highway; 4th Ave. from Harrison to So. 228th; So. 228th from the West Valley Highway to the East Valley Highway; the exfientions of So. 212th between the East Valley Freeway and the East City limits in that vicinity and that the City Attorney should draft the necessary material to be acted upon by the Council to set up for engineering, the use of the 1/2C gas tax money on a loan basis to this project to be repaid by this project when bonds or warrants are sold for the LID and the State Highway 1-1/2C gas tax funds are received, Durand seconded, motion carried. Eide Street vacation. The public hearing was opened on the Eide request for the vacation of a 20' wide alley connecting Russell St. and vacated Morton St. It was noted that the Planning Commission recommends approval. There were no object- ions or comments from the floor and the hearing was closed by motion. Strain moved to uphold the Planning Commission's recommendation's and to approve the alley vacation for the reasons stated by the Commission. Woodworth seconded, motion carried. Ordinance 1456, approving the alley vacation was read by the City Attorney. Woodworth moved for passage and adoption of the ordinance, Buxton seconded, motion carried. Bisyak Street Vacation. The public hearing was opened on: the Bisyak request for the vaction of the South side of Smith St. between 4th and 6th. It was noted that the Planning Commission recommends approval EXCEPT for 80' of the Northern bound- ary of Smith between 4th and 6th. There were no comments or objections from the floor and the hearing was closed by motion. Woodworth moved to uphold the Plan- ning Commission. Motion carried. Ordinance 145�, approving the street vacation was ready by the City Attorney. Strain moved for passage and adoption of the ordinance, Buxton seconded, motion carried. Rowbottom Alley Vacation. The public hearing was opened on the Rowbottom request for the vacation of a portion of an alley between Smith and Ward Streets, near State Street. It was noted that the Planning Commission recommends approval, conditioned upon the petitioners dedicating to the city thh city the property to be - used for a change in the alley as represented to the commission. Mr. Charles Sells of 412 E. Smith objected, stating that the vacation would barricade anyone in that alley, and that emergency vehicles and garbage disposal trucks would not have proper ingress and noted that two sewer lines ran through the alley. The City Engineer assured Mr. Sells that the storm drain would not be affectdd and that the archi- tect has stated that the sewer lines would be replaced with cast iron pipe. Mr. Matson, Architect presented a sketch which was reviewed by the council. The public hearing was closed by motion. Under discussion, Woodwotth opined that the portion should be spelled out in feet. Mr. Sells stated that the Fire Oh�ef, who was in the audience has assured him that there would be no fire hazards presented in granting the alley vacate and withdrew his objections. Strain moved to instruct the City Attorney to redraft the ordinance, granting the vacation with the conditions and that the legal description be furnished by the City Engineer, Woodworth seconded, motion carried. i 346, _ STREETS Matelich Street Vacation. The public hearing was opened on the Matelich request -for vacation of Beeler Road. It was noted that the Planning Commission recommends approval with the conditions as set forth in the Planning Commission minutes of May 9. There were no comments or objections from the floor and the hearing was � closed by motion. Buxton moved to uphold the Planning Commission's recommendations and conditions and approve the vacation. Motion carried. Woodworth moved to instruct the City Attorney to draft the necessary ordinance, Strain seconded, motion carried. The City Engineer stated that the contractor hopes to get James St. reopened for traffic on Tuesday and repaved the latter part of the week. Pozzi noted a traffic hazard on the West Valley Highway caused by the barrier installation and other con- struction work. The City Engineer stated that this was a State Highway -project 4 ' 1 and Pozzi moved that the City Engineer write a letter of protest covering various 'I items of the entire project, Woodworth seconded, motion carried. WATER LID 252. The continued public hearing was reopened on the proposed North Water LID 252. Four new protests were read as was a letter from Mr. Neilsen, Attorney representing Mr. Ordonio regarding an error in the legal description of his property. The City Attorney read a portion of the state statutes regarding this matter, and upon his query, Ohase stated that Hill & Ingman had filed with the City Clerk a certificate of the estimated cost and property value for this project. Ramsey clarified a point regarding zones of the district for Mr. Frye, who represented Goodnews Bay Mining Co. After all who wished to speak were heard the public hearing was closed. Mooney moved to instruct the City Attorney to draft .the ordinance ordering the LID for presentation at the July 3rd meeting, Strain seconded, motion carried. East Hill Water Co. Strain reported receipt of a letter from Robert Kuvara, Att- orney regarding the dissotultion of the East Hill Water Co. Strain noted that approxdmately 6 users had refused to surrender their meters to the city as required in the agreement and moved to amend the agreement so that these users would not ,. ; beexcluded from the 90 foot frontage charge for any future LID. The motion was aimnended to include a request for ratification of the amendment by the directors of the East Hill Water Co. Amended motion seconded by Durand, Woodworth opined that the six users had already breached the contract and that the amendment was unnec- cessary. Motion carried over Woodworthis nay. POLICE & Woodworth noted that the aerial ladder truck, recently purchased from Bellingham, j FIRE is now in operation. BUILDING Buxton stated that the utility building drawings are completed and plans are progressing as scheduled with a call for bids in July. LIGHTS Durand moved for the installation of two residential lights on the last poles North of James St. on Jason and on Clark Streets, Strain seconded, motion carried. BIDS The following bids were read for a car for the Police Dept. Med. Sized 2-dr. Compact Bowen Scarff 2149.46 1935.86 Strain' s Auto Co. 1971.03 1808.18 Valley Garage No bid 1795.00 Bill Hazelett 1793.39 1736917 All bids plus sales tax. Upon Woodworth's motion seconded by Strain, the bid was awarded to Bill Hazelett Chevrolet for the medium sized car. Motion carried. DOG LEASH Mooney noted the need for a dog leash law inithe city, pointing out that a little LAW girl who was in the audience was bitten recently and had required 20 stitches. Pozzi noted that in the past, a child was bitten while on private property and the dog had been disposed of, and that the present ordinance would cover this situation. i POLICE & FIRE Ordinance 1458, repealing hydrant sprinkler standby charges was read by the City Attorney. Mooney moved for passage and adoption of the ordinance, Buxton seconded, ; motion carried. ZONING Vickery. The public hearing was opened on the application submitted by Mr. Vickery for a rezone from R-3 to C-2 for 1 acre at 110th and the Kent Kangley Road. It was noted that the Planning Commission recommends denial. Carlton Butler of the Baptist Church stated that a church was planned for construction in the area and he objected to noise which would be created if the proposed drive-in restaurant were built. Mr. Vickery spoke on behalf of the application. There were no further i comments from the floor. Under discussion, it was noted that the Planning Commis- sion considered this to be spot zoning. The public hearing was closed by motion. Woodworth moved that the action of the Planning Commission be affirmed, and that the application be denied, Mooney seconded. Mooney and Woodworth voted aye, Durand, Strain and Buxton voted nay, and the motion was defeated. Strain moved that the C-2 zoning be granted, Durand seconded and upon roll call vote, Strain, Buxton and Durand voted aye and Woodworth, Mooney and Pozzi voted nay. No action was taken therefore as four affirmative votes are required to carry the motion. Stroud. The public hearing was opened on the application submitted by Donna Stroud for a rezone from 11-1 to J2-4. It was noted that the Planning Commission recommends R-3 which is satisfactory to the applicant. Woodworth moved that the Planning Commission's recommendations not be upheld and that the rezone be denied. Mooney seconded, motion carried. Waller. The public hearing was opened on the application submitted by Mr. Waller for a rezone from R-1 and R-3 to R-4. It was noted that the planning Commission recommends approval. Mr. Baldwin Sammis spoke in favor of the rezone. There were no further comments or objections from the floor and the hearing was closed by motion. Woodworth moved to uphold the Planning Commission's recommendations and approve the rezone and to instruct the City Attorney to draft the necessary ordin- ance, Strain seconded, Motion carried. Drake Annex. The public hearing was opened on the initial zoning of the Drake Annexation. It was noted that Mr. Drake had requested R-4 zoning and that the Planning Commission recommends R-1. Mrs. Bette Abee, Mr. Wood, Wanda Swanson spoke in opposition to the proposed R-4 zoning. Mr. Drake explained why he sought an apartrpent zoning of R-4. There were no further comments or objections from the floor and the hearing was closed by motion. Strain moved to uphold the Planning Commission's recommendations andulieny the R-4 zoning and to zone the property R-1, Woodworth seconded, motion carried. Skagen. The public hearing was opened for the zoning of the Skagen portion of the Wilson Annexation. It was noted that the Planning Commission recommends C-3 zoning. There were no comments or objections from the floor and the hearing was closed by motion. Strain moved that the Planning Commnission's recommendations be upheld and the property be zoned C-3y. with authorization for the Pity Atro'kneyutro.idraft the necessary ordinance, Mooney seconded, motion carried. Ordinance 1459, approving the Sebastian rezone from R-3 to R-4, on which the public hearing was held on Junac5th, was read by the City Attorney. Mooney moved to !approve the plat, Strain seconded, motion•1¢arriedvn, C1 PLATS Olympic View Estates. The public hearing was opened on the final plat of Olympic View Estates. There were no comments or objections :from the floor and the hearing was closed by motion. Mooney moved to approve the plat, Strain seconded, Under discussion, the City Engineer recommended that the ordinance be held until the required bond is presented to the City. Motion carried. By motion, public hearings were set for July 17th for the final plats of Green Heights #6 and Benson Crest #3. CORDON'ANNEXATION The public hearings was opened on the proposed Cordon Annexation. There were no comments or objections from the floor and the hearing was closed by motion. Strain moved to approve the annexation, subject to receipt of the waiver of the Board of Review, and instructed the City Attorney to draft the necessary ordinance, Mooney seconded, motion carried. KING COUNTY Buxton read a letter from the King County Fair Officals requesting the City's FAIR participation on August 18, 19 and 20 at Enumclaw. Ile noted he had contacted the Chamber of Commerce on this matter. CLAIM A claim from Mr. Ingersoll was introduced for damages to equipment in his laundro- cat reportedly caused by air in the water mains. A letter from Mr. Evenson, Water Superintendent was read stating that at no time was the water off and he opined that air could not have entered the mains. Mooney moved to refer the matter to the insurance carrier, Woodworth seconded, motion carried. PLANNING A communication from the Planning Commission was read noting that the commission would be meeting twice monthly with interested council members to continue prelim- inary workshop sessions on the proposed new comprehensive plan. Meeting dates proposed are: June 27, July 11 & 25, Aug. 8 & 22, Sept. 12,:& 26, Oct. 10 & 24. It was further noted that the commission would hear no further applications for rezones, or for initial zonings on annexed properties until the regular November meeting to allow more time for work on the comprehensive plan project. The Planning Commission's action was.approved by motion. The Mayor'$ appointment of Bob Coen to the Planning Commission,was confirmed by Council motion. VALLEY The City Attorney summarized the VRPC resolution of intent. Under discussion, Mr. REGIONAL Bicknell stated that the VRPC feels that there is no coordination between the 5 PLANNING participating cities. Iie noted that the overall planning should be considered as CO151ISSION one unit, rather than individual cities, and that the resolution stated what the VRPC will do if given the sanction by the cities. lie stated that the VRVC would only be an advisory commission and that if they are given the go ahead, they will submit a budget, possibly $18,000.00. Woodworth moved to endorse the VRPC Resoluti ion, Mooney seconded, motion carried. PARKS Mrs. Hogan noted that there were funds allocated for land acquisition and develop- ment in the budget and requested permission to use these funds for an architect to i PARKS plan development dfi Star Lake Park. Mooney moved to grant permission, subject to approval of each expenditure by the Council, Woodworth seconded, motion carried. AUDIENCE British Counsil Francis Jell was introduced. Mr. Jell noted that he was the senior mom!)(-, member in the U.S. of the Men of Kent, England, Association. He presented a road side sign from Kent, County to the City, as well as momentos from England to the Mayor. Woodworth moved that the Mayor write a letter of appreciation to England, Strain seconded, motion carried. CONFERENCES The City Attorney requested permission to attend the Municipal Attorney's section & of the Association of Washington Cities Convention in Seattle, June 22 & 23rd, CONVENTIONS Woodworth moved to grant permission, Mooney seconded, motion carried. Strain's motion, seconded by Mooney, was passed, approving the following claims.
