Present : Mayor Thornton, Councilmen: Armstrong, Durand, Mooney, Pozzi, Strain and Woodworth. Minutes of the last meeting approved as printer}, hy motion. Budget and Clerk 's reports submitted , accepted and placed on file , by motion. WATF;R 2nd Line Ramsey reported that Coluccio was now in cleaning up stages on the Second Transmission Line. LID 246 By motion, Hansen Construction co. contractors on the north water, project, was granted a 45 day extension. fll?ALTH &, North J?rid Mooney moved for a 60 day time extension to be granted SANITATION to `I'ri State Construction Co, contractors for t}re rror•th end sewer job. Motion passed. A letter was read from the Washington State Pol.lu.tion Control Commission approving the change order for the north treatment; plant for the George Slater Co. Letter filed, by motion. Plant Modifications A letter was read from the Health, Education and Welfare Dept stating that a "cut off" date of Jan 12, 1965 had been established for the work on the modifications to the treatment plant. Letter filed, by motion. Federal Grant In compliance with a letter from the Health, Education and I�Jelfare office, the Mayor was authorized to sign tree "assurance of compliance with the civil rights act" in connection with the federal grant. South End Mooney noted that the city officials would meet with residents of the south end on Tuesday, Jan 26th at 8:00 PM at the City Hall to discuss the south sewer program. Boeing By motion, the Citv Attorney was authorized to advise Boeing that under state statuie•• the city could not grant credit on the hook up fees for the *16,000 that will be paid for the sewer line. STORM SEWERS Van de Vanter The contractor is underway on the Van de Vanter storm sewer project and expects to be finished in early February. 8 th Ave. S. The work on the 81kth Ave. storm sewer will get under- way this week, with the state coordinating their work with the city 's. STREETS The City Engineer reported that t;he Northern Paci.f:ic is no longer interested in a spur crossing south of James across Ist Ave. They are willing to "replace the sidewalk in the Pink Elephant Bakery area after new grades are established. Smith St. Pozzi reported that -die paving is complete on Surith St. and that it would be open to traffic on 'Tuesday. James St. Extension A letter from the Washington Appraisal Services and a bill for their, services for, work in connection witti tire Chicago Milwaukee and St. Paul Railroad relative to the extension of James St, was, by motion, held over for action later in the week. Freeway Discussion was had on the procedure to be followed by the State Highway Dept regarding the freeway and the East-West Express- way and the purchase of rights of. way for the same. Tire City Engin- eer stated he understood that the transcripts from the public meet- ing held here would be considered before the Bureau of Public Roads. Then, after a plan is formed, it will he presented to the Council for approval. Mooney suggested we have a written communication from the Highway Dept so we will know where we stand on these issues, and a letter to McKay requesting this information was authorized. TRAFFIC Parking Woodworth moved for parking to be prohibited on both sides CONTROL of the street for the following locations : On Central from James to 228th On Smith from Kennebec to Jason On Meeker from the Milwaukee tracks to the `;west Highway Motion passed over Strain 's nay. Armstrong noted that ingress and egress at the Tradewell Shopping Center off Smith St was inadequate and that tre situation would be improved if some of the curbing was taken out opposite Clark St. Woodworth said his committee would look into the matter. LIGHTS Authorization was given, by motion, for the installation of 20,000 lumen lights, one at the corner of 6th &: Gowe and one at 5th & Gowe. FINANCE Leases Armstrong reported that the City Attorney was drafting documents for Narita to lease a. portion of the disposal plant site for $800 per .rear and for Reano to lease a portion of the north lagoon site for $120 per month, without the house. The city will have the right to terminate the leases if necessary. Authoriz- ation was given for the Mayor and City Clerk to sign the leases. Kent Swim Klub A motion was made for the bill for the Kent Swim Klub to be adjusted so that they do not have to pay the $40 sewage charge on the initial filling of the pool. It was ascertained that this same procedure will be followed for all pools on the initial filling. Motion passed over Pozzi 's nay. Insurance A letter was read from Hardware Mutual - Sentry Life Insurance Co expressing interest in bidding on the city'sminsur nce ! business. By motion, this was referred to the Finance Co GitX Hall A claim submitted by Don Bogard, Architect, in the amount of T-39b.UU for work on the plans for remodeling the City Hall was i held over until the Building Chairman, 0. Buxton, returns to the city. Parks & Recreation A claim from Hatch Sporting Goods for approx. T500.00 was denied by motion, as the expenditure was not' budgeted. The bill was referred to Chas. Wilson, of the Kent Activities Council. TONELLI A public hearing was opened an the Tonelli Annexation Bereiter ANNEXATION reported that the Board of Review report was favorable to the annex- ation, and, there,, being no objection from the floor, the public hearing was closed. Ordinance 1282 providing for the annexation of the property described therein was read and passed by motion. SCHOOL Woodworth noted that officers Loveless, Hougardy and Danielson had recently attended courses at Highline on Administration of Justice. Loveless also attended the auto theft conference. FIRE. DEPT Headquarters A letter was read from J.D. Stewart, contractor for Staion ffl, requesting extension of 30 working days. The request was granted, by motion. By motion, the Council authorized change order #1 concerning the apron at Station #1, on the recommendation of Fire Chief Bridges. The change will increase the cost by *665.00 Station #6 By motion, the Council accepted the work on Fire Station built by Miller Construction. SAFETY Discussion was had on the operation of the Kent Safety Council. COUNCIL Woodworth pointed out that state statutes would not allow the city to allocate funds directly to the Safety Council. Mr. Waschnict stated that the Safety Council would try to raise funds elsewhere ratyer than be taken over by the Seattle Safety Council. Woodworth commended the all-volunteer service of the Kent Safety Council and the directors of the Traffic School. ZONING By motion, Feb. 15th was set as the public hearing date for the I following rezones : 1) Lenci, MA to M-1. Planning Commission recommends approval 2 ) Mead & Willard PIA to M-1 3 ) Thorp & Thomson C-3 to R-3 to M-1. Planning Commission recommends approval only for that portion which borders on the C-3 property. Jackson - Clements A public hearing was opened on the Jackson- Clements request for a rezone from R-4 to C-3. It was ascertained that the Planning Commission recommends that the rezone as originallyl requested (R-4 to C-3 ) be granted. The Council has heard two public i hearings on this previously. Mr. Curran, representing those opposing the rezone , and Mr. Thatcher, representing the applicants summarized their previous statements on the matter. Bicknell reported that he felt the matter had been sufficiently aired before the. Planning Commission. Armstrong questioned the possibility that C-3 here could be considered spot zoning, but the Planning Commission maintained it is not, since it is contiguous to other C-3 zonings. Mr. Curran questioned the legality of the procedural ! steps in the matter and Bereiter stated that the legal requirements had been complied with. The public hearing was closed. Woodworth moved for the rezone to be granted and an ordinance drawn for the same, and the motion passed with Armstong voting nay. Bereiter then sug ,ested that the motion be changed to include the reasons i for the motion. Woodworth moved for another vote to be taken. This motion was seconded and passed over Armstrong's nay. Wood- I worth then moved for the rezone to be granted for the property described for this reason: the rezone would be compatible with the principles and techniques of comprehensive planning and would be in the best interests of the health and welfare of the citizens of Kent. The motion was seconded and passed over Armstrong 's nay. Curran stated that he would like the record to show that the objectors take exception to this motion of the Council. Pozzi noted that Curran had not complied with the usual procedure to be recognized from the floor and requested, j on a point of order that the Council move on to other business.
