HomeMy WebLinkAboutCity Council Meeting - Council - Minutes - 10/17/1966 Kent, Washington October 17, 1966 Regular meeting of the Kent City Council called to order at 8:00 p.m. Present: Mayor Thornton, Councilmen: Armstrong; Buxton, Durand, Mooney, Pozzi , Strain and Woodworth, City Engineer Sherwood, City Attorney Bereiter Minutes of the last meeting approved as printed and accepted by motion. Clerk's, Treasurer's and Budget Reports submitted, accepted and placed on file by motion. STREETS Traffic Control. • Mooney noted that unloading of trucks in the business district, especially on Railroad Ave. , and on Ist Ave. is hampering traffic and that the zoning of these areas should be checked. A - letter from the Kent Safety Council was read requesting -the removal of coverings on the "No Parking" signs on the South side of Smith Street. Durand moved this be referred to the Police Committee for a recommendation at the next meeting, Mooney seconded, motion carried. Woodworth stated that he would like the whole council to attend a meeting on this subject. James Street. The City Attorney read Ordinance 1403, increasing the speed limit on James Street from Ist Ave. to Washington, or the WVH, from 25 MPH to 35 MPH. Durand moved for passage and adoption of the ordinance, Strain .seconded, motion carried. Pozzi voted nay. S. 212th — LID 251. Upon Pozzi 's motion, the Mayor and the City Clerk were authorized to sign the purchase of property agreements for So. 212th with McLaughlin, Ordonio, Miller and Behar, Armstrong seconded, motion carried. Upon Pozzi 's motion, the bids that were held over from the last council meeting for improvement to So. 212th was awarded to Scarsella Bros. , low bidder at $211,580.70, with notice to proceed to be given by the City Engineer as soon as reasonable arrangements can be made regarding right—of—way acquisition. Durand seconded, motion carried. Vacation — Lincoln Ave. The public hearing was opened on the pro— posed vacation of a portion of Lincoln Ave. The City Engineer noted that the reason for the request was to add abutting properties to give additional property to build on. After some discussion, a motion was passed to continue the hearing until the next council meeting to allow time for more study. Walnut St. The public hearing was opened on the proposed vacation of a portion of Walnut St. Mr. Collins objected, stating the vacating property is adjacent to city property. The public hearing was closed by motion. Ordinance 1401, approving the street vacation was read by the City Attorney. Pozzi moved for passage and adoption of the ordinance, Buxton seconded, motion carried, with Mooney & Durand voting nay. Alley. The public hearing was opened on the proposed vacation of a portion of the alley between Walnut and Maple Streets. There were no objections or comments from the floor and the hearing was closed by motion. The City Attorney read Ordinance 1402, approving the vacation. Pozzi moved for passage and adoption of the ordinance, Strain seconded, motion carried over Durand and Mooney's nay. Upon Woodworth's motion, the public hearing was set for November 21 for a strreet, vacation of a portion of So. 181st St. filed by Mary Jo Stanley. Woodworth noted that the Planning Commission had recommended that the Council investigate the traffic flow on Central from Titus to the Bridge, plus a problem on 196th St. S. and moved that this be referred to the Street Department, Strain seconded, motion carried. i HEALTH & LID 250. Mooney noted that the Health & Sanitation Committee has SANITATION studied the financial report on Metro's recent proposal, submitted by McLean & Co. and he made the following motion: On the basis of all information heretofore available, and most recently the McLean Study, the sewer committee recommends that the City proceed with the construction of its North End treatment facilities and the improvements within LID No. 250 as originally planned and that the Mayor and the City Council notify Metro that the City cannot accept, in the best economic interests of the City, any of the proposals submitted by Metro." Durand seconded, motion carried unanimously, upon a roll call vote. Upon Mooney's motion, the Mayor was re- quested to send a telegram to Mr. Donsworth, Secretary to Metro, stating the action of the Council , Woodworth seconded,. motion carried. Air Pollution. A letter from the King County Commissioner's Office was read stating that the County is considering enactment of a county-wide air pollution control regulation. Mooney moved for the city to be a part of this progeam and for the City. Attorney to in- corporate the county's resolution into a city ordinance. The City Clerk was to inform Mr. Wallace's office. Strain seconded, motion carried. Flood Control. Buxton stated that he had received a letter from the Green River Flood Control District advising of a meeting of Drainage District #1 on October 20th at 7:30 p.m. in the City Hall. He encouraged members of the Council, the City Attorney and City Engineer to attend. A letter from the Des Moines Sewer District was read regarding additions to their district. Woodworth moved this be referred to the City Engineer and City Attorney, Strain seconded, motion carried. Regarding a proposed new development north of the Oxford Addition, Mooney stated that the 141 acres can connect to the sewer, but they must bear the cost of a pump station. Mooney moved to notify Fred Day of Sunset Realty of this action, Woodworth seconded, motion carried. WATER Strain stated that McLean & Co. has assured the city that we can go ahead with the capital improvements at Clark Springs, the 6 million gallon reservoir, and the roof on the 2 million gallon reservoir. He noted that the EDA money would cut down the LID costs. LID 246. Ordinance 1404, providing for the issuance and sale of bonds for LID 246 was read by the City Attorney. Woodworth moved for passage and adoption of the ordinance, Strain seconded, motion carried. The City Attorney read a letter explaining the court's action on the Hanson vs. the city of Kent suit. He recommended that the city pay the $ 14,203.76 retained fees .plus interest at 6% from April 26, 1965 to the date of the warrant, and for the said warrant to be released to Hanson's attorneys. Strain so moved, Durand seconded, motion carried. The City Attorney recommended that the $7,032.34, the amount of the judgment over and above the retained amount, be withheld until he consults with the bond counsel. Mooney so moved, Woodworth seconded, motion carried. The City Attorney opined that the City could not legally protect the City Transfer in the matter of the $ 1000.00 that the Hanson Co. owes them. LIGHTS Durand moved for the installation of one 7000 lumen light on the first pole west of 84th St. South on 222nd Street, Strain seconded, motion carried. BIDS The following bids were read for a panel truck for the engineer's department: Bowen Scarff: $2,314.49 and Bill Hazelett: $2, 176.05, both including tax. Upon Mooney's motion, the bid was awarded to Bill Hazelett, Durand seconded, motion carried. The following bids were read for two police cars, with trader Strains' Auto $3,755.92, including tax Bowen Scarff $3,284.32, including tax Valley Garage $3,652.00, including tax It was noted that Strain's Auto proposed to add 6J% for payments made more than 60 days after delivery. Pozzi moved to accept the low bid submitted by Bowen Scarff, Mooney seconded, motion carried. 281 FRANCHISE Woodworth stated that due to a conflict in schedules, the meeting with applicants requesting franchises for closed circuit television cables was not held. He moved to set the meeting for October 27th at 10:00 a.m. at the City Hall with notification to be made by the City Clerk. Durand seconded, motion carried. ZONING Campbell. The public hearing was opened on the application submitted by Mr. Campbell for a rezone from R-2 to R-4, which was approved by the Planning Commission. There were no objections or comments from the floor and the hearing was closed by motion. The City Attorney read Ordinance 1395, approving the rezone. Pozzi moved for passage and adoption of the ordinance, Buxton seconded, motion carried. General Investment Co. The public hearing was opened on the application submitted by the General Investment Co. for a rezone from R-I and R-3 to C-3. it was noted that the Planning Commission recommends C-1 and C-3. There were no objections or comments from the floor, and the hearing was closed by motion. Woodworth moved to uphold the Planning Commission's recommendation and approve the rezone to C-1 and C-3 for reasons outlined in their report and for the City Attorney to draft the necessary ordinance. Durand seconded, motion carried. { Stanley & Giilispie. The public hearing was opened on the application submitted by Stanley &. Giilispie for a rezone from C-1 to M-2. It was noted that the Planning Commission recommended M-1 and C-1 . Mr. Gillispie noted that this was satisfactory to the applicants and the hearing was closed. Strain moved that the City Attorney be instructed to draft the necessary ordinance, Armstrong seconded, motion carried. Tanaka. The public hearing was opened on the application submitted by Mr. Tanaka for a rezone from M-A to M-I. It was noted that the Planning Commission recommends approval of the rezone. Mrs. Murtha, who owns 10 acres adjoining Mr. Tanaka's property was assured by the City Engineer that her property was not involved and the hearing was closed. Ordinance 1396, approving the rezone was read by the City Attorney. Pozzi moved for ( passage and adoption of the ordinance, Woodworth seconded, motion carried. Behar. The public hearing was opened on the application submitted by i Mr. Behar for a rezone from M-A to M-I. There were no objections or comments from the floor and the hearing was closed by motion. Durand moved to approve the request for reasons outlined by the Planning Commission, motion carried. Ordinance 1397, approving the rezone was read by the City Attorney. Woodworth moved for passage and adoption of the ordinance, Strain seconded, motion carried. Mead & Samuels. The public hearing was opened on the application sub- mitted by Mead & Samuels for a rezone from M-A to M-2. It was noted that the Planning Commission recommends M-I instead of M-2, which was satisfactory to the applicants. The hearing was closed by motion. Arm- strong moved to approve the rezone for reasons outlined by the Planning r- Commission. The City Attorney read Ordinance 1398, approving the rezone to M-I. Strain moved for passage and adoption of the ordinance, Mooney seconded, motion carried. Smith. The public hearing was opened on the city's application for the Ben Smith property for a rezone from M-A to M-1 , which has been approved by the Planning Commission. There were no objections or comments from the floor and the hearing was closed by motion. Strain moved to approve the rezone for reasons outlined by the Planning Commission, Durand seconded, motion carried. The City Attorney read Ordinance 1399, approving the rezone. Pozzi moved for passage and adoption of the ordinance, Armstrong seconded, motion carried. DUNNING The public hearing was declared open on the proposed Dunning Annexation. ANNEXATION It was noted that the Board of Review had approved the annexation. There were no comments or objections from the floor and the hearing was closed by motion. The City Attorney read Ordinance 1400, approving the Dunning Annexation and recommended that the effective date of the annexation be the 26th of October. Pozzi moved to approve the ordinance, Woodworth seconded, motion carried. It was noted that the Utility Department should notify the garbage collectors in the area of the annexation. ZONING Upon Woodworth's motion, public hearings were set for November 7 for the following rezone applications: Mead M-A to MI-1 Blessing R-2 to R-3 City Rezone (Bon Ppty) M-A to C-3 & MHR ir• UTILITIES A letter from R. E. Walker requesting the council to authorize the Utilities Department to adjust the $ 15.00 arrears account of Mr. A. G. Tingley, was referred to the City Attorney by motion. Mr. Walker also requested council action to authorize deletion from the records of the $377.25 of the Chester Derbyshire account. Mooney so moved, Strain seconded, motion carried. PLANNING A letter from the Valley Regional Planning Commission was read urging Council members, planners and engineers to attend the November IOth conference. The City Clerk was requested to contact members of the council as to who will attend. Upon Mooney's motion, seconded. by Durand, this letter was placed on file. Motion carried. A letter from the Department of Commerce & Economic Development was read giving the schedule of payments to the John Graham & Co. project to date. The Council requested that the Mayor meet with Mr. deLaubenfels on this matter. CONFERENCE & Upon Mooney's motion, Bob Kristofferson was given permission to attend CONVENTIONS the Industrial Wastes Meeting in Portland on October 19, 20 and 21, Armstrong seconded, motion carried. A letter from Barney Wilson was read requesting permission to attend the Washington State Recreation & Park Society Conference in Spokane, October 23 through 25. Strain moved to approve the request, Mooney seconded, motion carried. The City Engineer stated that he and Joe Engeln attended an informative meeting of the Washington Public Works Association. PARKS Mrs. Hogan stated that the Housing and Urban Development forms have been received for the Mill Creek Property and asked permission to complete the forms and to have the City Attorney check them over. Mooney so moved, Woodworth seconded, motion carried. Upon Mooney's motion, the City Clerk was instructed to write a letter to Mr. Eisen, Assistant Industrial Agent for Northern Pacific Railroad, stating that the Council would like to meet with him regarding the pro— posed plans for a car wash in the park at Ist and Gowe, Armstrong seconded, motion carried. ZONING On Mooney's motion, the City Attorney was authorized to engage extra ORDINANCE secretarial help in preparing changes to the zoning ordinance in accord— ance with John Graham's recommendations. It was noted that public hear— ings would -be held on these proposed changes. A letter from Stokely—Van Camp, Inc. was read stating that it is their present plan to continue food processing in this area as long as they can economically secure sufficient raw products for processing. Strain moved to place this letter on file, Armstrong seconded, motion carried.
