Present: Councilmembers Bennett, Clark, Houser, Johnson, Mann, and Orr, Operations Director/Chief of Staff McFall, City Attorney Lubovich, Public Works Director Wickstrom, Police Chief Crawford, Fire Chief Angelo, Parks Director Hodgson, and Finance Director Miller. Approximately 25 people were at the meeting. PUBLIC National Health Unit Coordinator Day. Mayor Pro COMMUNICATIONS Tem. Woods noted that the Puget Sound Sea-Health Unit Coordinator Chapter was formed in the Puget Sound area in May, 1989, and that it represents many dedicated health team members. She read a proclamation declaring August 23 , 1995, as National Health Unit Coordinator Day in the City of Kent, and noted that the proclamation will be sent to Boyd Martin. CONSENT JOHNSON MOVED that Consent Calendar Items A CALENDAR, through C be approved. Orr seconded and the motion carried. MINUTES (CONSENT CALENDAR - ITEM 3A) Approval of Minutes. APPROVAL of the minutes of the regular Council meeting of August 1, 1995 . DEMOLITION (BIDS - ITEM 5A) 1995 Building Demolition and Removal. Bid opening for this project was held on Thursday, August loth with 11 bids received. The low bid was submitted by Building Busters, Inc. in the amount of $78, 648 . 42 . The Engineer' s estimate was $144 , 004 . 46 . The project consists of the demolition and removal of 28 buildings at three different sites, some of which are in line with the 196th Corridor and 272nd Corridor projects and could become potential hazards. It is the recommendation of the Public Works Director that this project be awarded to Building Busters, Inc. for the bid amount of $78 , 648 . 42 . Assistant City Attorney Brubaker noted that there was a minor irregularity in the bid, in that the lowest bidder filled out only the total price, not the unit price, on the bid form. He said that this is an informality which may be waived. Upon Mann' s question regarding the difference between the bid amount and the Engineer' s Estimate, Wickstrom explained that they are not experienced in estimating this type of project - and therefore estimated high. He also explained 1 August 15 , 1995 PUBLIC for Houser that none of the structures are COMMUNICATIONS usable. MANN THEN MOVED that the 1995 Building Demolition and Removal contract be awarded to Building Busters, Inc. for the bid amount of $78, 648 .42 . Clark seconded and the motion carried. ANNEXATION (PUBLIC HEARINGS - ITEM 2A) Meridian Annexation (AN-94-7) . This public hearing has been set for comment on the proposed Meridian Annexation. The City has received a valid petition requesting this annexation. On July 20, 1995, the Washington State Boundary Review Board for King County, after a public hearing, tentatively approved this annexation, and, on August 10, 1995 , the Boundary Review Board officially approved the Meridian Annexation to the City of Kent. The annexation area is com- prised of approximately 5. 27 square miles lying contiguous with and east of the current City limits. The annexation area is generally bounded on the north by S. 240th Street, on the west by Soos Creek and Highway 18 , and on the south by S.E. 288th Street. An ordinance has been prepared for Council deliberation which approves the annexation and, among other things, establishes the effective annexation date for January 1, 1996 . At the close of the public hearing, the Council may, if it chooses, vote to approve the Meridian Annexation ordinance. Assistant City Attorney Brubaker pointed out the area on the map and outlined the boundaries. He noted that the Boundary Review Board unanimously approved this annexation. He explained that Council can approve, disapprove or take no action on this annexation. He also stated that all or part of the area can be annexed. He noted that two portions of the annexation were omitted from the original petition when the City went before the Boundary Review Board, and that the legal description in the proposed ordinance takes these two exceptions into account. He pointed out that if the ordinance is adopted tonight, the annexa- tion will take effect on January 1, 1996 . Mayor Pro Tem Woods opened the public hearing. Hans Friewald, 11824 SE 270th, said the people in his area are against this annexation, and that it 2 August 15, 1995 ANNEXATION is illegal because the taxpayers were not allowed to vote on the issue. Brubaker explained that under State law, the two methods of annexation are by petition or by election. He explained that this annexation was proposed and processed by the petition method, and that the City received well over the required 60% of the assessed valuation of the area, resulting in $25, 000, 000 in excess valuation over the re- quirement. Friewald said he would like to see the paperwork indicating who is in favor of the annexation, since most people in his area are against it. Patricia Tisdale, resident of the Lake Meridian Apartments, spoke in opposition to the annexation and to the way it was done. She felt people should have been able to vote on it. Carol Voss, 14610 SE 266 Street, said she had gathered signatures on the petition and that it was a legal petition. She said they explained the petition to people and they knew what they were signing. She noted that in one area, 71. 89% of the homeowners were in favor of annexation. Tom Brotherton, 26805 148th Avenue SE, said his neighbors prefer to be in Kent rather than Covington. He noted that over 400 people at- tended the Boundary Review Board hearing, most of whom favored this annexation. Floyd Eiford, 11909 SE 248th, expressed concern about the amount of truck traffic on 248th, asked about the boundary at 240th and 132nd, and about sewers and street improvements. McFall noted that the area west of 240th and 132nd was not included in the original petition, and that areas west of 132nd with substantial no-protest annexation covenants and areas where petitioners gathered signatures framed the boundaries. He explained that the Boundary Review Board takes into consideration whether the proposed annexation area creates irregular boundaries, and they found that the proposed boundaries do not do so. McFall explained no-protest annexation covenants and noted that they are the same as signatures on an annexation petition. Wickstrom was surprised to hear of heavy truck traffic on 248th since it terminates into the country club. He said that sewer service east of 120th is handled by Soos Creek Sewers . Elsie Trotloff, 27657 145th Avenue SE, asked that Meridian Estates, Taylor Glen and Glenbrook be excluded from the annexation. She noted that 203 signatures had been turned in before the last Boundary Review Board meeting on 3 August 15, 1995 ANNEXATION a petition with the Covington information. She said they receive good service from the County on streets and don't want to pay for an LID in the City of Kent. She said that Kent estimates the tax revenue would fall short by $80, 000 of the anticipated expense and questioned why pins were given to petitioners by the Mayor. She then read a portion of a letter regarding direct mail, and asked that the area from 132nd Avenue SE to Highway 18 , 288th and 272nd be eliminated from the annexation. She felt a vote should have been taken. Edward J. Pawlowski, 27727 106th Avenue SE, spoke against the annexation, and said that neither he nor his neighbors were approached about the issue. He questioned the boundary, asked why Meridian Valley residents were not brought in, and presented a petition requesting to be excluded. Cass Brotherton, 26805 148th Avenue SE, said that this started because of Covington' s efforts to incorporate. She said the residents of her area did not associate with Covington and found great support to annex to Kent. She noted that the petition mentioned by Ms. Trotloff asks if people want an election, and does not state how they would vote, and that some of those who signed may want to be a part of Kent. She also noted that there are signatures spread throughout the entire annexation area. She explained that when col- lecting signatures on the petition, it was easier to contact people in denser areas, but that packets were mailed to everyone. She said that Meridian Valley was not included in the annexa- tion because thdy were eliminated from the Covington incorporation, and therefore did not have the tame issues. She noted that the Growth Management Act requires that urban areas become part of a city by a certain date. Nadine Eiford, 11909 SE 248 , asked what will happen to their animals after the annexation, and Brubaker ex- plained that the Planning Department will hold public hearings on zoning of the area. He stated that he believes the City has zoning designations that allow for the type of use Eiford is con- cerned about, that there will be opportunities to address those concerns, and that she can expect that the current use will be protected and zoned appropriately. Orr pointed out that she lives in an area which was annexed several years ago, and that people were still allowed to have their 4 August 15, 1995 ANNEXATION animals after the annexation. She said it is the intent of the Council not to disrupt anyone' s way of life. Alice Matz , 17200 SE 265, noted that she worked on the petition to incorporate Covington and that they got over 300 names in the area where Elsie Trotloff lives saying they would rather be in Covington than Kent. She expressed concern about the Fire Department and noted that residents of Meridian Valley use the fire station and library in Covington. She suggested that the boundary go down Kent-Kangley and that the fire station be left in Covington. She disagreed with the no-protest agreements, felt people should have had the opportunity to vote, and said the petition method was used because the city would have lost an election. Brubaker pointed out to the Council that if the boundaries are changed tonight, the redefined area must be resubmitted to the Boundary Review Board. He displayed a map showing areas repre- senting properties whose owners signed the annexation petition. He also noted that the Boundary Review Board found overwhelming support at their hearing from people stating they were much more a part of the Kent community than Covington. He pointed out that during the four- month period that the petition was circulated, anyone who signed the petition had the right to withdraw their signature and that no one did. Hans Friewald expressed concern about environ- mental issues which have taken place over the years in Kent, and about new regulations which may come up. Upon a question from Patricia Tisdale, Woods explained that the Police Department budget will be increased and that sixteen officers will be added. Elsie Trotloff asked why two friends of Mr. White were not eliminated from the Boundary Review. Board for this annexation, and why King County Council- member Vance sent someone, since they had voted to be neutral, but were for Kent. Woods suggested calling Mr. Vance and the Boundary Review Board, and Brubaker pointed out that the Boundary Review Board approved the annexation unanimously and that if there had been an issue about even two of the votes, there would still be a majority vote. He also -noted for Johnson that it is his belief that the Governor appoints the members of the Boundary Review Board. Alice Matz 5 August 15, 1995 ANNEXATION said that the vote at the Boundary Review Board meeting on the loth was not unanimous because two people sustained. There were no further comments and ORR MOVED to close the public hearing. Johnson seconded and the motion carried. ORR MOVED to adopt Ordinance No. 3241 annexing the Meridian Annexation area, as described in the packet this evening, which establishes an effective date of January 1, 1996 . Houser seconded. Johnson pointed out that there will always be people in any area who want to be excluded from annexation, and that State law prohibits the creation of islands. He also noted that the urban growth boundary has been established, and the law states that those areas will be annexed by existing cities or that new cities will be formed. He stated that the City of Kent is committed to the environment, and is one of only two cities that has land zoned agriculture and has land in the Farm Preservation Program. He said the City has been aggressive in purchasing land for open space, parks and recreation and so forth. He noted that the City and Fire District 37 have had a good working arrangement for many years, and that it will continue. He said greater public safety will be provided in the annexation area than currently exists in terms of police protection and urged the Council to pro- ceed with the annexation. Fire Chief Angelo agreed with Johnson that there has always been a strong relationship between the City and Fire District 37 , and said that the quality level of service will continue. He noted that there are no plans to change the apparatus or personnel. Orr concurred with Johnson and said that when her area was being annexed, they found a Council that was responsive and concerned about their wishes . She said the Council still listens, and encour- aged citizens to stay involved as the city goes through zoning determinations and to provide in- put so that the Council is aware of their wishes . She noted that signing the petition was the same as voting, and that this annexation represents the majority. 6 August 15, 1995 ANNEXATION There were no further comments from Council and ORR MOVED to enter Mr. Pawlowski' s note into the public record. Houser seconded and the motion carried. Orris motion to adopt Ordinance No. 3241 then carried unanimously. PARKS & (CONSENT CALENDAR - ITEM 3C) RECREATION Rewiring of Resource Center. APPROVAL to allo- cate $50, 000 from the City CIP fund to provide necessary repairs at the Resource Center. There is a need to rewire the Resource Center to im- prove the electrical, telephone and data elements at the facility. The need is immediate as the facility has experienced some electrical problems recently. FINANCE (CONSENT CALENDAR - ITEM 3B) Approval of Bills. APPROVAL of payment of the bills received through July 31 and paid on July 31, 1995 . The Operations Committee for August 9 , 1995 was cancelled. Councilmembers authorized payment by signing check summary. Clark noted that at the last COMMUNICATIONS Council meeting he had spoken about. Initiative 164 . He pointed out that this issue will soon come before the voters and asked that, in an effort to present a balanced view, the Mayor sponsor the taping of a debate on the issue. He said that King County Assessor Scott Noble would be willing to speak about the history and the impact of Initiative 164 , and suggested that 47th District Representative Jack Cairnes or King County Councilmember Chris Vance speak on the other side of the issue. He said he would also like to have a discussion by a group representing 7 August 15, 1995 CONTINUED the City, including Law, Public Works, and COMMUNICATIONS Planning, regarding potential impacts to the City of Kent. McFall said such a video could be prepared for broadcast on cable tv before the election, but that Public Disclosure Commission regulations must be met. There were no objec- tions to Clark' s request, and Bennett noted that in the future others may have similar requests. REPORTS Operations Committee. Johnson noted that the Committee will meet at 9 : 30 a.m. on August 23rd. Planning Committee. Orr noted that a special meeting of the committee will be held at 4 : 00 p.m. on September 5th. Administrative Reports. McFall reminded Council of an executive session on pending litigation and noted that potential property acquisition has been added to the executive session. CITY COUNCIL ACTION: Councilmember moves, Councilmember seconds DISCUSSION: ACTION: Council Agenda Item No. 3D PUBLIC WORKS COMMITTEE AUGUST 14,1995 PRESENT: PAUL MANN GARY GILL TIM CLARK STAN WADE DON WICKSTROM KRIS LANGLEY TOM BRUBAKER ABSENT: JIM BENNETT 212TH STREET HOV - AGREEMENT Wickstrom stated that this is an accounting issue in that we have received a Grant for approximately $3 Million dollars and we need to formally establish a budget for this so that the money can be receipted. Committee unanimously recommended authorization to accept the Grant in the amount of $3,495,493 for the South 212th HOV Lane project and establish a budget for same. SIX YEAR TRANSPORTATION IMPROVEMENT PROGRAM Wickstrom explained that this is a yearly event; actually we are behind schedule at this time. This was to have been done by the first part of July. Wickstrom referenced the 6 Yr Plan in the agenda packet and said that there is nothing new in this plan; the Council has already seen the Traffic Improvement Plan associated with the Growth Management Act. He said we need to go back and add the ISTEA Grant for the bus shuttle system of approximately $400,000. Committee unanimously recommended setting September 5th as the Public Hearing date for the Six Year Transportation Program and adoption of same. LID 330 SEGREGATION - ASSESSMENT #6 r Tn 327 SEGREGATION - ASSESSMENT #45 Wickstrom stated that these segregations are related to Van Doren's Landing and this is merely an additional segregation so that properties can be sold. Committee unanimously recommended adoption of Resolution # for the segregation of Assessment #6 in LID #330. 1 Committee unanimously recommended adoption of Resolution # for the segregation of Assessment #45 in LID #327. ADDITIONAL ITEM: (TIM CLARK) 2 12TH STREET HOV LANE - TRAFFIC PROBLEM Clark noted that the channelization of the traffic during the construction on S. 212th is a very irregular pattern in terms of the flow. Clark said that all of the trucks were attempting to make left hand turns thru the greater density of traffic. In so doing, they created a number of problems. He asked if there is a more efficient way to handle the traffic flow; also, is it possible to indicate "no left turns" during certain time periods? Stan Wade, Construction Engineer stated that we have recognized the problems; we have consulted our traffic staff and the contractor and between everyone, we came up with the present traffic plan. Wade explained the project to the Committee, noting that we are on schedule; he stated that as far as the trucks making left hand turns they are moving with the signals at the intersections. Clark stated that part of the problem is that the trucks are turning into the businesses and not going to the intersections. Wade said we can't keep them out of going into their businesses. Clark stated that the traffic is also backing up at the railroad tracks and asked if there is something further we can do there. Wickstrom said we will look into the situation again. CITIZEN COMPLAINT REGARDING SIGNAL TIMING (PAUL MANNl Mann referenced a letter of complaint to the editor regarding the timing of our traffic signals. Kris Langley explained how the timing of the signals are set to maximize the number of cars thru any given intersection. Verbal approval to award was given May 17, 1995. Based on the low contract bid and availability of funds, this letter is a written confirmation of approval to award. Your request for an increase in Urban Arterial Trust Account (UATA) funds is approved in the amount of $5,413. The total amount of UATA funds now authorized for participation in this project is $3,495,493. In accordance with Urban Arterial Program Guidelines, an Updated Cost Estimate (TIB Form 190-015) is again required upon completion of the contract but prior to final settlement with the Transportation Improvement Board. Committee unanimously recommended authorization to accept the Grant in the amount of $3,495,493 for the South 212th HOV Lane project and establish a budget for same. SIX YEAR TRANSPORTATION IMPROV M NT PRO RAM �y Wickstrom explained that this is a yearly event; actually we are behind schedule at this time. This was to have been done by the first part of July. Wickstrom referenced the 6 Yr Plan in the agenda packet and said that there is nothing new in this plan; the Council has already seen the Traffic Improvement Plan associated with the Growth Management Act. He said we need to go back and add the ISTEA Grant for the bus shuttle system of approximately $400,000. Committee unanimously recommended setting September 5th as the Public Hearing date for the Six Year Transportation Program and adoption of same. LID 330 SEGREGATION - ASSESSMENT #6 I_ID 327 SEOREQATION - ASSESSMENT #45 Wickstrom stated that these segregations are related to Van Doren's Landing and this is merely an additional segregation so that properties can be sold. Committee unanimously recommended adoption of Resolution # for the segregation of Assessment #6 in LID #330. 1 Committee unanimously recommended adoption of Resolution # for the segregation of Assessment #45 in LID #327. ADDITIONAL ITEM: (TIM CLARK) 212TH STREET HOV LANE - TRAFFIC PROBLEM Clark noted that the channelization of the traffic during the construction on S. 212th is a very irregular pattern in terms of the flow. Clark said that all of the trucks were attempting to make left hand turns thru the greater density of traffic. In so doing, they created a number of problems. He asked if there is a more efficient way to handle the traffic flow; also, is it possible to indicate "no left turns" during certain time periods? Stan Wade, Construction Engineer stated that we have recognized the problems; we have consulted our traffic staff and the contractor and between everyone, we came up with the present traffic plan. Wade explained the project to the Committee, noting that we are on schedule; he stated that as far as the trucks making left hand turns they are moving with the signals at the intersections. Clark stated that part of the problem is that the trucks are turning into the businesses and not going to the intersections. Wade said we can't keep them out of going into their businesses. Clark stated that the traffic is also backing up at the railroad tracks and asked if there is something further we can do there. Wickstrom said we will look into the situation again. CITIZEN COMPLAINT REGARDING SIGNAL TIMIN (PAUT MANNI Mann referenced a letter of complaint to the editor regarding the timing of our traffic signals. Kris Langley explained how the timing of the signals are set to maximize the number of cars thru any given intersection. While we're running behind schedule (July is the required time-frame) this year's program is based on the Capital Facilities Plan adopted last year as part of Kent's Comprehensive Plan. In order to be consistent with GMA, this current draft must go through the same process and meet the same criteria as last year's program which we have done. CITY COUNCIL ACTION: Councilmember moves, Councilmember seconds DISCUSSION: ACTION: Council Agenda Item No. 3F PUBLIC WORKS COMMITTEE AUGUST 14,1995 PRESENT: PAUL MANN GARY GILL TIM CLARK STAN WADE DON WICKSTROM KRIS LANGLEY TOM BRUBAKER ABSENT: JIM BENNETT 212TH STREET HOV - AGREEMENT Wickstrom stated that this is an accounting issue in that we have received a Grant for approximately $3 Million dollars and we need to formally establish a budget for this so that the money can be receipted. Committee unanimously recommended authorization to accept the Grant in the amount of $3,495,493 for the South 212th HOV Lane project and establish a budget for same. SIX YEAR TRANSPORTATION IMPROVEMENT PROGRAM Wickstrom explained that this is a yearly event; actually we are behind schedule at this time. This was to have been done by the first part of July. Wickstrom referenced the 6 Yr Plan in the agenda packet and said that there is nothing new in this plan; the Council has already seen the Traffic Improvement Plan associated with the Growth Management Act. He said we need to go back and add the ISTEA Grant for the bus shuttle system of approximately $400,000. Committee unanimously recommended setting September 5th as the Public Hearing date for the Six Year Transportation Program and adoption of same. LID 330 SEGREGATION - ASSESSMENT #6 LID 327 SEGREGATION - ASSESSMENT #45 Wickstrom stated that these segregations are related to Van Doren's Landing and this is merely an additional segregation so that properties can be sold. Committee unanimously recommended adoption of Resolution # for the segregation of Assessment #6 in LID #330. 1 Committee unanimously recommended adoption of Resolution # for the segregation of Assessment #45 in LID #327. ADDITIONAL ITEM: (TIM CLARK) 2 12TH STREET HOV LANE - TRAFFIC PROBLEM Clark noted that the channelization of the traffic during the construction on S. 212th is a very irregular pattern in terms of the flow. Clark said that all of the tricks were attempting to make left hand turns thru the greater density of traffic. In so doing, they created a number of problems. He asked if there is a more efficient way to handle the traffic flow; also, is it possible to indicate "no left turns" during certain time periods? Stan Wade, Construction Engineer stated that we have recognized the problems; we have consulted our traffic staff and the contractor and between everyone, we came up with the present traffic plan. Wade explained the project to the Committee, noting that we are on schedule; he stated that as far as the trucks making left hand turns they are moving with the signals at the intersections. Clark stated that part of the problem is that the trucks are turning into the businesses and not going to the intersections. Wade said we can't keep them out of going into their businesses. Clark stated that the traffic is also backing up at the railroad tracks and asked if there is something further we can do there. Wickstrom said we will look into the situation again. CITIZEN COMPLAINT REGARDING SIGNAL TIMING (PAUL MAN1\Il Mann referenced a letter of complaint to the editor regarding the timing of our traffic signals. Kris Langley explained how the timing of the signals are set to maximize the number of cars thru any given intersection. A RESOLUTION of the City Council of the City of Kent, Washington, directing the Finance Director to segregate assessment number 45 levied under L.I.D. 327. WHEREAS, on May 2, 1989, the City established assessment number 45 of Local Improvement District 327 ("LID 327") in the amount of$226,202.57; and WHEREAS, Birtcher Frank Properties, the owner of record of the property affected by assessment number 45, previously requested and obtained segregations of portions of the property subject to assessment number 45, creating thereby a revised assessment number 45 together with new assessment numbers 45-1 through 45-11; and WHEREAS, Birtcher Frank Properties has requested segregation of an additional parcel from the property subject to assessment number 45, which shall be designated assessment number 45-12, and which property is described in the LID segregation application certificate filed by Birtcher Frank Properties, attached hereto as Exhibit A; and WHEREAS, the application is in all respects proper; NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES HEREBY RESOLVE AS FOLLOWS: 1 Section 1. The original tract of assessment number 45 of LID 327, which is legally described in the LID segregation application certificate filed by Birtcher Frank Properties, attached hereto as Exhibit A and incorporated herein by this reference (indicated as "Exhibit A" on the application certificate), shall have one parcel segregated from the assessment tract, in accordance with the application of Birtcher Frank Properties. Section 2. The legal description of the segregated parcel is described in the attached LID segregation application certificates filed by Birtcher Frank Properties (indicated as "Exhibit B" on the application certificate). Section 3. The legal description of the remainder of the tract of assessment number 45 is described in the attached LID segregation application certificates filed by Birtcher Frank Properties (indicated as "Exhibit C" on the application certificate). Section 4. The new assessment amount for the newly segregated tract that will be subject to assessment 45-12 shall be $11, 276.92; the new assessment amount for the remainder of the property originally subject to assessment number 45 shall be equal to the amount remaining due under the original assessment number 45 less the assessment amounts now attributed to the tracts subject to the newly and previously formed assessment numbers 45-1 through 45-12. Section 5. The City Clerk shall deliver a certified copy of this resolution to the Finance Director who shall proceed with the segregation upon being tendered a fee of ten dollars for each tract of land for which segregation is to be made together with payment to the City for its reasonable engineering and clerical costs, as determined by the City's Public Works Department, that were incurred in making this segregation. Section 6. Committee unanimously recommended authorization to accept the Grant in the amount of $3,495,493 for the South 212th HOV Lane project and establish a budget for same. SIX YEAR TRANSPORTATION IMPROVEMENT PROGRAM Wickstrom explained that this is a yearly event; actually we are behind schedule at this time. This was to have been done by the first part of July. Wickstrom referenced the 6 Yr Plan in the agenda packet and said that there is nothing new in this plan; the Council has already seen the Traffic Improvement Plan associated with the Growth Management Act. He said we need to go back and add the ISTEA Grant for the bus shuttle system of approximately $400,000. Committee unanimously recommended setting September 5th as the Public Hearing date for the Six Year Transportation Program and adoption of same. I� LID 330 SEGREGATION - ASSESSMENT #6 L� LID 327 SEGREGATION - ASSESSMENT #45 Wickstrom stated that these segregations are related to Van Doren's Landing and this is merely an additional segregation so that properties can be sold. Committee unanimously recommended adoption of Resolution # for the segregation of Assessment #6 in LID #330. l Committee unanimously recommended adoption of Resolution # for the segregation of Assessment #45 in LID #327. ADDITIONAL ITEM: (TIM CLARK) 212TH STREET HOY LANE - TRAFFIC PROBLEM Clark noted that the channelization of the traffic during the construction on S. 212th is a very irregular pattern in terms of the flow. Clark said that all of the tricks were attempting to make left hand turns thru the greater density of traffic. In so doing, they created a number of problems. He asked if there is a more efficient way to handle the traffic flow; also, is it possible to indicate "no left turns" during certain time periods? Stan Wade, Construction Engineer stated that we have recognized the problems; we have consulted our traffic staff and the contractor and between everyone, we came up with the present traffic plan. Wade explained the project to the Committee, noting that we are on schedule; he stated that as far as the trucks making left hand turns they are moving with the signals at the intersections. Clark stated that part of the problem is that the trucks are turning into the businesses and not going to the intersections. Wade said we can't keep them out of going into their businesses. Clark stated that the traffic is also backing up at the railroad tracks and asked if there is something further we can do there. Wickstrom said we will look into the situation again. CITIZEN COMPLAINT REGARDING SIGNAL TIMING TAUL MANN) Mann referenced a letter of complaint to the editor regarding the timing of our traffic signals. Kris Langley explained how the timing of the signals are set to maximize the number of cars thru any given intersection. WHEREAS, on May 15, 1990, the City established assessment number 6 of Local Improvement District 330 ("LID 330") in the amount of$869,339.42; WHEREAS, Birtcher Frank Properties, the owner of record of the property affected by assessment number 6, previously requested and obtained segregations of portions of the property subject to assessment number 6, creating thereby a revised assessment number 6 together with new assessment numbers 6-1 through 6-11; and WHEREAS, Birtcher Frank Properties has requested segregation of an additional parcel from the property subject to assessment number 6, which shall be designated assessment number 6-12, and which property is described in the LID segregation application certificate filed by Birtcher Frank Properties, attached hereto as Exhibit A; and WHEREAS, the application is in all respects proper;NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES HEREBY RESOLVE AS FOLLOWS: Section 1. We have received updated information that the program has been eliminated for the 1996 program year. There will be no funds to help households who need energy assistance this coming winter season and for our most vulnerable citizens this will create a severe hardship. The center's LIHEAP program has seen a substantial increase of eligible low-income families in this county who are in need of energy assistance and it is imperative that you contact congressional members as soon as possible. In 1995 we served 4415 households in South King County and of these households, 839 were Kent residents. Unfortunately this represents only 28%of eligible households in need of this program. For low-income families,the working poor who are at 125%and below of poverty,keeping the heat on during the winter months is a real challenge and they often resort to potentially life threatening alternatives in an effort to save energy. The LIHEAP program is critical for thousands of low-income families in this state who are still facing an energy crisis. Without federal funding,this crisis will fall on our local cities and counties who are not equipped financially to assume this burden. Listed below are LUELAP program bullets to help you in writing letters to congressional members: • Adequate home heat is a necessary aspect of shelter and the lack of home heating poses a threat to health,safety. and lives of low-income families. • Mare than 60%of those receiving assistance live on annual income of less than$6000 annually,and the percentage of income low-income households spend on residential energy is about 11%to 14%of their total income. RESOURCE CENTER RE-WIRE: John Hodgson told Councilmembers that this subject could go to Operations Committee, but their next meeting had been canceled. Councilmember Orr, in concurrence with Jon Johnson, told John to send this item to Parks Committee and they will approve it if the Parks Committee does. The Resource Center has a wiring problem because the system is fairly old and needs to be re- done. They have had computer problems and an electrical outage. The amount requested for repairs in the 1996 CIP budget is $50,000. According to May Miller, the Finance Director, the money is available in this year's budget. Two repairs are needed right away. If not the full amount, at least $35,000 for the electrical re-wire, telephone and data re-wire, which is needed now. These electrical problems have had a significant impact on staff. Charley Lindsey and John Hillman were available for questions. Councilmember Mann had no questions and concurred, Chair Houser seconded. The motion was passed 2-0. MASK THEATRE FACILITY USE: Jim Bennett arrived. John reported that two City Council meetings ago, MASK Theatre gave a presentation of request to consider Kent Commons as their permanent home, scheduling all performances annually, at a reduced Recreation rental rate. Three Parks staff members met with MASK. Representatives of MASK were present. The request is to perform at Kent Commons under the umbrella of the Parks and Recreation Department. MASK requires a permanent home for audience appeal, to pursue long term grants, and to secure plays. They currently utilize Kent Commons, Senior Center, and Resource Center. The two latter are not acoustically set up for performances. Most theatre companies request permission to use for, plays six months in advance. There is precedent; the Carco Theatre runs through the City of Renton for the Valley Players and Burien Little Theatre runs through the City of Burien at the Highline Performing Arts; they receive favorable rental rates. MASK is asking for 3 weekends in a row, 3 times a year. They also require 1-2 hours a night the week prior. Lori Hogan gave a historical background on the City's relationship with MASK. In the fall of 1992 the Arts Commission and the Parks Department came together and MASK began. There are a variety of ways the department supports MASK. (1) Through a re-grant process of Page 1 Parks Committee Meeting Minutes August 8, 1995 the Arts Commission for the past three years they have received an annual grant that has progressively increased. They are the highest award winner of nine. (2) They are currently are at the assessed internal rate which is $16 per hour. (3) Responsibilities that other renters would be expected to perform are waived. (4) They are given the opportunity to have fund raisers at summer concerts and Winterfest at no charge. (5) They have publicity in City brochures, event calendars and newsletters. FINANCIAL IMPACT Performance dates were provided. The 18 performance dates requested by MASK annually nets $1,440, compared to the Commons being rented at 100% capacity which nets $9,000. Lori continued to say that the week prior to MASK's performances technical time to prepare is require;, this is a challenge due to the fact that their performance site is typically held for classes during the week. Weekly Commons staff is asked to provide reduced or free rates. The staff tries to remain impartial in their procedures. Lori suggested the following options: 1. Allow MASK to reserve one series of performance dates at the Commons, Senior Center and Resource Center. Rental would be assessed at the Recreation rate. 2. Allow MASK to reserve one series of performance dates at the Commons and one series of dates at the Senior Center at the Recreation rental rate. MASK would be responsible for finding a third performance site. 3. Approve MASK's proposal to consider the Commons their permanent home, -- scheduling all performances on an annual basis, at a reduced Recreation rental rate. 4. Require MASK to follow the same rental procedure as all other rental groups. Fees would be assessed according to established fee schedules. In all options, dates would be reserved annually on a space available basis. Parks and Recreation class dates will not be altered to accommodate rehearsal time. John expressed concern about the possibility of other groups requesting the same thing. Chair Houser requested clarification regarding the difference of what MASK pays and the public pays. Lori explained that there are not usually classes on Friday and Saturday night since they are prime rental nights for the public. The usual charge for the time allocations of 10 hours is $500. John explained that the fee that MASK receives is equivalent to what the department assesses itself. In essence MASK is one of the programs. MASK spokesperson Greg Oberst, a trustee with the board, came forward to say only one of the options are viable for them and that is to allow them to have all their shows at the Commons at the recreation rate. The other options would force them to make changes; dissolving or moving. Page 2 Parks Committee Meeting Minutes August 8, 1995 They must have one location to operate like a professional theatre company. Chair Houser asked if MASK had been working with the Performing Arts Center, adding that Kent doesn't have a theatre. Greg said that was a community problem, Commons is as close as Kent has. They are wanting to salvage the 1995-1996 season. Councilmember Mann asked about the quality of the plays. If we endorse MASK, is there any way we can have a say in the plays that are presented. Greg said they are sensitive to the community. JoAnn Wesson said they do not wish to offend, but attract the community. Initially the group hoped to put on a children's theatre piece, classical piece and comedy. She summarized the plays that they have offered. A problem with children's theatre is you need a matinee. They choose plays depending on acceptability, content, availability and production values. Councilmembers expressed concern about other groups requesting these privileges. John suggested establishing a third rental rate. Chair Houser said under the umbrella everything would have to be okayed through John. John said there would have to be an advisory capacity. Lori shared that the Arts Commission doesn't pre-approve performances, but values their selections. If there is deviation, it is up to the Arts Commission to continue future funding or not. John mentioned again we would have to put some monitoring mechanism in place. Chair Houser inquired about legalities. Tom said there could be a problem with "gift of public funds." The City is prohibited to give money outside the City unless they are needy or poor. The reduced rate is a defacto gift of$34 per hour. There may also need to be control over content, with certain conditions. Bennett said he understands the concern of revenue, but a community theatre affects the quality of life. Maybe we're over charging the other folks. He wants to support the theatre. Let them prove their accountability; it takes certain type of building to accommodate their needs. For continuity, it would be better to be held at one place. Chairperson Mann asked Tom to look into the "gift of public funds" issue. Tom said he could and suggests that Council needs to decide if it wants to sponsor a theatre company, provide a permanent home, and set conditions like a contract. Council would be taking MASK under their wing more. JoAnn stated MASK has been under their umbrella from the beginning, and has been blessed with the discount rate. They do not have the technical expertise to relocate and brought their plight to Council. Councilmember Bennett asked Tom to write a one year agreement with standards and suggested Councilmembers attend some of the plays; Tom consented. Chair Houser suggested MASK increase their revenue to pay the $500. She agrees that we should give them one year. Lori asked if that should be a goal expressed in the contract. John wants to avoid precedence setting. John would like to see added financial accountability, and have a contract by the next meeting. JoAnn is hoping to get Steel Magnolia for the October performance; they want recognizable titles. Chair Houser suggested monetary goals could be increased in increments. JoAnn said they have the lowest ticket price in the area. John says the show will go on, even if MASK only gets close to their goal. Page 3 Parks Committee Meeting Minutes August 8, 1995 Tom will put together an agreement to include financial incremental rent for the next year with the ability for the Parks Department to approve and check on "gift of public funds." A meeting with MASK will be scheduled to discuss a contract. Starting with a trial basis for a year avoids precedence setting. Houser says it should have gone to mayor's office. Tom clarified that it is still subject to final approval of Kent City Council. PROGRAM/PROJECT UPDATES: Glenn Nelson Tennis Court: resurfaced and we already have impact from rollerbladers. Skateboard Committee: The committee continues to meet to prepare to address the Council. John visited a nice Skateboard/Rollerblade Park in Moses Lake. Titus Park will be ready to dedicate in a couple of weeks. Midway Reservoir: Still waiting for paperwork on the Midway Reservoir. Helen shared a concern about The City of Seattle not wanting to sell. Miniature Golf Course: It has made as much money as last year already. Golf Landscaping promises to be done so synthetic turf can be put out this weekend. They start paying fines after Friday of$550 per day. Youth/Teen Prooram: The Lighthouse program is down for three weeks because school is getting ready to begin. Youth Employment Program: The Press will be out with a story tomorrow. Congress is in the process of eliminating the Youth Employment Program; It barely passed this year. John will write a letter to our local representatives for signatures. There are 22 youths making money and fixing our parks. Councilmembers consented to giving their signatures. The youth have done two miles of trails and some rehab along the Green River. Staff applied for grant for$23,000 that will allow the City to continue employing 21 teens. Teen Leadership Camp: Camp is full, parents and teens like it. Special Olympics: It is this weekend. John invited Councilmembers. Canterbury Faire: The Faire is next weekend. BALL Lin Ball, Human Services Manager, introduced guest speakers Dini Duclos and Dave Daniels, of the South King County Housing Forum. She said the forum was given support last April by the City Council to explore a mechanism to address affordable housing for south King County. Ms . Ball said the purpose of today' s visit is to present information on an upcoming workshop to be held in August . Dave Daniels, Chair of the South King County Housing Forum, distributed an informational flyer detailing the conference scheduled for Wednesday, August 23 , 1995, at Federal Way' s Visitation Center, from 5 : 00 to 8 : 00 p .m. He said the workshop is intended to unite the efforts of the south King County cities to achieve affordable housing by creating a regional planning network. Mr. Daniels said the purpose of today' s visit is to ask the City of Kent to join the other south King County cities participating in the program. Discussions continued regarding the projected demand for low to moderate income housing, assessment of current affordable housing stock, and possible funding . incentives to promote well-managed, safe, affordable housing. Dini Duclos, Executive Director of the South King County Multi- Service Center stressed the importance of Kent, Federal Way, Auburn sharing their housing issues, to work together for viable solutions and form the leadership to achieve affordable housing throughout south King County. Laurie Evezich answered Chair Orr' s question regarding the legal ramifications of requiring landlords to set aside a portion of CITY COUNCIL PLANNING COMMITTEE MINUTES JULY 18 , 1995 PAGE 2 newly remodeled housing units for low income housing. She said besides for the acceptance of Section 8 certificates, she didn' t think the City could enact such a policy. Discussions followed pertaining to affordable housing development, possible incentives through State programs to encourage future affordable development . Ms . Ball said the questions and comments of today are typical of the input that would be beneficial at the workshop . Chair Orr asked the guests what they would like to see the City of Kent do to support the conference. Mr. Daniels said they would like to see a resolution supporting the conference as well as participation by elected officials . Chair Orr said she would alert the Council of the workshop tonight, but present the resolution at the August 1st full meeting of the City Council . Council member Clark MOVED to draft a resolution supporting the South King County cities in a Housing Workshop on August 23 , 1995 at Federal Way' s Visitation Center from 5 : 00 to 8 : 00 P.M. Council member Johnson SECONDED the motion. There was no further discussion and the motion CARRIED. INTERLOCAL AGREEMENT BETWEEN KENT AND AUBURN - J. HARRIS Jim Harris, Planning Director, said this agreement is similar to other interlocal agreements, which sets the joint Potential Annexation Area (PAA) boundaries of adjacent cities . He outlined the joint proposed PAA boundary changes.as .submitted by the City of Auburn, and said the last agreement was in 1969 between the Cities of Kent and Auburn which defined the PAA boundary at 272nd street . He referred to a map contained in the agreement which detailed the exact boundary. He said also included within the agreement is the process necessary and responsibilities of the Cities if changes are to be made to the PAA boundary. Mr. Harris said the Law Department has not yet fully reviewed the document , although Ms . Evezich discovered one minor omission, and that possible changes would need to be made . Council member Johnson MOVED to recommend approval of the Interlocal Agreement between Kent and Auburn, with a caveat by the Law Department . Council member Clark SECONDED the motion. There was no furtherdiscussion and the motion CARRIED. ADDED AGENDA ITEMS Mr. Lubovich gave an update on the requested environmental review for the Saturday Market location. He said ground water testing is scheduled because of the industrial uses east of the market location the City intends to purchase . Linda Johnson of the Kent CITY COUNCIL PLANNING COMMITTEE MINUTES JULY 18 , 1995 PAGE 3 Downtown Partnership added that test results of surrounding sites have passed the inspection when last tested 3 years ago, and that she can supply the City copies of the results . She added that Sir Speedy and Jack in the Box had tests performed about a year ago, and no contamination was indicated. The last page of a faxed summary was distributed. Mr. Lubovich said no action from the Planning Committee was required, and that this matter will be discussed at the City Council meeting tonight . Council member Clark asked Mr. Lubovich if there is a resolution on Referendum 48, which he responded was in the packet . When asked if the issue should be discussed now, Mr. Harris interjected that it was not necessary as the emergency ordinance will be discussed at the City Council Workshop tonight . Fred Satterstrom gave an update on Growth Management . He said an appeal has been initiated by Thomas Bigford (in behalf of Jerry Marcy) on the Kent Comprehensive Plan, and gave background information concerning the appeal . He said a pre-hearing conference is scheduled for August 2, 1995 at the Growth Hearings Board. Discussions continued regarding the reason for the appeal and the City' s plan to address the appeal, including taking the issue to the Superior Court . Ms . Evezich reported on the progress concerning school impact fees . She said her contact, Mr. Fred High of the Kent School District has been on vacation, but they plan to meet shortly after his return on July 19 . She said an ordinance is being drafted, but wants to consider the results of Initiative 164 before taking the ordinance to Committee . Mr. Satterstrom added that the Planning Commission has made some recommendations that will be coming to the City Council on Accessory Housing, Development Standards for Single Family. He said a hearing is scheduled for next Monday, July 24, on East Hill Zoning Amendments, to bring the zoning into conformance with the Comprehensive Plan Land Use Map, and to expect these issues in the fall . He discussed a few of the general zoning changes, and when asked by Chair Orr what time frame was required by the Council for this issue to be heard, Mr. Satterstrom said this was required to be reviewed by the State first, which could take up to sixty days . The Planning Committee adjourned at 5 : 00 p.m. PUBLIC WORKS COMMITTEE AUGUST 14,1995 PRESENT: PAUL MANN GARY GILL TIM CLARK STAN WADE DON WICKSTROM KRIS LANGLEY TOM BRUBAKER ABSENT: JIM BENNETT 212TH STREET HOV - AGREEMENT Wickstrom stated that this is an accounting issue in that we have received a Grant for approximately $3 Million dollars and we need to formally establish a budget for this so that the money can be receipted. Committee unanimously recommended authorization to accept the Grant in the amount of $3,495,493 for the South 212th HOV Lane project and establish a budget for same. SIX YEAR TRANSPORTATION IMPROVEMENT PROGRAM Wickstrom explained that this is a yearly event; actually we are behind schedule at this time. This was to have been done by the first part of July. Wickstrom referenced the 6 Yr Plan in the agenda packet and said that there is nothing new in this plan; the Council has already seen the Traffic Improvement Plan associated with the Growth Management Act. He said we need to go back and add the ISTEA Grant for the bus shuttle system of approximately $400,000. Committee unanimously recommended setting September 5th as the Public Hearing date for the Six Year Transportation Program and adoption of same. LID 330 SEGREGATION - ASSESSMENT #6 LID 327 SEGREGATION - ASSESSMENT #45 Wickstrom stated that these segregations are related to Van Doren's Landing and this is merely an additional segregation so that properties can be sold. Committee unanimously recommended adoption of Resolution # for the segregation of Assessment #6 in LID #330. 1 Committee unanimously recommended adoption of Resolution # for the segregation of Assessment #45 in LID #327. ADDITIONAL ITEM: (TIM CLARK) 212TH STREET HOY LANE - TRAFFIC PROBLEM Clark noted that the channelization of the traffic during the construction on S. 212th is a very irregular pattern in terms of the flow. Clark said that all of the trucks were attempting to make left hand turns thru the greater density of traffic. In so doing, they created a number of problems. He asked if there is a more efficient way to handle the traffic flow; also, is it possible to indicate "no left turns" during certain time periods? Stan Wade, Construction Engineer stated that we have recognized the problems; we have consulted our traffic staff and the contractor and between everyone, we came up with the present traffic plan. Wade explained the project to the Committee, noting that we are on schedule; he stated that as far as the trucks making left hand turns they are moving with the signals at the intersections. Clark stated that part of the problem is that the trucks are turning into the businesses and not going to the intersections. Wade said we can't keep them out of going into their businesses. Clark stated that the traffic is also backing up at the railroad tracks and asked if there is something further we can do there. Wickstrom said we will look into the situation again. CITIZEN COMPLAINT REGARDING SIGNAL TIMING (PAUL MANNI Mann referenced a letter of complaint to the editor regarding the timing of our traffic signals.
