Kent , Washington March 3 , 1958.
Regular meeting of the City Council present Mayor Thornton
Councilmen, Curran, Parsons, Pozzi, Scott, Shaffer, Sttaift,
Woodworth;
Motion passed to accept the minutes as printed;
Treasurer' s reported presented and by motion placed on file ;
� SHERWOOD;
Inspected the North Park sidewalks, and found that
some were low and full of water others had holes and weeds
growing over them;The street °lights were not in to bad a
condition; Drainage was bad at First Ave. North and Winner
catch basin is in a bad location. It is the understanding 'that
the N.P.Railnoad Co will raise the grade at this point in
the near future. .
Mr. Appleton of North Park District requested of the council
to have the streets and sidewalks fixed, because the condition
of the streets were very bad on his new car.
SIDEWALK REPAIRS
Motion passed to have the clerk notify the various property
owners to repair their walks that has been under discussion,
soon as the Engineer furnished the owners names, the sidewalks
are to be repair to the City Engineer' s specifications.
Mr., SHEtRWOOD
. Mot,ion passed to have the building committee look into the
outside painting of the new utility building as to color.
COUNCILMAN SCOTT;
Motion made by councilman Scott to purchase a used pickup
truck for use at the Treatmant Plant , motion passed by all
except Strain voted ney. `
Two sidesewers have collapsed at Winner & Adams Streets as
well as the trunk has sunk reported Councilman Scott.
COUNCILMAN POZZI;
I hereby move that the City Engineer' s Estimate No. 3 of
work done by the contractor Russ Davis Concrete Construction
Co on contract Two in Local Improvement District No. 237 of
the City be accepted and approved. that the city issue warrants
on Local Improvement District No. 237 Fund of the city 'in the
amount of $3, 874.67 to -provide funds to pay such estimate ; that
said warrants be in the following numbers and denominations:
Warrants No. 26 $is000.00
Warrants No. 27 •1,000.00
Warrants No. 28 1,000.00
Warrants No. 29 874.67
be dated March 3 , 1958, be made payable to Grandee & Co. , Inc.
of Seattle, Washington, and bear interest at the rate of 4.60%
per annum; "that the proceeds of the sale of such warrants be
credited to Local Improvement District No. 237 Construction Fund"
of the city creamed by resolution No. 387, and 'be used to pay
such contractor.
Motion made by Pozzi seconded by Strain and passed 7,yes;O,No.
COUNCILMAN CURRANT
Motion passed to have Mayor and Clerk. sign change orders;
Change order # 2 for Contract six Rock Creek Supply Main, Item a
'-- installation of an additional 13 feet of 12" cast iron pipe
and 450 elbow on the discharge side of the measuring orifice at
Kent Springs. Item b, request approval of extra work involved in
crossing the Kent-Kangley Road with the supply main near the
Rock Creek Intake Structure.
Letter and blue prints subriiitted by the: :Engineering .Firm of
Hill and Ingman for the ( as built ) _dart of,.tl�e' water system
was turned over to the water chairma` n for study.
Motion passed to have the clerk bill Hill & Ingman for the
repair of the canyon line by the water crew, this was for the
slippage of earth from the pipe line in the canyon, the cost
of the replacement of the earth ever the pipe , and fixing it

Councilman Curran also made a report on the periodical reports
and claims of. the contractors on the water system.
COUNCILMAN STRAIN;
Made a report to the council on the installation recommendation
for two more Mercury - Vapor lights at First & Winner and
N.P.Tracks and James. for residential lights at Winner & West
Highway, and Winner & Adams. Motion passed to have the clerk
place the order with the Power Co. for installation.
PARK BOARD CHAIRMAN BAFFARO;
Mr. Baffaro spoke to the council on the property that the
American Legion owns abutting our property on the north, .this
property should be purchased says Mr. Baffaro, .it would give
us the much needed room that we are in need of. Motion passed
to have ti#h Park Board bring in a report at the next regular
meeting and for Councilmen Shaffer & Strain to serve on the
committee.
COUNCILi IAN SHAFFER;
Reported on city planning and stated that we would not have
bottle-necks in our progress like other cities if we had a
good future planning system, and that Federal matching grants
most likely would be coming along in the last part of A91,000.00

released by the Bureau of Budget, and I recommend that
at a time be released for planning until the Federal matching
mooney is avai:able.Motion passed to have finance committee
advance planning about $ 1,000.00 at a time.
Motion passed to have city attorney draw emergency ordinance
for $ 5,000.'00 for planning.
Councilman Shaffer also explained the Everett meeting to the
council and the advantages of planning if the Metro Plan comes
into effect.
Letter read from Howard Mfg. Co letting the city council
know .that "they did not approve of the way the contractor on
the sewer repair was doing, that they were causing Howard' s
inconvenience, and they would expect to be compensated for
damages.
Letters read from the N.P.Railroad Co. stating that they.
had corrected the necessary repairs to the Smith Street
crossing, and cleared the walk on North First Ave. of all
debris.
Letters with Deeds inclosed from Mr. Brandon, and from Mr.
Leber Sr. for street rightsaways. one for Chicago Street East
of Reiten Rd. and one for a way in gauge addition.
Currandrew to the attention of the council that the N.P.
was rerdoving a loading platform on East `Smith Street, and if
the R.R. Co had no intention of use for the ground that the
City might be able to use it to strighten out Shinn Street
with East Smith, on `and across the N.P.Tracks.
Contract with the King County Parks and the City of Kent to
increase the Recreation Director' s salary $ 25.00 per month
from the city was read. and by Motion passed the Mayor and
'Clerk was instructed to sign.
Letter read from Mr. Curran on a city sewer passing through
his lot without easement was placed in the hands of the city
attorney for legal opinion on the matter and advise to the
council.
ORDINANCE NO. 973 read and by motion passed to authorize the
Mayor & Clerk to issue bonds against LID 236 in the amount of
$25017. 59 . bonds to be issued on or after March° 25, 1958.
Water rate ordinance for the water Department read and placed
in the hands of the City Engineer fbr study with the office
officials. Motion made to adopt ordinance, Motion passed to
table for two weeks for study.
VALLEY CONSTRUCTION C0;
City Attorney read a letter from Valley Construction Co in
regard to the leaks in the trunk sewer pipe line, that is causing
cave ins on the new sewer line,,

Letter from Valley Construction Co and the claim for work
on the sewer is on file in the office of the clerk.
TRUNK SEWER;
On motion duly made , seconded and passed by the unanimous
vote of the Council, it was found by the City Council that
the present condition of said sewer constitutes a nuisance
that a public health emergency exists, that repair of sewer
is immediately necessary; that it is not known that the cost
of repair will exceed $5,000.00 and the City Attorney and
Associat Council were authorized and directed to notify
Valley Construction Co, Contractor, and General Casualty Co. ,
of America, Surety, to proceed forthwith to make the necessary
repairs to said sewer, at contractorts own cost and expense,
or that the City would employ another contractor to do the
work and hold Valley Construction Co. and its surety reap
sponsible for all damages and expenses in connection therewith.
On motion duly made, seconded and passed by unanimous vote
of the Council it was found by the City Council that the rr
present condition of the said Winner street sewer constitutes
a nuisance , that a public health emergency exists, that repair
of the sewer is immediately necessary) that it is not known
that the cost of repair will exceed $5,000.00 and the Sewer
Committee and the City Engineer were authorized and directed
that in the event Valley Construction Co. did not respond to
the notice authorized by the council by previous motion, to
select and employ for the city another contractor to proceed
forthwith with the required repairs of the sewer,under the
direction and supervision of the City Engineer.
SPECIAL MEETINGS ON SEWER TRUNK;
Councilman Curran requested of the council to have placed
in the minutes of this meeting;
Meeting held on monday February 24th. ay the city hall in
regard to the holes appearing in the trunk sewer line that
Hill & Ingman Engineered and Valley Construction Co did the
work, at this meeting the council tried to find out. the cause
of the failure in the sewer line, and who was at fault, the
meeting was adjourned with little or no value as to the cause.
Another meeting was held prior to the regular meeting of
the council, with Engineers, Attorneys, as our councel,
and Mr. Harstad and engineer that is retained by the council
for investigation of the failure and to advise the council
of his findings, at the end of this meeting do definate reason
was given for the failure.
Motion passed to retain Mr. Harstad as our Engineer on the
sewer repair.
Claims read and motion passed to allow all claims except
the claims presented by Hill & Ingman.
