Present: Mayor Thornton, Councilmen: Armstrong, Buxton, Durand, Mooney, Pozzi , Strain and Woodworth, City Engineer Sher- wood, City Attorney Bereiter Minutes of the last meeting approved as printed and accepted by motion with the following correc- tion: Under Water East Hill, page I, should read "the million gallon stand pipe . .... Clerk's, Treasurer's and Budget Reports submitted, accepted and placed on file by motion. STREETS Vacation. The City Engineer reported that the street committee recommends that the Eckland request for a street vacation not be considered because it serves as an access to the Latter Day Saints Church and in the future could be used as public access to properties on 94th Avenue and Summit Avenue. Pozzi moved that it be denied, Woodworth seconded, motion carried. Traffic Study. The City Engineer stated that the Highway Department had re- quested confirmation of the $5,000.00 commitment made by the City for the pro- posed Green River Valley traffic study. Pozzi noted that the minutes reflect that the City will participate in the project up to the $5,000.00 figure. S. 212th. Pozzi reported that various trucking firms had agreed to bear part of the costs of a five foot shoulder on 212th. WATER East Hill. Strain moved that Hill and Ingman be authorized to proceed with the necessary studies and preparation for two additional six million gallon storage tanks on East Hill , including the necessary piping and appurtenances. In addi- tion, they are to prepare the plans and specifications for a. cover over the existing three million gallon reservoir, and the improvements to the Rock Creek facilities necessary to approximately double its intake capacity. Compensation for this work is to be in accordance with the terms outlined in the existing contract and outlined in Section X(f) of the same contract. Motion seconded by Durand and carried. Water District #75. Strain noted that the voucher for Water District #75 was in order and moved that the warrant be released. Mooney seconded, motion carried. HEALTH & North End. Mooney moved to waive the regular order of business and for the City SANITATION Attorney to read Ordinance 1337, establishing L.I .D. 250, commonly 'referred to as the North Sewer System. Motion seconded by Strain and motion carried. The ordinance was read by Bereiter and Mooney moved for its passage and adoption. Woodworth seconded and the motion carried unanimously. Mooney reviewed action taken during the last two weeks, noting that the council- men had individually reviewed approximately 77 letters from protestors on the North End Sewer L. I .D. Two sections of dead-end lines have been deleted from the project, which will not interfere with the over-all plan. He noted that several people had requested that an outside financial concern evaluate Metro's proposal, and upon his instructions the City Clerk read a letter from West Coast Manage- ment, stating that they had studied all of the proposals and facts and concluded that it would not be in the best interests of Kent to enter into the agreement proposed by Metro. The engineering done by Hill and Ingman for the proposed LID 250 plans have now been approved by the Washington Pollution Control Commission and State Department of Health in Olympia. He noted that last Tuesday City Officials spent all day at a conference called by Warren Magnuson and it was learned there that the local people must have a program to offer the government before EDA funds are allocated and by passing the ordinance, that the L. I .D. has been created and we have a program to offer. He reported that he would send wires immediately to advise EDA Brock Adams and Senator Magnuson of the action taken tonight. Ordinance 1338, relating to adopting a system or plan of additions to and better- ments and extensions of the sewage collection and disposal system of the city and providing for the issuance of $435,000.00 of Sewer Revenue Bonds was read by the City Attorney. Pozzi moved for passage and adoption of the ordinance, seconded by Strain, motion carreed unanimously. Sewer Revenue Bonds. Mooney stated that the council has reviewed the $435,000.00 sewer revenue bond issue and moved for the city to accept the proposal of McLean and Co. to buy the bonds. Woodworth seconded, noting that McLean's certified good faith check for $ 10,000.00 was attached to the proposal. Motion carried. i i Garbage. Mooney stated that the dumpster type operation is working out very satisfactorily. His motion to purchase 19 street trash cans was seconded by Pozzi and carried. LIGHTS Durand moved for installation of a 20,000 lumen light on So. 228th in bend where it cuts back to the North on pole #8801, east of the East Valley Highway. Strain seconded, motion carried. Durand moved for the City Clerk to write a letter to Mr. McHugo advising him that the street light which was removed at Holland's Auto Rebuild was done in the best interest of the city and if a lighting problem exists on his property, it would be his responsibility and not the city's. He noted that this light was not included in the light LID. Strain seconded, motion carried. POLICE & Upon Woodworth's motion, an application for a cabaret license was approved for FIRE the Meeker's Landing Restaurant. Durand seconded, motion carried. FINANCE The City Attorney introduced an Emergency Ordinance providing funds for employees in the engineer's office. Armstrong moved to have the City Clerk publish it. Durand seconded, motion carried. j The City Attorney read Resolution 554, authorizing a transfer of $85,009. 16 from the Garbage Fund to the 1965 Sewer Construction for the purpose of paying in full the Ist National Bank of Enumclaw, the balance owing on the Bevaart real estate contract. Pozzi moved for passage of the resolution, seconded by Armstrong, motion. carried. KENT The City Engineer reported that it has been determined that a Board of Review will HIGHLANDS have to be called on the matter of the Kent Highlands Annexation. The City Engineer ANNEXATION recommended it be held on Friday, April 22nd, at 10:00 a.m. Woodworth so moved, Pozzi seconded, motion carried and the City Clerk was instructed to notify the appropriate people. WEST Ordinance 1339, approving the plat, was read by the City Attorney. The public CREST hearing on West Crest was opened, there were no objections from the floor. The City Engineer noted a slight error in the bond, and noted that the City has not yet received a hold harmless agreement for drainage from the cul—de—sac. The public hearing was closed. Woodworth moved to approve passage and adoption of the ordi— nance, with instructions to the City Engineer not to sign the plat until these corrections have been made. Armstrong seconded, motion carried. GREEN VALLEY The public hearing on the plat of Green Valley Heights #5 was declared open. There HEIGHTS were no objections and the hearing was closed. The City Engineer stated that a $ I00,QOO.00 bond is required, $50,000.00 for grading and $50,000.00 for improvements. Strain moved the plat be approved and the ordinance be drafted after the bond is posted. Seconded by Durand and carried. GOODWIN The City Clerk introduced the 75% petition on the proposed Goodwin Annexation. On ANNEXATION Woodworth's motion, the public hearing was set for May 2nd and the City Clerk was instructed to request a waiver of the Board of Review. Motion seconded by Durand and carried. MID VALLEY The Mid Valley Land 107o annexation petition was presented and Woodworth moved that LAND a 7:30 meeting with the proponents be set for May 2nd. Pozzi seconded, motion ANNEXATION carried. MCGRATH Pozzi moved that the minutes show that an early meeting was held with McGrath ANNEXATION annexation proponents and that they had agreed to assume their share of the existing bonded indebtedness. Woodworth seconded, motion carried. LORENTSON Mooney. felt that the sewer and water committees should meet with the plattors of PARK PLAT the proposed Lorentson Park Plat. Armstrong moved that a letter be written by the City Engineer, Pozzi seconded, motion carried. ZONING Parks. The public hearing on Parks rezone application from C-3 to M-1 was opened. It was noted that the Planning Commission recommended the request be denied. Mr. Maki and Mr. Romero spoke against the rezoning, Mr. Tribe was in favor of it. The hearing was closed. Pozzi moved to uphold the Planning Commission's recommendation and deny the request, seconded by Strain, motion carried. I I Kent-West. The public hearing on Kent-West rezone from M-1 to C-3 was opened. There were no objections from the floor and the hearing was closed. Strain moved to uphold the Planning Commission's recommendation and to approve the request for the reasons stated in their report. Armstrong seconded, motion carried. The City Attorney was instructed to draft the ordinance. Armstrong requested the City Engineer to supply the council with sketches of any forthcoming rezones to facilitate the hearings and the City Engineer agreed to do SO. City of Kent. The public hearing on the City of Kent rezone from M-1 to C-3 was declared open. It was noted that the Planning Commission recommends approval. Mules Drake stated he had no objections to residential usage, but felt it shouldn't be necessary to take away existing uses to the community, and felt it should be handled• in a variance. John Hauge opposed the rezone and the City Engineer defined M-1 and C-3 zoning. Bill Ramsted stated he was in favor of the rezone, as he felt the lots were too small for manufacturing sites. Woodworth moved that the area North of Harrison Street be excluded, and the balance of the rezone be approved for reasons stated in the Planning Commission's recommendation. Buxton seconded and motion carried. The City Attorney was instructed to draft the necessary ordinance. Commonwealth Investors. The public hearing on rezone from C-1 to C-3 for Commonwealth Investors was declared open. There were no objections and the hearing was closed. Pozzi moved to uphold the Planning Commission's recommendation to approve the rezone for the reasons outlined in their report. Durand seconded, motion carried. The City Attorney was instructed to draft the necessary ordinance. Matelich. A letter was read from the Planning Commission recommending that the application submitted•by Andy Matelich for a change of zoning from R-3 to R-4 be approved. By motion, the public hearing was set for May 16th. Peretti . A communication from the Planning Commission was read recommending that the application submitted by Louis Peretti for a change of zoning from R-3 to C-3 be approved. By motion, the public hearing was set for May 16th. Sorenson. A letter from the Planning Commission was read recommending the approval of the rezone from M-1 to C-3 submitted by Eugene Sorenson. By motion, the public hearing was set for May 16th. Kent Highlands. A communication from the Planning Commission was read recommend- ing that initial zonings of R-4 and M--2 be approved for this newly annexed pro- perty. By motion, the public hearing was set for May 16th. STREET Nazarene Church. A letter from the Planning Commission was read recommending VACATION the vacation of dedicated streets as requested in the petition. By motion, the public hearing was set for May 16th. PLANNING The Mayor requested that the council confirm the reappointment of Don Bogard fo COMMISSION the Planning Commission. Woodworth so moved, Durand seconded, motion carried. UTILITY TAX Pozzi moved for the City Attorney to draft an ordinance which would impose a tax on city utilities, which tax will come from revenue funds and be placed into the current expense fund, when the funds are available. It was noted that this was not a tax to be passed on to the people. Woodworth seconded, motion carried. Strain and Mooney voted nay. CONFERENCE & The City Engineer recommended that Dick Sharf attend the Building Inspector's CONVENTIONS School in Tacoma on April 29th. Woodworth so moved, Durand seconded, motion carried. A communication was read from the South King County Bar Association in which they are extending an invitation to the State Patrol Officers, Local Police Officers, and Mayors and City Councilmen of South King County cities and towns to a no-host meeting on April 28th at 7:00 p.m. at the Hyatt House. Woodworth moved that the letter be placed on file, Armstrong seconded, motion carried. A letter was read from Warren C. Gonnason extending an invitation to the Mayor to attend the West Side Green River Watershed Study hearing on Wednesday, April 20, at 10:00 a.m. at the Tukwila Town Hall. Woodworth moved that the council appoint Owen Buxton as the city's representative, seconded by Strain, motion carried. Mr. Buxton reported that he would attend the meeting. I A letter was. read from Fire Chief Foster in which he gave a brief report of the Command School attended by he and Capt. Larcom,' April II through the 14th in Yakima. Upon Woodworth's motion, seconded by Strain, the letter was placed on file. Motion carried. PARKS Mooney stated that there were 1286 children- within the city limits west of the Green River and felt that this should be brought to the Park Board's attention. He noted that in 1956, the City of Kent entered into a joint contract with School District 415 to set up a recreation program. Mooney moved to have the Council and Park Board meet with the King County Park Board and the Superintendent of the Federal Way School District and its Board members to see if a similar arrangement could be made to provide recreation for the people on the West Hill.' Pozzi seconded, motion carried. Woodworth and Strain voted nay, Woodworth noting that he felt a preliminary meeting should be held first. CENSUS The City Clerk announced the census count of 12,318 for the year, a gain of 679 over last years figure.
