March 7, 1966
Regular meeting of the Kent City Council called .to order at 8:00 p.m. Present: Mayor
Thornton, Councilmen: Buxton, Durand, Mooney, Pozzi , Strain, and Woodworth, City Engineer
Sherwood, City Attorney Bereiter.
Minutes of the last meeting approved as printed and accepted by motion.
STREETS Parking. Woodworth moved to instruct the City Attorney to
amend the ordinance so parking would be allowed on Smith from
South Central to Kennebec. Durand seconded, motion carried.
Woodworth also noted that Officer Peare spoke at Kiwanis
recently and encouraged other organizations to ask for Peare
to present his program for them.
Walkways. Pozzi reported he had had requests for a walkway
from Hilltop to the East Hill Elementary School. Pozzi moved
for the city to join with the school on this problem, and
for the City Engineer to so inform Mr. Reed and Mrs. Lou Ford,
secretary of the P.T.A. Strain seconded, motion carried.
C. E. Sherwood reported he had attended a meeting with rep-
resentatives of the State Highway Department, Auburn, Tukwila,
and King County, regarding a proposed study of highway needs
for the entire valley. Kent's share of the cost would be
$5000.00 payable in 1967. He recommended that the city share
in this program. Strain so moved, Durand seconded, motion
carried.
Pozzi moved for the Engineer to send letters to the Water
Department and the Gas Company regarding the lowering of
lines at the end of Gowe Street, so that the Street Depart-
ment can proceed with the street improvements. Motion carried.
A resolution of the Midway Chamber of Commerce was read urging
the city to improve traffic control in the following ways:
1. Exert all possible effort in behalf of installing
a Fifth Traffic Lane on Pacific Highway So. between
So. 252nd and Kent-Des Moines Road.
2. Install a Traffic Light at the intersection of
So. 240th and Pacific Highway South.
3. Exert all possible effort to have the proper agency
provide a Free Right Turn Lane from the Kent-Des
Moines Road to Pacific Highway South.
The Mayor urged Carl Pozzi to arrange a meeting with Midway
Chamber of Commerce to discuss the problem. Mr. Warnke said
a few words on behalf of the need for traffic control in this area.
A letter from Washington State Highway Commission was read
advising us that arrangements have been made for a Federal Aid
route hearing for the Kent West Bypass. This hearing will be
held at 10:00 a.m. on Wednesday, March 23rd at Kent City Hall.
An informal prehearing will be held the previous day, during the
hours of 1 :30 p.m. to 5:00 p.m. and 7:00 p.m. to 9:00 p.m. on
Tuesday, March- 22nd, at City Hall, at which time representatives
will be on hand to answer questions. Woodworth moved that letter
be placed on file, Pozzi seconded, motion carried. •
A letter was read from Washington State Highway Commission con-
cerning the recent limited access hearing on the Valley Freeway,
section South 285th to South 228th St. It was noted by the City
Engineer that reference to South 228th was left out of the summary
and that it is important that the records show that we requested
it. Pozzi moved that the City Engineer send a covering letter,
seconded by Woodworth, motion carried.
Calverts Addition. Upon the recommendation of the City Engineer
a motion was passed to accept the streets in CAIverts Addition,
subject to the conditions outlined in the engineers letter to
Mr. Calvert.
WATER Strain moved that W. Jackelson and Mr. Touchek along with others
in the general area of the Kent-Kangley Road and Maple Valley Highway
be informed that water would be available to their area by contract
with a water district which would have to be formed. It was noted
that the people must form the water district.
Orillia Water Co. Strain stated he had met with Mr. Curran, attorney
for the Orillia Water Co. and Is negotiating with him to set up
paperwork to come to an agreement on this problem.
Water District No. III . Strain read from a letter from Emerson Thatcher
requesting a motion be made so that Water District #III be granted an
additional one year within which to connect its system to the water mains
of the City of Keht, that Section I of the contract between the city and
the Water District be amended to so provide and that the Mayor and the
City Clerk be authorized and directed to execute such amendment on behalf
of the City. Strain so moved, seconded by Mooney, mgtion .carried.
Water District No. 105. A letter was read from George H. Paulson,
Secretary of King County Water District No. 105, advising us that
areas described in the letter have either been annexed to the Water
District or are in the process of annexation. Pozzi moved that the
letter go to the City Engineer with a carbon copy to the water committee.
Strain seconded, motion carried.
North. The City Attorney requested a motion be made for the city to not
resist the suit by Hanson Excavating Co. for partial payment of $ 15,915.45,
scheduled before the Superior Court on. the 16th of March, 1966. He stated
that according to his figures, Hanson is entitled to this sum, however,
there are other sums in dispute. Strain so moved, Durand seconded, motion
carried.
HEALTH & Garbage Rates. Ordinance 1334,revising procedure for garbage collection
SANITATION charges was read by the City Attorney. Durand moved for passage of ordi-
nance, Woodworth seconded, motion carried.
North End. The City Attorney stated "This afternoon at 4:45 p.m., a
restraining order in the matter of the North End LID was presented to
the City Clerk from King County Superior Court. This order restrains
the city and Mayor and Council from enacting the proposed ordinance and
also requires the Mayor & Council to appear in the King County Superior
Court on the 23rd of March. On the basis of this order, -I am advising
the City not to take any action on the LID ordinance this evening". Mooney
stated, "We wish to respect the court's order, however, I move the City
Attorney be authorized to move to dismiss the restraint and request the
Judge to increase the required bond to 6 million dollars. Also to authorize
Hill & Ingman to investigate alternative temporary facilities possible to
serve industries and that the engineering costs involved become a city ex-
pense, these expenses may be attributable to the petitioners asking the
injunction against the City of Kent Woodworth seconded, motion carried.
Attorney Bonjorni opined that the delay might have some beneficial '
effects if it would permit city consultants and representatives. of METRO
to have an open public meeting to .get some of the problems solved. He
noted that the sewers would be needed and a decision should be reached.
Mr. Weis& asked if the delay would jeopardize our application for
federal funds. Mooney stated that we have made the application for federal
aid, but we do not know what effect this delay will have.
Mooney reported that regarding the North End sewer, we still lack easements
should the project ever get under way. Mooney moved thaf the City Attorney
start condemnation proceedings and that the City Engineer supply necessary
legal descriptions. Strain seconded, motion carried.
Mooney recommended that the Air Pollution committee be, ready with a proposal
so that the city can enact a new ordinance.
CONFERENCES A letter from Barney Wilson was read requesting permission for Pete Baffaro
& CONVENTIONS and himself to attend the Pacific Northwest Park and Recreation Conference
on April 17, 18, 19 and 20, in Salem, Oregon. Strain moved they be authorized
to attend the meeting, Woodworth seconded, motion carried.

ZONING Richard's Hlghllne Acres. Ordinance 1335, zoning the recently annexed Richard's
Highline Acres was read by the City Attorney. Strain moved for passage of ordi-
nance, A'boney seconded, motion carried. The area was zoned C-3.
Mead. Ordinance 1336, providing for rezone .from M-A to M-1 for the property
described on the Mead application was read by the City Attorney. Durand moved
for passage of ordinance, Strain;=seconded, motion carried.

ANNEXATION A petition for annexation for the East Hill Shopping Center was read by the
City Clerk. Woodworth moved to set the date for March 21 at 7:30 p.m. to meet
with proponents. Durand seconded, motion carried.
UTILITY The Mayor suggested we find a ne4 location for the utility buildings soon. The
BUILDING City Engineer was instructed to find out how much acreage is required in the
North lagoon area leased to Mr. Narita where the Street- Department would make
proper fill. Buxton was asked to estimate the cost of the• new buildings. The
Mayor reported he would meet with the state to discuss the $37,000 offer made
for the present buildings and to advise them that the city feels that $45,000.00
was more in order.
The Mayor reported that he felt we should postpone action on the Puget Sound Power
and Light easement for access to the utilities building.
Woodworth noted the untimely dea't.h of W. Emerson Thatcher and moved that a letter
of condolence be written his family. Strain seconded, motion carried.
