April 17 , 1967
Regular meeting of the Kent City Council called to order at 8 :00 p.m.
Present : Mayor Thornton , Councilmen : Armstrong, Buxton, Durand, Mooney,
Pozzi , Strain and Woodworth, City Engineer Sherwood, City Attorney
Bereiter
Minutes of the last meeting approved as printed and accepted by
motion , with the following addition to paragraph 1, page 1 : " in
accordance with requirements of the City Engineer and Health and
Sanitation Committee with compensation . . . . . "
Clerk's , Treasurer ' s and Budget Reports submitted, accepted and placed
on file by motion .
HEALTH & The City Engineer recommended that a quit claim
SANITATION deed for a sewer line from Thomas Burke be ex-
ecuted. Pozzi moved that the Mayor and City
Clerk be authorized. to sign the deed releasing
part of the easement , Armstrong seconded, motion
carried.
STREETS The City Engineer reported that he received a
letter from the Economic Development Administra-
tion stating it was alright to go ahead with
Phase III of South 212th. IIe asked for authoriza-
tion to begin discussions with the County and
State regarding details of this project. Pozzi
so moved, Woodworth seconded, motion carried.
LID 251. Ordinance 1446 , providing for issuance
and sale of bonds for LID 251 was read by the City
Attorney. Pozzi moved for passage and adoption
of the ordinance , Armstrong seconded, motion
carried.
Traffic flow Study. The public hearing was
opened for the adoption in part of the John Graham
traffic flow study. There were no objections or
comments from the floor and the hearing was closed
by motion. Woodworth moved to approve adoption of
the study and to instruct the City Attorney to pre-
pare -the necessary ordinance , Pozzi seconded, motion
carried.
A proposed agreement from McLean & Co. was read
agreeing to buy $65 , 569.06 LID No: 251 bonds at
51/2 %. By motion , the Mayor and City Clerk were
authorized to sign the agreement.
LID 253. A ietter from the Investment Exchange
Corp. was read opposing the proposed taking of a
triangular piece of property for LID 253 . The
City Engineer stated that he felt that objections
to the LID could be worked out and eliminated.
Traffic Study. Resolution 569 , authorizing the
State to withhold 3 , 50.00 from the City' s gas
tax revenue toward the Green River Valley Trans-
portation Study was read and passed on Pozzi ' s
motion , subject to the approval of the City
Attorney, Armstrong seconded, motion carried.
Armstrong stated that there should be a program
to widen James Street to 100 feet as it will be-
come a main arterial. The City Engineer stated
that our comprehensive plan provides for an 80
foot right-of-way on James Street and for James
Street to be 100 feet wide between the East Valley
Highway and the West Valley Highway.
Cliff Cavanaugh of 312 Woodland Way complained of the
open drainage ditch in the street right-of-way in
Hauge ' s Armscrest area, which creates a hazard to
children in the area. The City Engineer stated that
the street is not deeded to the city and that he
would have his staff investigate the matter. The
City Attorney stated that if this is a dangerous
situation , appropriate action can be taken .
Mooney stated that with the completion of the John
.Graham Traffic Study, he felt that the Council should
negotiate an LID to improve the streets , particularly
11th from Harrison to James , Smith from the NP tracks
to the freeway, Gowe from lst to 6th and 2nd from
Harrison to Smith, with curbs , gutters , and blacktop.
Pozzi noted that the Chamber of Commerce and the
Street Committee are now working on this matter and
areā¢ waiting for estimates . IIe noted that Mooney and
the City Engineer would be notified of the next meeting
of this group.
WATER Bids . The following bids were read for a six million
gallon steel reservoir :
Chicago Bridge & Iron Co. 294 , 810.00
General American Transportation Corp. 300, 200.00
Pittsburgh-DesMoines Steel Co. 301 , 315.00
Venture Construction 318, 997.00
American Pipe & Construction 329,678.72
Upon Strain ' s motion , the bid was awarded to Chicago
Bridge & Iron Co. , Armstrong seconded, motion carried.
Strain noted that the valving on the reservoir will
be done within 90 days , in time for the summer.
Strain reported that the final phase of the Clark
Springs project will commence July 1.
Strain stated that a Resolution of intent for the
proposed LID 252 will be ready at the next meeting.
A letter from the Department of Health was read
stating that plans and specifications for the six
million gallon steel reservoir were approved.
Strain moved to place the letter on file , Armstrong
seconded, motion carried.
LIGHTS Durand moved for the installation of 20 - 20,000
lumen lights on So. 212th from the West Valley
Highway to the bridge crossing Green River per
Puget Power engineering study, Pozzi seconded, motion
carried.
Durand moved for the installation of five 20,000
lumen lights on :
2nd pole west of the East Valley Highway on 200th St.
Corner of 200th & 31st So.
3rd pole North of 200th on 31st So.
Corner of 196th & 31st So.
3rd pole west of the East Valley Highway on 196th
Woodworth seconded, motion carried.
ZONING SS&M Co. The Mayor noted that a public hearing was
scheduled on the application of SS&M Co. for a rezone
from R-1 and R-2 to R-3. The City Attorney stated
that the notices were posted 14 days prior to the
hearing, however, they were not mailed until 12 or 13
days before the hearing which could be considered
improper notice. IIe recommended that the public hear-
ing be set for May 15 and to remail and repost notices for
same . Woodworth so moved, Pozzi seconded, motion carried.

Rentonites. The public hearing was opened on the
application submitted by Rentonites for a. rezone
from R-4 to C-3. It was noted that the Planning
Commission recommended denial by a 11 - 3 vote.
Lou Peretti noted the close vote of the Planning
Commission and requested the Council to reconsider
the merits of this application . . Noel Bicknell was
asked for his comments , and noted that the dissenting
planners were of the opinion that it was not proper
j to have any more businesses facing 240th. There
were no further comments or objections from the floor
and the hearing was closed by motion . Pozzi moved
that the application be approved to C-3 zoning.
Pozzi ' s motion carried upon the following roll call
vote : Armstrong, Buxton , Pozzi and Strain AYE and
Durand, Mooney and Woodworth NAY. Strain moved to
instruct the City Attorney to prepare the necessary
ordinance , Buxton seconded, motion carried.
It was noted that the plead Rezone has been postponed
indefinitely.
Upon Woodworth' s motion , seconded by Durand, public
hearings were set for May 1 for:
Zoning of Oien Annexation
Zoning of Wilson Annexation
Zoning of Drake Annexation
Incorporating a Street into the Comp. Plan
(McNae Request )
Motion carried.
East Hill Annexation . The public hearing was opened
for the zoning of the East Hill Annexation to R-1,
R-2, R-3 , R-4 and C-3. It was noted that the Planning
Commission so recommends , with Bud Poole 's approval.
The City Engineer pointed out the various areas on
the map to clarify the proposal. Al Sebastain of
9614 So. 252nd requested R-4 zoning for his property.
Mr. Bicknell noted that it was the unanimous decision
of the Planning Commission that the proposed zoning
was best for the city. Mr. Sebastain wa.s advised
that he could request a rezone for his property
through the usual rezone procedures. There were no
further comments or objections from the floor and
the hearing was closed by motion . Pozzi moved that
the recommendations of the Planning Commission be up-
held, Buxton seconded, motion carried. Woodworth
moved to instruct the City Attorney to prepare the
necessary ordinance , Mooney seconded, motion carried.
PLANNING A letter from the Department of Commerce was read
requesting authorization to make the final payments
to the John Graham Co. The Mayor recommended that
the payments be released to them, Mooney so moved,
Armstrong seconded, motion carried.
A letter was read from Bowen Scarff, submitting his
resignation from the Planning Commission . Mooney
moved that his resignation be regretfully accepted,
Strain seconded, motion carried. Woodworth voted
nay, noting that the resignation was a great loss to
the City. The City Clerk was instructed to send a
letter of appreciation to Mr. Scarff.
BOARD OF Appeal. A letter from Mr. & Mrs. Virgil Umberger
ADJUSTMENT was read appealing the decision of the Kent Board
of Adjustment in regard to their request for a
,variance in R-2 zoning. Woodworth moved to set the
public hearing for May 15 , Strain seconded, motion
carried.

CITY A petition bearing 466 signatures was introduced
GOVERNMENT requesting that proper procedures be taken for the
organization of a Council/Manager from of government .
It was noted that for the petition to be. valid, it
mus.t contain signatures representing 20% of the number
of voters who voted for all candidates for Mayor in
the last muncipal election . The City Clerk was in-
structed to clieck the validity of the signatures.
Strain moved to accept the petition and place it on
file , Mooney seconded, motion carried.
GREEN Ordinance 1445 , approving the plat of Green
VALLEY Valley Heights #5 was read by the City Attorney.
HEIGHT #5 Pozzi moved for passage and adoption of the
ordinance , Strain seconded, motion carried.
CORDON The 10% petition for the Cordon Annexation was
ANNEXATION presented along with a letter from the City
Engineer certifying that signatures thereon re-
present owners of property aggregating more than.
10% of the assessed valuation. The petition was
referred to the annexation committee , who will
meet with the proponents within 60 days. Strain
moved that a report by the committee be submitted
at the next meeting, Durand seconded, motion
carried.
APPEAL The City Attorney reported that he spent the after-
SANITARY noon in Judge James ' court regarding the court action
LAND FILL concerning the sanitary land fill matter. He noted
that the Judge ordered the City to supply certified
documents concerning zoning regulations and sanitary
land fills . He stated that he would report further
developments.
POLICE & Woodworth stated that the year-end report of the
FIRE Fire Department will be given to each Councilman.
PARK & Woodworth moved to allow the Park Department and
RECREATION _ Mayor to negotiate with Dr. Rugg for Mill Creek
Canyon property for a park and report back to the
Council. Armstrong seconded, motion carried.
E8NVENTIONS & The City Engineer requested permission to atted a
seminar in Seattle , May 4th and 5th. Armstrongso
moved, Buxton seconded, motion carried.
The City Engineer reported on the APWA Conference
that he and the Assistant City Engineer had attended
in Bellingham, April 12 through April 14th. He
stated that over 160 public works people throughout
the state had attended.
Armstrong' s motion , seconded by Mooney was passed,
approving the following claims :
