February 7, 1966
Regular meeting of the Kent City Council called to order at 8:00 p.m. Present: Mayor Thornton,
Councilmen: Armstrong, Durand, Mooney, Pozzi and Strain and Woodworth, City Engineer Sherwood,
City Attorney Bereiter
Minutes of the last meeting approved as printed and accepted by motion.
Clerk's, Treasurer's and Budget Reports submitted, accepted and placed on file by motion.
STREETS Upon the City Engineer's recommendation, Woodworth's motion to approve the
release 'of an easement on Western Farmers Association property was passed.
Pozzi moved for authorization for the Mayor and City Clerk to sign an easement
for Puget Sound Power & Light for access to. utilities. Woodworth seconded and
motion carried.
Ordinance 1333 providing for the condemnation of portions of the O'Brien Road
and Novak Lane was read by the City Attorney. Pozzi moved for passage of
ordinance, Mooney seconded, motion carried.
212th. Pozzi noted that widening of S. 212th was necessary and that construction
should take place this summer, to coordinate with water and sewer programs. He
moved for Hill & Ingman to be authorized to proceed with plans and specifications
including right-of-way engineering with all designs to be coordinated with the
City Engineer and Street Committee, and for Dames & Moore to handle soil analysis
for the project. He noted that compensation for Hill & Ingman would be on the
basis outlined in section X(F) of the existing agreement. Woodworth seconded,
motion carried.
Freeway. A letter was read from the Washington State Highway Commission
acknowledging receipt of the Mayor's letter of February 1, 1966, ,regarding
various aspects of plans for the Valley Freeway, which they are calling to the
attention of the Department Staff. Letter placed on file.
James. A letter was read from the Washington State Highway Commission concern-
ing our request for additional traffic control facilities at the Intersection
bf James Street and the West Valley Highway and informing us that additional
warning signs will be installed at this intersection. Channelization and signali-
zation will be considered for the 1967-69 construction program. Letter placed
on file.
Freeway. Woodworth moved for the Mayor to be authorized to sign the voucher
from the State for payment for the utility building whenever advisable. Strain
seconded, motion carried.
Pozzi noted that the City is trying to work with the Chamber of Commerce to get
the street program moving in a unified manner. He moved to send a communication
to P.J. McKay requesting a meeting with State Officials to further discuss various
features regarding East-West Freeway. Armstrong seconded, motion carried.
LIGHTS A motion was made by Durand to put five additional mercury vapor lights on 36th
Ave. S. two at the corners of 244th and 248th, with three lights placed equally
In between. Strain seconded, motion carried.

Pozzi noted that the lights on James Street will be installed soon.
POLICE & Woodworth noted that the Colonial Tavern and Eagles Hall have requested cabaret
FIRE licenses and moved for the Police Committee to be given the power to act on this
matter. Strain seconded and motion carried.
A letter was read from Puget Sound Power & Light commending the Kent Police and
Fire Department for their assistance on Tuesday, February I, 1966 when a 12,000
volt line fell. Woodworth moved .that copies be sent to Police Dept. and Fire
Dept. thooney seconded, motion carried. Mooney moved that Puget Power be requested
to correct all the leaning poles in the area, including the one near the Freeway
entrance. Woodworth seconded, motion carried.
WATER Strain noted that the City would be willing to assist residents in the Black
Diamond Highway, Maple -Valley Highway area, in forming a water district.
Strain moved for the City Attorney to be authorized to make a written proposal
for the acquisition of the Hamilton Road Water System through Mr. Thatcher,
Attorney for the Water Co. The City Engineer suggested that water company supply
a map showing the system in detail along with approximate locations of lines.
Strain added this to motion, seconded by Mooney, motion carried.
HEALTH & Complaint. Mooney reported that during the past week, he, the Health Officer,
SANITATION a County representative and the City Engineer investigated a complaint about
a sewage problem at Willo Vista Trailer Court. Samples. were taken of well water
which proved satisfactory and Mooney noted that all corrections have been made
by the owner.
North End. Resolution 552, declaring the City's intention of establishing an
LID for sewer improvements in North Kent, and stating that a hearing on the
proposed• LID will be held in the City Hall at 8:00 p.m. on •February 28th, was
read by the .City Attorney. Mooney's motion to pass the resolution was seconded
by Strain and carried.
ZONING Woodworth reported that he had received a call from Mr. Ramstad regarding a delay
in a rezone. It was ascertained that through a typographical error, the publica-
tion was incorrect, and the rezone would be delayed. Ramstad had planned to move
a building onto the site to be rezoned, and now will need an extension of time from
the State In order to leave the building at it's present location until the rezone
goes through. It was ascertained that the City Engineer would contact the state
officials to assist in securing the extension.
Mead. A public hearing was opened on the rezone application filed by Herb T. Mead
from M-A to M-1. It was noted that the application had been approved by the
Planning Commission. There were no comments from the floor and the hearing was
closed. By motion, the City Attorney was instructed to draft the necessary
ordinance.
Richards Hi-Line Acres. A public hearing was opened on the.zoning of Richard's
Hi-Line Acres. It was noted that the Planning Commission recommended it be zoned
C3. There were no objections or comments from the floor. Woodworth moved the
hearing be closed. Pozzi seconded and motion carried. The City Attorney was
instructed to draft the covering ordinance by motion.
PARK A letter was read from the Department of the Air Force, Property Control & Re-
distribution Branch, reporting that they will act soon on the City's request for i
a plane for the park. Letter placed on file.
The City Attorney reported he had drafted leases for both Dr. Rugg & Mr. DeMartino.
FINANCE Armstrong moved that the indebtedness of $88,000.00 to Mrs. Bevaert on the lagoon
property be paid off by borrowing the money from other city funds. He noted that
the lending fund would be paid the same interest now being paid. Upon Strain's
second, the motion carried. TheCity -Attorney was instructed to draft the covering
ordinance.
A letter was read from the City Treasurer requesting authorization to reinvest
$100,000'.00 of 1964 Water Construction Funds for a period of 90 days. Armstrong
so moved, Strain seconded, motion carried.
CONFERENCES A letter was read from the Columbia River Water Congress of .the Northwest extending
an invitation to attend the Columbia River Water Congress sponsored by the Wenatchee
Daily World. The dates will be April I and 2 in Wenatchee. Woodworth moved that
the Mayor be authorized to attend, seconded by Mooney, motion carried.
A letter was read from Commissioner Scott Wallace suggesting we bring together,
within King County, an informal group patterned after the Puget Sound Governmental
Conference. This will be discussed at a meeting scheduled February IOth at 8:00 p.m.
The Mayor remarked that the City of Kent will be represented at this meeting.
BID Bids for a truck for the sewer department were read by the City Clerk. Upon
Nooney's motion, the bid was awarded to Valley Garage upon their low bid of
$1,693.46 plus tax, with trade.
TELEPHONE A letter was read from Pacific Northwest Bell reporting a reduction in the contract
CONTROL covering the city's .PBX Switchboard.
PLANNING The Mayor's appointment of Don Eide to the Planning Commission to replace Marvin
COMMISSION Beckman was confirmed by motion by the Council.
RATES Ordinance 1332, passed at the last meeting was read again by the City Attorney
including the corrections mentioned at the last meeting. The corrected ordinance
was passed on Strain's motion, seconded by Mooney.
ANNEXATION A petition for annexation by Kent Highlands was submitted by Curran & Curran,
along with a letter from the City Engineer certifying that the signatures thereon
represent owners of property aggregating more than 10% of the assessed valuation.
A motion was passed to meet with the proponents of the annexation at 7:30 p.m. on
February 21st immediately preceding the next council meeting.
APPEAL The City Attorney noted that a hearing was scheduled on an appeal filed by Orvel
Cavendar and his wife and Calvin Hilton and his wife from the ruling of the Board
of Adjustment in upholding the decision of the City Engineer in granting an
occupancy permit to Kent Masonic. Hall Assn. He proceeded to read the appeal and
Resolution #49, passed by the Board of Adjustment on January 4, 1966.
The hearing was then declared open. Mr. Veblen, representing the Cavendars and
the Hiltons reviewed the history of the matter quoting from Ordinance 898 and
quoting also from a letter from City Engineer Sherwood to the Masonic Lodge
setting forth certain conditions which the city required be complied with before
the certificate of occupancy could be issued. Mr. Veblen contended that the
conditions had never been fulfilled, and that the principle problems were drainage,
parking and fencing. Mr-. Ronald Meier, representing the Masonic Lodge held that
the conditions outlined by Mr. Sherwood had been met and that the matter had been
reviewed in detail before the Board of Adjustment before that body passed Resolu—
tion #49.
The hearing. was concluded and a motion passed for the council to recess for an
executive session. Regular meeting reconvened. Pozzi moved for the decision of
the Board of Adjustment in this matter to be upheld as outlined in Resolution #49:
. .. for.the reasons that the Masonic Lodge Association had substantially complied
with the conditions of the original Conditional Exception and the provisions for
parking and blacktopping and all other conditions and that the City Engineer's
interpretation of the fencing requirement was a fair and reasonable decision made
in good faith and that the said City Engineer in good faith applied the zoning
ordinances of the City of Kent in issuing said Certificate of Occupancy". Motion
seconded by Strain and carried. Mooney abstained from voting.
