HomeMy WebLinkAboutCity Council Meeting - Council - Minutes - 08/15/1966 Kent , Washington j August 15 , 1966 Regular meeting of the Kent City Council called to order at 8 :00 p.m. Present : Mayor Thornton , Councilmen : Armstrong, Buxton , Durand , Mooney, Pozzi, Strain and Woodworth , City Engineer Sherwood , City Attorney Bereiter Minutes of the last meeting approved as printed and accepted by motion . Treasurer ' s report submitted , accepted and placed on file by motion . BUILDING Utility Building. The City Engineer reported that .the engineering department has been surveying the proposed site of the new utility building, and that they will contact steel suppliers to discuss our needs . I-Ie noted that no i information has been received from the Highway Department on a probable date for removal of the old utility building. STREETS So. 212th. Pozzi reported that an executive meeting was held in order to discuss the LID 251 for S. 212th and that an agreement had been reached with the Millers . Right-of-way offers to the others will be mailed in the morning, and further problems were not anticipated . The City Attorney stated that he had prepared a condemnation ordinance , but felt it would not be needed . The City Engineer reported . that he proposed a call for bids on the basis of a temporary four-lane facility to be extended to a five lane , in case there are difficulties in securing rights-of-way. Discussion was had on an accelerated method of procedure for LID 251. It was determined that the final hearing could be held on September 6th, the next meeting. If this procedure is used the final roll will be exactly the same as the pre- liminary, Ramsey noted. The City Engineer proposed to open bids on September 12th and award same on September 19th. Woodworth moved to accept the final roll as filed this date, and to set the final hearing for the September 6th meeting. Motion seconded by Strain and passed. A communication was read from Mrs. Taylor and seven other land owners requesting an access road through from the East Valley Highway to 80th Ave. Mooney moved that this petition be referred to the street committee and the City Engineer, Woodworth seconded , motion carried . HEALTH & LID 250 - North Sewer. Mooney moved for the City Engineer SANITATION to work with the City Attorney to get further time extensions on LID 250 Contracts , A, B, D and F. Pozzi seconded, motion carried . A communication was read from Jack Bereiter stating he had been advised to direct the city to have the Mayor and at least two Councilmen in attendance at a pre-trial hearing on the lawsuit , at 9: 30 a.m. on August 22, 1966, in Room 736 of the King County Courthouse. The judge also ordered that the attorneys and at least three of the plaintiffs be present , It was noted that the City Attorney, Mayor Thornton , Mooney and Strain will attend. The following bids were read on Contract E: Murphy Bros. , Inc. 562 , 775 .00 National Const . Co. 599, 249.00 Harold Kaeser Co. 678,829.00 Tri-State Const . Inc . 707,025.02 Upon Mooney' s motion, Contract E was awarded to Murphy Bros . , low bidders at $562 , 775.00, subject to satisfactory financing arrangements and EDA' s approval; Strain seconded , motion carried. HEALTH & LID 249 _- South Sewer. Mooney moved that Tri-State ' s SANITATION contract for LID 249 be accepted as complete by the City, Woodworth seconded , motion carried. The final hearing on LID 249 was opened. A protest by Mr. Sorenson was read objecting to the legality of various aspects of the LID assessments , and especially to the assessment of a back lot . Mr. Bonjourni , representing the Sorensons , stated that the back lot was inaccessible and"unusable" . The City Attorney noted that in his opinion the assessments were legal , and the City Engineer stated that he felt the lot was useable. He further explained the methods of assessing corner lots showing that the actual parcel on the corner would not be charged twice. After discussion , Woodworth moved for a $250.00 reduction in this assessment , Armstrong seconded , motion carried , with Pozzi and Mooney voting nay. A protest by Mrs . Florence Playford was read stating that she has been charged for 10 feet too much and requested that the amount be adjusted. The City Engineer stated that an error had been made and Armstrong moved for 10 feet to be deleted and the amount adjusted accordingly. Strain seconded , motion carried . A protest by Frank Fulton was read stating that he felt the sidesewer charge was too high. The City Engineer stated that it was the standard sidesewer charge and was within 10% of the estimate , as required by law. Pozzi moved that no action be taken in this matter, Woodworth seconded , motion carried . A protest by Clarence Mahon was read stating his objection to being charged for 120 feet of frontage , declaring that this line was not actually put in because he had declined to give an easement across the vacated - portion of Kirkwood. The City Engineer noted that his property abuts the line by virtue of the vacated street . Mooney moved to reduce Mahon ' s charge to 60 feet of frontage . Motion seconded by Durand and carried. A protest from George S. Carpenter was read stating that his portion of Chicago Street is vacated and that he stands the cost of sewer line on this thirty feet in order to hook-up to the sidesewer. He further objected that he had rented a back- hoe and had to dig 8 1/2 feet to reach the sidesewer which he had been told was only 5 feet deep, thus incurring extra expense for the back-hoe and material for shoring. The City Engineer explained that this could happen , as the reference point may have been at. a depth of five feet . Mooney moved that .$30.00 be deleted from his assessment , Strain seconded, motion carried , Pozzi voted nay. A protest from Airs . W. A. Ammons was read objecting to the cost of their assessment , and particularly to the sidesewer charge . The City Engineer stated that it was a standard sidesewer charge, and that it was within 10% of the preliminary estimate. Upon Woodworth' s motion , no action was taken on this matter, Armstrong seconded, motion carried. Woodworth moved that the .hearing be closed , Mooney seconded, motion carried. Woodworth moved for the City Engineer to be authorized to incorporate these changes in the final assessment roll, for the City Attorney to make the changes 'in the ordinance and for the City Clerk to furnish a list of the action taken tonight . Pozzi seconded , motion carried . The City Attorney stated that the ordinance will be ready for the next council meeting. - ZONING Newell. It was noted that the public hearing on the Newell application for a rezone from R-1 to MHR was held on July 18th, and action has been held over until tonight. Mr. Newell explained that the planning of the sewage system was done by Mr. Biggar, who stated that the percolation tests proved adequate. The plans were presented and Mooney noted that they were complete. Wood- worth moved to approve the rezone request for reasons outlined by the Planning Commission , Durand seconded , motion carried. Ordinance 1369 , approving the rezone was read by the City Attorney. Pozzi moved for passage and adoption of the ordinance , seconded by Strain , , motion carried. i i ZONING Weiser. Mr. Weistr requested to postpone the public hearing on this request for a rezone from MA to MHR and C3 to the , September 6th meeting. Woodworth so moved , Strain seconded , motion carried. Meier. The public hearing was opened on the application sub- mitted by Mr. Meier for a rezone from M1 and R2 to R4, C3 and M1. There were no objections or comments from the floor and the hearing was closed by motion . Strain moved to uphold the Planning Commission ' s recommendation for approval of the rezone ,. Mooney seconded , motion carried. The City Attorney was auth- orized to hold the ordinance until the next meeting in order to make a correction . I Harn . The public hearing on the Harn application for a rezone ` from R2 to C3 and Ml was opened. There were no objections or comments from the floor and the hearing was closed by motion . Mooney moved to approve the request for reasons outlined by i the Planning Commission , Durand seconded , motion carried. The City Attorney was authorized to hold the ordinance until the next meeting in order to make necessary changes to it . Terhune. The public hearing on Terhune ' s application for a rezone from R3 to R4 was opened. There were no objections from the floor and the hearing was closed by .motion . Durand moved to approve the request for reasons outlined by the Planning Commission , Mooney seconded , motion carried , Ordinance 1370, ' approving the rezone was read by the City Attorney. Pozzi moved for passage and adoption of the .ordinance , Strain seconded, motion carried. Roos. The public hearing on the Roos application for a rezone from R-3 to R-4 was opened . There were no comments or objections from the floor and the hearing was closed by motion . Woodworth moved to appr.ove the request for reasons outlined by the Planning Commission , Mooney seconded , motion carried . Ordinance 1371 , approving the rezone was read by the City Attorney. Strain moved for passage and adoption of the ordinance , Durand seconded , motion carried. Hoss Bros . The public hearing was opened on I-Ioss Bros. ' application for a rezone from MHR to C-3. There were no ob- jections from the floor and the hearing was closed by motion . 'Pozzi moved to approve the request for reasons outlined by the Planning Commission , Durand seconded , motion carried. Ordinance 1372 , approving the rezone was read by the City Attorney. Pozzi moved for passage and adoption of the ordi- nance , Woodworth seconded , motion carried. Turner. The public hearing was opened on Turner 's application for a rezone from R-1 to C-3. There were no objections from the floor and the hearing was closed by motion . Woodworth moved to approve the request for reasons outlined by the Planning Commission , Armstrong seconded , motion carried. Ordinance 1373, approving the rezone was read by the City Attorney. Mooney moved for passage and adoption of the ordi- nance , Mooney seconded , motion carried. City of Kent. The public hearing was opened on the City of Kent ' s application for a rezone from MA and M-1 to C-3. It was pointed out that this was adjacent to the recent Sorenson rezone. There were no objections from the floor and the hear- ing was closed by motion . Mooney moved to approve the request for reasons outlined by the Planning Commission , Durand seconded , motion carried. Ordinance 1374 , approving the rezone was read by the City Attorney.. Strain moved for passage and adoption of the ordinance , Mooney seconded, motion carried. ANNEXATIONS McGrath. The public hearing was opened on zoning the McGrath Annexation to R-1. There were no comments or objections from the floor and the hearing was closed by motion . Durand moved to approve this zoning for reasons outlined by the Planning Commission , Armstrong seconded , motion carried. Upon Durand ' s motion , the City Attorney was instructed to draft the necessary ordinance,' Strain seconded , motion carried. ANNEXATIONS Mid Valley Land. The public hearing was opened for the zoning of the Mid Valley Land Annexation to M-A, as recommended by the Planning Commission . Mr. Janecke of Investment Exchange Corporation stated that they had asked for M-1 zoning,but the Planning Commission re- commended MA because of the lack of adequate sewer lines in the area. He noted that they wanted a 250' square zoned M-1. Strain moved for the annexation to be zoned .MA to M-1. This request will be heard before the Planning Commission , following regular rezone procedure. Durand seconded , motion carried. RESOLUTION A resolution from the Associated Improvement Clubs of South King County was read in which they stated that they were opposed to outside governmental units exerting pressures upon communities, that they would render assistance to our community and that they would request the local newspapers to assist in publicizing their position . Strain moved to have this placed on file and requested the City Clerk to acknowledge receipt of this communication . Armstrong seconded, motion carried. MILES DRAKE The City Attorney read Ordinance 1375 , approving the Miles ANNEXATION Drake Annexation . The City Attorney recommended that the effective date of annexation be the 29th of August . Woodworth moved to approve passage and adoption of the ordinance , Strain seconded , motion carried. DUNNING A petition for annexation was presented, signed by Mr. & ANNEXATION Mrs . Dunning, along with a letter from the City Engineer certifying that signatures thereon represent owners of property aggregating more than 10% of the assessed valua- tion . Strain moved that a meeting be set for 7 : 30 p.►n. , September 6th, with the proponents. Durand seconded, motion carried. BUILDING The City Engineer reported' that 7 million ddllars in PERMITS building permits had been issued last week, which was more than the totals for either 1964 or 1965. So far, the permits for this year have totaled 31 million dollars . PLANNING It was noted that Mr. Bicknell ' s term of office for the COMMISSION Planning Commission had expired. The Mayor ' s reappoint- ment of Mr. Bicknell for a 6 year term was confirmed on Strain ' s motion , seconded by Woodworth, motion carried . It was noted that the Planning Commission had regretfully accepted the resignation of Harold Heath. Upon Woodworth ' s motion , the City Clerk was instructed to write a letter to Mr. Heath, expressing the city' s appreciation for his years of service. HOUSING It was noted that Mr. Eckness has purchased property adjacent to the Nazarene Church property on the Benson Highway, where he contemplates building a housing complex. He has requested water and sewer service for this pro- perty which is outside the city. It was ascertained that it has been the city' s policy to provide such service and Mooney moved to inform Mr. Eckness that the services will be extended at his expense. It was pointed out that if this property was annexed to the city, any buildings con- structed thereon would have to meet the city' s standards.
