January 17, 1966
Regular meeting of the Kent City Council called to order at 8:00 p.m. Present:
Mayor Thornton, Councilmen: Armstrong, Mooney, Pozzi , Strain and Woodworth,
City Engineer Sherwood, City Attorney Bereiter.
Minutes of the last meeting approved as printed and accepted by motion.
Clerk's, Treasurer's and Budget Reports submitted, accepted and placed on file by
motion.
LIGHTS It was noted that the short poles along Military Road in vicinity
of 244th have been replaced with regular poles. Sherwood suggested
street lights be installed along this strip. Strain moved that this
be referred,to street light committee. Motion carried.
STREETS Arterial Street Plan. A public hearing was opened on the proposed
updating of the arterial street plan. The City Engineer noted that
streets which would not be included under the 1/2 cent gas tax
money should also be improved, possibly under an LID. He explained
which streets were included in the plan. There were no objections
from the floor and the Public Hearing was closed. Resolution 548,
updating the comprehensive street plan was.read by the City Attorney
and Pozzi 's motion to pass same was seconded by Armstrong and carried.
HEALTH & North. Mooney reported on the north end industrial property sites.
SANITATION The resolution of intent will be ready for council by February 7th
and the public hearing will be held late in February. Hill & Ingman
have had excellent cooperation from the people securing the easements.
Mooney reported that more returns received lately had indicated
favorable reception to the dumpster type disposal system. The commit—
tee is considering the question of whether we should go into operation
ourselves or on a lease basis. Will try to resolve this problem in
two weeks. The committee will also propose changes in the charges
for pick—up service in some instances.
POLICE & Woodworth reported that Patrolmen Loveless and Hougardy had recently
FIRE been promoted from Class C Patrolmen to Class B. Woodworth's motion
for the third class firemen category to be assigned the salary base
of $505 month was seconded by Strain and carried.
A letter was read from the King County Fire District #23 commending
the Kent Fire Department for the help and cooperation rendered them
on December 8, 1965. Mooney moved for Woodworth to commend the Fire
Chief, Strain seconded and motion carried.
A letter was read from Statewide City Employees Retirement System
requesting the Council 's action regarding the possible retirement of
Police Chief Robert E. Lee. Strain moved letter be referred to the
Police Committee, Armstrong seconded, and motion carried.
WATER LID 246 A letter was read from Goodnews Bay Mining Company regarding
$ 14,068.37 water main assessment and noting that they would seek to
recover the amount if the LID was "undone" by litigation instigated
by several attorneys. Mooney moved letter be accepted and placed
on file. Woodworth seconded and motion carried.
The City Attorney requested permission to obtain expert legal counsel
to assist him in the challenge of LID 246 and also to assist him in
the law suit instigated by Hanson Construction Co. ' Strain seconded,
motion carried.
FREEWAY A notice was read from the State Highway Commission giving the informa—
tion that the public hearing on the route of Valley Freeway from S. 228th
to S. 285th will be held in the Kent courtroom on Tuesday, January 25th,
at 2:00 p.m. Highway representatives will be on hand at a prehearing on
January 24th from 1 :30 to 4:30 p.m. to answer questions. It was deter—
mined that the City has had no communication from the state regarding
city property involved. Mooney moved for the City Clerk to write to the
District Director requesting a meeting with Kent officials to discuss
the value of city property which is in the path of the freeway. Motion
seconded by Strain and passed.
ZONING Mead A letter was read from Kent Planning Commission recommending that
the application submitted by Herb T. Mead for a change of zoning from M-A
to M-1 be approved. Armstrong's motion to set public hearing for February
7th was seconded by Pozzi and carried.
Richards Hyline Acres A letter from the Planning Commission was read
recommending that the newly annexed Richard's Hyline Acres be zoned C3.
By motion a public hearing on same was set for February 7th.
Parks A public hearing was opened on the Parks request for a rezone
from C3 to MI. It was ascertained that the Planning Commission had
recommended that this application be denied. Mr. Judson Colburn, repre-
senting the applicant explained the location and showed pictures of the
proposed fabricating plant which would employ about 200 people. It was
determined that such an operation would fall under MI zoning. The City
Engineer recommended that if this rezone was granted, that a 200' C-3
buffer zone be maintained. It was noted that financing for this C3 area
had proven difficult to secure. Mr. Wilson, who owns property on the
South, adjacent to the Parks property objected to the MI zoning. He re-
ported that he had no definite plans for his property as yet, but that
MI zoning would not be compatible with his property. The public hearing
was closed by motion. j
Pozzi 's motion for a 5 minute recess was seconded by Strain and carried.
The Council recessed to the conference room.
Pozzi moved to reconvene. Strain seconded and motion carried.
Woodworth made a motion to uphold the recommendation of the Planning
Commission which was seconded by Pozzi . Under discussion, Armstrong
moved to amend the motion to add referring the matter back to the Planning
Commission with a request to consider including all the property on the
East side of present Highway 99 and property immediately North, and South
to 252nd St. to be rezoned to MI . Mooney seconded. Amended motion carried,
with Woodworth voting nay.
FINANCE A letter was read from the City Treasurer certifying amount of
assessments collected from Local Improvement District No. 246, to
be $53,084.08 and reporting that the unpaid assessments amounted
to $185,704.54. The letter was placed on file.
CLAIMS Pozzi noted that Mrs. Esther Stacie had filed a claim for damages to
her car, incurred when she parked near the fire hydrant on Ist Ave.
near the National Bank of Washington. He moved for the claim to be
denied, and noted that the hydrant was not improperly placed. Motion
seconded by Woodworth and carried. Mooney noted that Mrs. Stacie had
also filed a claim for recovery of money paid for sewer charges. He
moved for the City Clerk to be instructed to write to her advising her
that both claims have been denied. Motion carried.
UTILITY TAX A letter was read from the Washington Natural Gas Company suggesting
that in the city's proposed 3% tax on utilities, some consideration be
given to placing a maximum tax on industrial users, and that some thought
be given to taxing other fuel as well. Upon Pozzi 's motion, seconded
by Armstrong, the letter was placed on file.
Ordinance 1331, providing for a 3% tax on utilities and repealing the
B&O tax, to become effective on March I, 1966 was read by the City Attorney.
Woodworth moved, seconded by Pozzi for passage of the ordinance. The motion
carried with Mooney abstaining. Mr. Maki stated that this measure would
transfer the tax burden from business to the people.
RATES Ordinance 1332, concerning water rates and sewer connection fees and other
fees and .placing the municipal accountant in charge of the city's utility
department was read by the City Attorney. Woddworth's motion to pass the
ordinance was seconded by Strain. Discussion was had on the merits of the
changes in the various charges. The motion carried. The City Attorney
advised that there were grammatical errors in the ordinance that would have
to be corrected and that the document would be presented to the Mayor for
signature later in the week.
APPEAL The City Clerk reported that an appeal from the action of the Board of Ad-
justment in the Kent Masonic Hall Assn., Inc. matter had been filed by the
attorneys for Mr. & Mrs. Orvel Cavender and Mr. & Mrs. Calvin Hilton. Mooney
moved for the public hearing to be set for the February 7th meeting. Notion
seconded by Strain and carried.
EDA APPLICATION The City Engineer reported that resolutions were necessary to authorize some-
one to sign the applications for securing funds through the Economic Develop-
ment Administration to help in the construction of streets, water and sewer
improvements. A motion was passed to name the City Engineer, Glen Sherwood,
as the city's representative in this matter. Resolution 549 for the water
improvement application was read and passed by motion. Resolution 550 for
the street improvement program was read and passed by motion. Resolution
551 for the sewer improvement program was read and passed by motion.
STADIUM Mooney moved for the city to go on record as endorsing Mayor Custers proposal
for locating a stadium in Renton, seconded by Strain. Mooney commented that
Custer's proposed IoCation would handle traffic very efficiently. POZZi ,
Woodworth and Armstrong voted nay. Motion failed.
CITY ATTORNEY A letter of resignation was read by the City Attorney to be effective not
later than March 31, 1966. No action was taken on the matter.
