Regular meeting of the City Council present Mayor Thornton,
Councilmen Bovell, Hartlaub, Mauritsen, Shaffer, Strain, &
Woodworth.
Minutes of the last regular meeting approved as printed. . .
Treasurer and Clerk 's report presented and by motion placed
on file.
City Engineer requested the Council to set a hearing date of
February 5, 1962 on this arterial street plan on the 2 cent gas tax,
Ordinance.
It was moved, duly seconded and passed to hold the hearing
on February 5, 1962.
Mayor Thornton announced the hearing open on LID 240 for
Improvement on the streets of Kenwood and Guiberson.
Clerk read a letter from Gertrude B. Dawson stating that her
vote would be no against these improvements at this time for the
streets on LID 240.
Clerk read a letter from Mr. James P. Curran stating that he
did not wish to protest the assessment under LID 240 but he thought
the 0ity should figure out some method to secure further improved
streets without imposing the entire assessment upon the property
owners, especially when the street was more or less a main arterial.
Clerk read a letter from Mr. Dowell, Good, & Worth protesting
the narrow entrance on their driveway when the street improvement
was made on LID 240 stating, that they had only a 14 foot curb
entrance. It is to narrow and they would like the same width as
their driveway, otherwise they protest the assessment.
No further people objected from the floor so the Mayor
declared the hearing closed.
Motion made, duly seconded and passed to' deny the protest.
The reading of the Ordinance was called for.
Ordinance #1114 was moved, duly seconded and passed by the
unanimous vote of the Council present app"roving and confirming the
assessment roll of the LID 240 for the improvement of certain
streets and Avenues in the City of -Kent by construction and
installation of curbs, gutter, storm drains , catch basins,
ballast, crushed stone, sub-base , asphaltic concrete paving, to-
gether with all necessary work in connection therewith and incidental
thereto.
Mayor Thornton announced the hearing is now open on the
Plumbing Code.
No objections were made on the Plumbing Code adoption so
the mayor announced the hearing closed.
Ordinance #1115 was read to adopt the Western Plumbing
Official Uniform plumbing code by reference and by motion made
duly seconded and passed.
Mayor Thornton announced the hearing open on the Building
Code.
The Building Code we have is the national building code
which we have been working under for some years: But we are
adopting a later addition of this code. Anyone objecting please
stand give their name and address.
No one objected to the later addition of this code so
Mayor Thornton declared the hearing closed.
• City Attorney is to draw an Ordinance as the Building
Officials and Engineers so recommend as the slight changes to
be made, Motion carried..
Councilman Woodworth brought up the retirement phase of
Denis L. Armstrong which reaches age 65 in April. Councilman
Woodworth moved to retire Mr. Armstrong at this time, duly
seconded and carried.
Councilwoman Bovell moved " because of the rapid growth
within our City limits, new annexations and areas seeking annex-
ation, it is important that we evaluate our present sewerage
disposal plant in respect to capacity and improvement that can
be made now and plan for future enlargement to accomdate projected
developement.
Therefore, I move the following :
1. That we make application to the housing and Home Finance
Agency that the Community facilities administration for funds
to finance preliminery and final planning of sewerage gathering
and disposal, including all presently anticipated annexations
within the next six years. Planning to be projected ten years.

2,. That we hire Hill & Ingman as Consulting engineers to
start work immediately, with our Engineer to prepare this ap-
plication.
, 3 . That we ask the City Attorney to prepare a resolution
to accompany this application.
4. That the City Engineer and the Counsulting Engineers
prepare forthwith, information on the improvements that have
been made in the disposal plant and its present load to be
forwarded to Mr. Koch, of the State Health and Sanitation Dept. ,
Smith Tower, Seattle, for their information. Also that a flow
of all data and information on our present disposal plant and
treatment of sewerage as it developes thru this planning-be
forwarded to ` Mr. Koch's Office at least once a month. Council-
woman Mauritsen seconded and carried the above motion:i.
Councilwoman Mauritsen made a motion to have installed a
street light on the North Road at the East Hill Elementary
School, duly seconded and passed- for the installation of this
street light.
Councilwoman Mauritsen would also like Council action on
the lights that were installed at the Military Road and the CORRECTED REFER TO
MINUTES OF 2-5-62
Kent De sMoine s Road•
Councilwoman Mauritsen reported that all the other lights
on order have been installed. The only lights that have not
been installed are suspension lights. ` Two at Kent DesMoines
Road and the Reith Road entrance and one on the West Highway
at Ernies Standard Road.
Councilman Strain made a motion to have the Clerk call
for bids for a new 40 H.P. water pump' in the Reiten Road
pump house at a cost of$2450.00 this includes a 40 H.P. ,
reduced voltage Auto-Transformer Motor starter, a 200 Ampere
3 Pole J Frame Breaker, all wire, fittings, conduit and
ether material needed to install above. Motion was made,
duly seconded and passed to call for bids for the installation
of a pump and equipment.
Councilman Strain brought up his meeting with Water
District #111 that is in the Meridian area he stated that they
were seeking different sources of water for their district
and that if they took water from the City of Kent we would
give the people in their District their choice to go with the
District or take water from the City. If they went to another
source we would not give them our customers that were in the
District.
Motion made for the Clerk to write a letter to the Water
Commissioner of District 111 stating that if they took water
from the City of Kent we would give our customers in their
district for them to have as their customers and if they
went to another source we would retain our own customers with
in their districtk motion duly seconded and passed.
City Attorney Thatcher brought up a question with one
of our water users In the East Hill that he had signed an
agreement that the City could terminate his water at anytime
on account of he was using surplus water and the contract
reads that way. The FHA would like to have it clarified so
this was explained to the Council that it was the policy of
the City to protect ourselves in that way at no time have we
cut of anyones water, because we have surplus water for the
people.
Motion was made for the City Attorney to write a letter
to the FHA and let them know of the policy that we had and
why to satisfy the FHA that they could go ahead and make a
loan on the place.
A letter was read from L.H. Cavanaugh, City Treasurer
announcing that he had securities purchased as an investment
with $80,000. Sewer Constfuction funds and which will then
be available for reinvestment in full, or a lesser amount as
may be determined by the City. Engineer to be unrequired for
immediate disbursement. The Treasurer at this time is
recommending that we invest the money in Savings and Loan
Associations and get returns of 4 to 41% instead of the low
return from a Government Investment of 2.4%. Motion made,
duly seconded and passed for the Treasurer to invest the money
in Savings and Loan instead of Treasruy bills.
Continued:
A letter of resignation from Mr. E.W. Turner from the
Planning Commission was read. Motion made, duly seconded and
passed to except the Resignation of Mr. Turner from the Planning
Commission with thanks.
Motion was made, duly seconded and passed to instruct the
Clerk to write a letter to Mr. Turner for appreciation' of his
services on the Planning Commission.
A letter was received from Woodland Homes Inc. , Mr. J.W.
Morrison • President stating that he recently attended a meeting
between our park board, County Park Board, and Federal Way
School District and others in connection with the exchange of
a piece of property of which I am the owner for park purposes.
King County now owns a parcel of land on the Military Road
disignated for park use and wishes to exchange with the City
of Kent this site for a parcel of land adjacent to an Elmentary
school and proposed Jr. High School.
This letter he states 'will serve notice that he is in favor
of the property transfer this would constitute a better park
location for the school and surrounding area.
City- Attorney Thatcher reported that he was requested at
the last meeting to find out wheather or not this park could
be used otherwise than for purposes he found out that even
with the transfer that this shall be for park purposes and for
park purposes only. He has acquired all of the detail and
legal matter on the condition of the Transfer and he recommends
that the City accept the transfer for park purposes.
Mrs. Hogan a park board member 'was present at the meeting
and stated that at this time we have not enough information to
ask for a transfer.
City Attorney stated that the park board was aware of
this piece of property transfer quite some time ago, and Barney
Wilson said that we shouldn't rush into this transfer until
we know what we are getting. It seems that this piece of
property was not equal in value to the piece on Military Road.
Councilman Shaffer moved for the City Attorney to ask for
a transfer of the general plan of the City of Kent will ask
King County to transfer park property and the right to change
it for other property that will be used for park property and
have Mr. Jones of the Federal Way School let us know what his
development is. This motion was duly seconded and passed with
Councilwoman Mauritsen voting nay.
A letter was read from the Planning Commission stating
that they had received a letter from the City of Renton stating
that their Planning Commission had recommended the initial set-
back at 20 feet along the North side of South 180th. This
would be a total setback of 50 feet from the center line of the
road. They request that we do the same this would provide for
an industrial arterial of 100 feet width.
The Kent Planning Commission is unanimously in favor with
this plan and they recommend that the City Council require the
same setbacks on the South side of 180th. motion made, duly
seconded and passed to set a hearing date on the setbacks on
the Orillia Road premsis 180tO for February 5,
A letter was read from the Association of Washington
Cities presenting the subject of Election for a levy would be
for a four year period. The reason for this is to have less
election costs.
Motion made, duly seconded and passed to have the chairman
of the Finance Committee study this letter and report pack.
A letter was read from Mr. Macwhinnie a dentist in Seattle
denouncing Flouidation. This letter was referred to the health
I and Sanitation Committee for study.
A resolution was presented and read for the creation of
an LID for water lines on the Lake Fenwick Road. Motion made
duly seconded and passed to adopt Resolution #466 for the
improvement of certain streets and avenues in the City by
construction and installation of water mains and fixing a
time and hearing date. 1 62 on the Lake

Continued:
Ordinance #1116 on the glass doors was read. Councilman
Hartlaub moved, duly seconded and passed to adopt the Ordinance
on the glass doors.
Mayor Thornton appointed Harold Heath to the Planning Comm.
in the place of E. W. Turner who resigned from the Planning
Commission.
The Council by motion passed to accept the recommendation
of Harold Heath to the Planning Commission made by the Mayor
to take the place of E. W. Turner.
A letter was read from Gertrude Bovell to the Mayor as
follows: "Dear Sir: I wish at this time to submit my
regignation as Civil Defense Director I have gained much from
this position and enjoyed it. To take effect as of Jan. 15, 1962.
Gertrude R. Bovell".
Motion was made, duly seconded and passed to accept the
resignation of Mrs. Bovell.
Mayor Thornton appointed.'Edward G. Costello as director
of Civil Defense in place of Mrs. Bovell. The Council confirmed
the appointment by the Mayor.
Councilman Woodworth brought the question up of the com-
plaint of Mr. Worth, Good and Dowell in regard to a 14 foot curb
cut out to their driveway on Guiberson Street. This 14 foot
curb cut out caused them to hit their tires on the curb and
they requested that it be 18 foot cut out the same width as
their driveway.
City Attorney Thatcher stated that Viater District 75 asked
for a continuance on the case. Council moved that City Attorney
refuse the continuance on the case by motion passed.
Pete Baffaro, member of the park board appeared before the,
Council at this time and asked about the Park property. It
was stated that the park property had been negoiated and talked
about for thellast hour and instructions was for the City Attorney
to get a transfer from the County for this piece of property
under discussion.
8 ' Mayor Thornton reported on the river bank that was two
bad slides along the Frager Road owing to the fact that they
were letting the water out of the dam and shutting it off to
sererly and causing a suction on the banks, thus causing a -
slippage on the ground so the City Engineer called the County
Engineer, and he called Gib Kendall the Street Foreman with
the County men looked at the Frager Road cuts and he stated that
the County would make a study and the control of the rivet.
They would find out why the dam was raised and lowered so fast
and would then report back.
Walt Ramsey of Hill & Ingman was present and stated that
he would get right on the sewerage problem that his company was
hired for during this meeting.
The Board of County Commissioners in regular session on
January 8, 1962 set a date of hearing on the petition for
annexation of territory .- to the City of Kent which was approved
by Resolution No. 460 passed by the City Council of the City
of Kent on' Novemb.er 6, 1961, said hearing to be held on January
29, 1962 at 9:30 AM. This hearing is for the calling of an
election on the' annexation of Valley View and Valley Vista.
