Kent , Washington December 18 , 1961
Regular meeting of the City Council, present Mayor Thornton,
Councilmen Bovell_, } artlaub , i,iaruitsen, Pozzi , Shaffer, Strain,
and '.'oodworth.
Minutes of the last regular meeting approved as printed.
Report of officers, Clerk, Budget, and Treasurer, approved
and placed on file .
Cit- Engineer Sherwood reported on the letter referred to
him at the last meeting on the Lake Fenwick LID. He stated
that now the valuation has raised and an LID could he had.
Councilman Strain moved to have the City Attorney draw a
Resolution for the intent of creating a Local Improvement
District for a water line on the Lake Fenwick Road, duly seconded
and passed.
City Engineer Sherwood reported on Icy Creek and Rock creek
flow. Rock Creek had a 3 , 000.000 gallon high flow, low flow
,,,.,as 1.4. Icy creek was 1. 62 low, but has now picked up to 2 .64.
Mr. Conner, Hush Coldsmith ' s Engineer reported on the
Kentwood Hill sewer. Ile stated that the contract would be
approximately !',2 , 000.00 less than the bid price and by next
Council meeting they would most likely have the final estimate
in.
'Isst. City Fngineer, Dent reported on the James Street
sewer statin; that the man who had the contract made better
connections than were on the previous lines. It is setteling
and will. be in better condition later on.
Councilwoman Bovell reported on Flouri.dation for the
equipment to install ; counting; labor and machinery would be
approximately $5,000.00 and the cost of operation as close
as she can proct,re would be 200 down to 80 per person a year.
They wish to study Flouridation more so will have a report at
a later meeting.
Councilman F'ozzi reported on Street names and changes.
'They were working on this and would have a report into the
sign Department.
Councilman Har•tlaub moved to hold a hearinF- on the Plbg.
Clde January 15 , 1962 , duly seconded and carried.
Councilman Hartlaub moved , duly seconded and carried to
set a hearing on the Building; code for January 15 , 1962.
This is to bring the Code up to date.
Farry Holmnuist , State Engineer was present at the
meeting; and would like a piece of ground that the City owns
which they missed acoui.ring a title to on the Freeway. Ile
requested the purchase of a small corner of the old O'Brien
water sirstem that we purchased for that organization.
Motion made, duly seconded , and passed for the Mayor and
the Clerk to sign the bill of sale and the Resolution for the
sale of the small track of land for a fee of $50.00.
.flavor Thornton announced the hearing open on an annex-
ation that a petition was presented by John Thompson and. others
Anyone in the crowd who objects to this annexation stand give
their name any? address.
Mr. Thigpen in that area objects to the way the petition
is proposed. Ile objects to having his property annexed into
the City of Kent.
Mrs. Sleeman was present and she says she does not want
any part of the City of Kent .
I',,Irs. Robare was present and says she doesn 't want to be
in Kent on account of the trouble she had with the building
department . They wouldn 't allow her a two foot variance.
No other objections.
Mayor Thornton announced the hearing closed.
Motion made to accept the petition duly, seconded and
passed with Councilman Strain and Councilman ,n;oodworth voting
nay.
Motion made , duly seconded and passed for the petition
of John Thompson and others signed by the owners of not less
than 75% in value according to the assessed valuation for
general taxation of the property in said petition described
filed with the City at 11 :30 Am on the 20th day of NRvember
1961, be approved and that the Mayor of the City of Kent be
directed to convene a review board to consider the annexation
proposed.
Continued :
Mayor Thornton announced the hearing open on the Calhoun
appeal to the Council from the Board of Adjustment on a ruling.
Mr. Calhoun spoke in his defense on building a carport to
near the street and the roof of the carport being even with the
street. He would like to have the City leave it the way it is
until the street is improved to the full width.
Mr. Wilke , Building Inspector stated that Mr. Calhoun had
no permit to build this carport.
Mr. Sipe was present from the Board of Adjustment and gave
the finding's of the Board of Adjustment on Resolution #9•
-- Mr. Stark that lives in the area spoke on the street variance
and stated that as long as the street was not widened to the full
property width it was of no concern to him. He also stated that
he has land at the end of that street and it would not always be
a dead end street.
No one else appeared at the hearing. Mayor Thornton declared
the hearing closed
Councilman Woodworth moved to accord the ruling of the Board
of Adjustment , duly seconded and carried with Councilman Shaffer
refraining from voting.
Mayor Thornton opened the hearing on Street lights LID 241 .
Mr. Curran wanted to know why he didn't get an appraisal of what
he owed on this LID after discussion it was found that the City
Clerk had no t mailed out the proper notices according to law
only posted them in the official City paper so the hearing was
dropped and called for a later date .
Mayor Thornton brought up the mutual aid agreement with
the King County Civil Defense and stated that it should be moved
by the Council to have the Mayor and Clerk sign the agreement,
so, Councilwoman Bovell moved to have the Mayor and Clerk sign the
mutual aid agreement , duly seconded and gassed.
Councilwoman Bovell announced that we will have to have our
old Civilian Defense Ordinance revised to work with this new
agreement. Mrs. Bovell requested City Attorney to draw and revise
this Ordinance.
A letter was received from the City of Renton requesting the
Kent Planning Commission to use 20 foot setbacks on 180th or the
Orillia Road, instead of our recommended 10 foot. Letter was
referred to the Planning Commission.
A letter was received from Ruskin, Fisher and associates
requesting sewers in a division they were interested in for at
least 120 connections. Locat$d in the vicinity of 132nd Avenue
S.E. and S.E. 216th St. This letter was referred to the Sanitation
Committee and the City Engineer for study.
A letter was read from the members of the Valley Elementary
PTA Safety Committee thanking the City Council for the fine walk-
way they made on 4th Avenue North between Winner and Shinn Streets
and they did appreciate this because of the school children that
use this walkway.
This letter by motion, duly seconded and passed was placed
on file .
Letter was read from Weter, Roberts, and Shefelman signed
by James Gay our Attorney on the City of Kent vs King County
Water District #75 stating that he is billing us with the previous
services they have rendered and as you have probably been advised
the case has been set for trial on March 12, 1962. Motion was
made,. duly seconded and passed to place the letter on file.
City Attorney Thatcher explained in full ddtail the workings
of the King County Justice Court System he suggested that a motion
be made and we become a part of the justice court system.
A motion made , duly seconded and passed that the City of
Kent elect to take neither under 5 nor under chapter 6 of the
Court law but to become a part of the justice court system.
Additional motion to this, duly seconded and carried that
the City of Kent can't be given representives to the Justice Court
District Committee and its plan includes not only the sub office
in Kent and also the appointment of a Court Commissioner and
creating justice traffic court.
Councilwoman Bovell suggested that Mayor Thornton and
City Attorney Thatcher to work on having a court Commissioner at Kent.
Chief of Police Lee spoke that we have a good court with our
present judge and if we have to set up a Justice Court system we
should insist on a Commissioner and a Traffic Court Violation
Bureau but this would create a larger job for the police in jail
because we are in the center of the population and it would draw
more people to the court . It would be more people to be handled
through the jail.

Mr. Thatcher also stated that we would have no control
over the Justice because he is an elected official.
Mrs. Hogan was present and wanted to know if the Council
had arranged the relief program from the state.
Mayor Thornton announced that she should write a letter
to the man that we had out here and have him make another
appearance on this program at the Council meeting.
Motion made , duly seconded and passed for the Clerk to write
to the State requesting the man that spoke , to return us an
engaged meeting . A copy of the letter is to go to the Park Board.
Mayor Thornton announced the appointment of John 141cGreagor
to the Board of Appeals for an: unexpired term, by motion, duly
seconded and passed the appointment was confirmed.
Dr. Drangsholt was appointed to the Library Board by the
Mayor. Motion made , duly seconded , and passed to confirm the
appointment to the Library Board made by the P,ayor.
Ed Sipe was reappointed for a five year term to the Board
of Appeals. Motion made , duly seconded and passed to- confirm
the appointment of the Mayor.
A hearing was Set for the Street LID 241 for February 5 , 1962
At 8:00 PM at the City Council Chambers.
A hearing was set for the Kenwood Guiberson Street LID
street improvements for January 15, 1962 at the City Council
Chambers.
Councilman Strain stated that he was havinfr a mecti.ng with
the State `timber Cruiser, Mr. Michel Bi_gley ofi the trees that
we were to sell by thining to a logging firm this action was
previously placed in the hands of the t"later Committee .
