2. SUMMARY STATEMENT: This hearing was postponed to this date by
City Council action on April 5, 1988 . The hearing will consider
an appeal of the Hearing Examiner ' s denial of Goodwin
Professional Center conditional use permit No . CE-87-5 . The
request was for a conditional use permit to allow retail uses for

Request for Property Purchase - Scenic Way_
Mr. Bigford stated he has recently discovered that part of his
driveway and his oil tank are located on property that belongs to
the City of Kent immediately adjacent to his property. Mr. Bigford
requested he be allowed to purchase an 8-foot strip of the City' s
property which abuts his . Wickstrom explained the property in
question is utility property and in order to sell it it must be
declared surplus and put out for bids. The costs involved in this
process would exceed the value of the property. Johnson inquired
if an easement would be better. Wickstrom indicated he would have
concerns about the City' s liability if an easement were granted.
Mr . Bigford stated he would be willing to assume the costs of
appraisal and advertising involved in order for the property to be
put up for bid. McCaughan indicated the cost of an appraisal could
be as much as $1500. It was determined that staff should consult
with the City Attorney to determine the proper procedure in order
to sell the property.

Regular meeting of the Kent City Council was called to order at 7: 00
p.m. by Mayor Kelleher. Present: Councilmembers Biteman, Dowell,
Houser, Johnson, Mann and Woods, City Administrator McFall , City Attorney
Driscoll, Planning Director Harris, Public Works Director Wickstrom and
Finance Director McCarthy. Also present: Police Chief Frederiksen,
Fire Chief Angelo, Personnel Director Webby and Corrections Facility
Administrator Linville. Councilmember White was not in attendance.
Approximately 15 people were at the meeting.
PERSONNEL Corrections Officers. Corrections Facility Admini-
strator Linville introduced Al Williams and Dennis
Baumgardner who are new Corrections Officers.
Employee of the Month. Helen Wickstrom announced
that Lori Hogan, Superintendent of Recreation, has been
selected as the Employee of the Month for April.
She noted that Hogan has worked for the City in the
Parks Department in various capacities for the past
seventeen years .
PROCLAMATIONS National Community Development Week. Mayor Kelleher
declared the week of April 2 through 9, 1988 as
National Community Development Week in the City of
Kent.
Spring Rally Clean-Up Week. Mayor Kelleher read a proclama- .
tion proclaiming the week of April 16 through 24,
1988 as "Getting Ready for Centennial ' 89 Spring
Rally Clean-Up Week" in the City of Kent.
CONSENT CALENDAR BITEMAN MOVED that Consent Calendar Items A through Q
be approved, with the exception of Item G which was
removed by Councilmember Dowell, and Item O which
was removed by Councilmember Biteman. Johnson
seconded and the motion carried.

SANITATION Centerpointe - Bill of Sale. ACCEPTANCE of the bill
of sale and warranty agreement for continuous opera-
tion and maintenance for approximately 60 feet of
water main extension, 45 feet of sanitary sewer
extension, 1220 feet of street improvements and
24 feet of storm drainage improvements constructed
in the vicinity of 72nd Avenue South and South 180th
for Centerpointe, and release of the cash bond after
expiration of the one year maintenance period.

Stonecreek Apartments - Bill of Sale. ACCEPTANCE
of the bill of sale and warranty agreement for con-
tinuous operation and maintenance for approximately
75 feet of water main extension and 92 feet of sani-
tary sewer extension constructed in the vicinity of
S. 252nd Street and 100th S.E. and release of the
cash bond after expiration of the one year main-
tenance period.

Ahamay Estates - Bill of Sale._ ACCEPTANCE of the
bill of sale and warranty agreement for continuous
operation and maintenance for approximately 574 feet
of water main extension and 525 fet of sanitary
sewer extension constructed in the vicinity of S.E.
252nd Street and 119th Place S.E. for Ahamay Estates
and release of the cash bond after expiration of
the one year maintenance period.
KDA REQUEST Dee Eklund, President-Elect of the Chamber of Com-
FOR FUNDS merce, asked that the City support the Chamber' s
application for funds to the Washington State Local
Development Matching Fund Program, Department of
Community Development. The Chamber ' s proposal is in
conjunction with Kent Downtown Association, which
has committed $3 , 000 of the $20 , 800 project. $3 ,000
has been requested from private business and $5, 000
is requested from the City of Kent Economic Develop-
ment Corporation. It was determined that the Council
could not authorize expenditure of EDC funds , but
could make recommendations to the Board.
Dowell, a Board member of EDC, questioned a past
contribution to KDA and Burpee stated that the City
had appropriated $9 , 500 and that the EDC contributed
$10, 000. $7, 000 of the EDC funds had been used for
a shoppers survey, $500 financed a meeting in Wenat-
chee and the remaining $2 , 500 was slated for a

KDA REQUEST brochure on marketing for downtown Kent. HOUSER
FOR FUNDS MOVED for the City Council to endorse the grant
application of the Kent Chamber of Commerce for
funds to conduct market and transportation research
in Kent, and that the Chamber 's request for $5, 000
from the City of Kent EDC as a portion of local matching
funds be referred to the Economic Development Corpor-
ation with a favorable recommendation in writing
for their consideration. Woods seconded and the
motion carried, with Dowell and Biteman abstaining
since they are EDC Board members.
COMMUTER RAIL (CONSENT CALENDAR ITEM 3Q)
Funds for Rail Study. ADOPTION of Resolution 1165,
appropriating $50 , 000 for a multi-jurisdictional study
of commuter rail transit in King County and author-
izing the Mayor to enter into negotiations with
other cities and the county for an interlocal agree-
ment to provide for such a study.
STREETS E. Smith St. /E. Walnut St. Storm Drainage Improve-
ments. Bid opening was held March 21 with fifteen
bids received. The low bid was submitted by Site-
Con in the amount of $66, 960. 15 . The Director of
Public Works recommends that the bid from Site-Con
be accepted. JOHNSON SO MOVED. Houser seconded
and the motion carried.
TRAFFIC CONTROL Fourth Avenue Traffic Signal Modifications. Bid
opening was held on March 31 with two bids received.
In accordance with the recommendation of the Public
Works Director, JOHNSON MOVED that the low bid of
U. D.L. , Inc. in the amount of $70, 314 . 50 be accepted.
Woods seconded. Motion carried.
PUBLIC SAFETY (CONSENT CALENDAR ITEM 3D)
Police/Fire Training Center. ADOPTION of Resolution
1162 amending the Capital Improvement Program and
reserving $950, 000 of councilmanic debt capacity
for 1989 to complete the Police/Fire training center.
SURPLUS PROPERTY (CONSENT CALENDAR ITEM 3E)

ADOPTION of Resolution 1163 setting the public
hearing date of April 19 , 1988, to consider the
declaration of certain property located at 520

SURPLUS PROPERTY (CONSENT CALENDAR ITEM 3H)
Surplus Property - Vicinity of 102nd Avenue S.E.
and S.E. 240th. AUTHORIZATION to declare as surplus
a parcel of 50 ' x 50 ' in the vicinity of 102nd
Avenue S.E. and S.E. 240th Street and to offer same
for sale at fair market value and to direct the
City Attorney to prepare the resolution setting the
public hearing date for May 3, 1988.
HOUSING AND 1989 Community Development Local Program Policies.
COMMUNITY This date has been set for a public hearing on the
DEVELOPMENT 1989 Community Development Local Program Policies.
It is necessary to readopt Kent ' s CDBG Program
Policies each year. A description of the local
strategies for the use of CDBG funds has been dis-
tributed and made a part of the record. The 1989
program policies are similar to the 1988 policy docu-
ment and the 1989 estimated funds for the City of
Kent are $165 , 354. After adoption by the Council
the policies will be forwarded to the King County
Planning and Community Development Division and
incorporated into the 1989 King County Community
Development Block Grant Consortium Policy Plan.
The public hearing was opened by Mayor Kelleher.
Dan Stroh of the Planning Department described the
proposed policies noting that due to the annexations
last year the amount of the funds estimated for
1989 has increased by approximately $5, 000. He
noted that in the Human Services category, additional
services have been added to the health care services.
He pointed out also an increased emphasis on the low
income areas. King County Rape Relief has stressed
need for low cost counselling services and the YWCA
has noted the continued need for emergency shelter
programs.
There were no comments from the audience and the
public hearing was closed. Woods noted that the
Human Services Committee and the Planning Committee
had reviewed the policies and had recommended approval.
She MOVED to approve the 1989 Community Development
Local Program Policies as recommended. Dowell
seconded and the motion carried.
(CONSENT CALENDAR ITEM 3M)
1985 Community Development Block Grant Fund Transfer.
AUTHORIZATION to approve close out of 1985 Community
Development Block Grant Crime Prevention Program
and transfer the $2 , 353 balance of remaining funds

HOUSING AND to the 1987 Housing Repair Program. This will
COMMUNITY bring both Crime Prevention and other housing repair
DEVELOPMENT activities under a single umbrella.
1989 Community Development Block Grant Funds. The
City Council needs to consider three actions in
order to receive 1989 CDBG block grant funds: ( 1 )
elect to receive "pass-through" funds, ( 2 ) allocate
15% of funds for public (human) services, ( 3 ) allo-
cate 15% of planning and administration. Woods
noted that the Planning Committee had reviewed this
matter and recommended approval. She then MOVED
to approve the three actions. Biteman seconded and
the motion carried.
CONDITIONAL Goodwin Professional Center No. CE-87-5 - Appeal.
USE APPEAL The applicant has requested that this hearing be
postponed to the April 19th meeting and the Council
concurred.
REZONES (CONSENT CALENDAR ITEM 3F)
1424 Investments Rezone (RZ-87-3) . ADOPTION of
Ordinance 2774 rezoning the 1424 Investment property
from MHP, mobile ho;ma park, to GC, general commercial .
The conditions imposed have been fulfilled.
United Truck Lines Rezone RZ-87-4. This date has
been established to consider the Hearing Examiner ' s
recommendation to deny the request by United Truck
Lines to rezone property from CM, commercial manu-
facturing, to M2, limited industrial. The property
is located at 8801 South 218th Street. WOODS MOVED
to adopt the findings of the Hearing Examiner and
to concur with the Hearing Examiner ' s recommendation
of denial of RZ-87-4. Johnson seconded and the motion carried.
(CONSENT CALENDAR ITEM 3G)
REMOVED BY COUNCILMEMBER DOWELL
Trans-Canada Enterprises Property Rezone (RZ-81 -2) .
ADOPTION of Ordinance 2775 rezoning the certain pro-
perty of the Trans-Canada Enterprises from RA,
residential agricultural to MR-M, medium density
-. multifamily residential . The conditions imposed
have been fulfilled.
Upon Dowell ' s question Harris displayed a map of
the area. He noted that in 1981 the Council had
approved the rezone of this 8. 5 acre parcel from RA
to MRM, with certain conditions which have now been
fulfilled. He noted that under this zoning, between

HOUSING AND 400 and 500 units would be permitted for the entire
COMMUNITY development, with four acres reserved for open space,
DEVELOPMENT and parking and access to the river provided to the
public. The new development standards would apply
for property located next to single family zoning
and he pointed out that since much of the property
is situated near the river, ample setbacks are
required.
Dowell noted that he hoped that the design standards
would be ample to ensure a quality development as
this is the entryway to the city.
Carolyn Wagemans noted from the audience that this
unique parcel, almost entirely surrounded by the
river, should be left in open space or developed as
a park. Woods pointed out that when this rezone
was approved in 1981 , the adjacent property, also
a part of this development, was already zoned MRM.
She noted that the cost of acquiring multi-zoned
property was prohibitive. Dowell pointed out that
the City had just purchased park property at Lake
Fenwick. DOWELL THEN MOVED to adopt Ordinance 2775
approving the rezone. Biteman seconded and the
motion carried.
INSURANCE (CONSENT CALENDAR ITEM 3N)
Washington Cities Insurance Authority Interlocal
Agreement Amendment. ADOPTION of Resolution 1164
which amends certain portions of the interlocal
agreement creating the Washington Cities Insurance
Authority.
ANIMAL CONTROL (CONSENT CALENDAR ITEM 3C)
Interlocal Agreement with King County for Animal
Control. AUTHORIZATION to renew the interlocal
agreement with King County for animal control from

RECREATION REMOVED BY COUNCILMEMBER BITEMAN
Golf Course Financing. AUTHORIZATION to establish
a golf course construction fund budget and to trans-
fer $50, 000 budgeted for Mill Creek Trail and $250 , 000
budgeted for Kent Commons parking into the River-
front acquisition account to be used for golf course
land acquisition. The golf course budget will pro-
vide $5, 250 , 220 for land, building, improvements and
equipment. These improvements will be paid for with

PARKS AND revenue bonds and the sale of approximately five
RECREATION acres of property contiguous to the golf course
site. One parcel of property along Green River
will be paid for with the combined Riverfront acquis-
ition, Mill Creek Trail and Commons parking funds.
Biteman asked about the bridge cost and location.
Helen Wickstrom and Leroy Charff, the architect,
explained that the proposed bridge would cost $205, 000
including site development, plus $30, 000 for the
guard rails, that it would accomodate golfers with
carts, joggers and bikes , which the existing pedes-
trian bridge would not. Charff noted that it was
not feasible to place the bridge closer to Frager
Road under the State regulations and due to the
alignment of Frager Road. It was noted that the
Parks Committee and Operations Committee had recom-
mended that this item be approved. HOUSER MOVED
to approve the financing as presented. Woods
seconded and the motion carried.

Riverbend Golf Course Well Drilling Project. ACCEPT-
ANCE of the well drilling project as complete and
release of retainage to Hokkaido Drilling and

Resolution No. adopted by City Council on April 19 , 1988
established May 17 , 1988 for the public hearing on LID 333 . All
of this was the result of a petition received in October 1987 and
subsequent contact with property owners which indicated
sufficient support.
PROPOSED IMPROVEMENT
The project is the installation of a traffic signal including the
required work to interconnect the signal with the other City
signals for proper coordination.
PROJECT COST
The total project cost is estimated at $130, 000 . The project
will be funded 100 percent by the L. I . D.
METHOD OF ASSESSMENT
The assessment is based on property size, location of the
property with respect to the new signal and other alternate
outlets from the area and potential use of the property.
All properties which require use of the intersections at
190th/west Valley Highway, 188th/West Valley Highway and
72nd/180th St. for access are included in the L. I . D. boundary.
The assessment calculation is based on square footage with
several adjustment factors .
1. The assessment rate varies with the properties closer to the
signal being higher.
2 . Parcels #1 and #3 have alternate access which does not
require use of the intersections involved. Therefore a
portion of these properties is deleted from the assessment
calculation.

3 . Parcels #4 and #13 received approval from the City to allow
a greater amount of office space than would normally be
allowed under the zoning code. With the higher density of
office space these properties will generate approximately
twice the number of peak hour trips. Therefore a weight
factor of 2 was applied to their assessment calculation.
4 . A portion of the project area is being assessed for the
signal at 190th and West Valley Highway. Now that 72nd
Avenue is connected through to the north, additional
properties in the project area can use the West . Valley
Highway signal . Since the service areas for both of the
signals is the same, all properties should pay for both.
This can be accomplished in the new L. I. D. The $12 , 824 . 41
assessed within the project area under L. I . D. 328 for the
West Valley Highway signal is redistributed to everybody in
the new L. I.D. , then a credit is given to those assessed
under L. I . D. 328 .
PAYMENT OF ASSESSMENT
Upon Council passing the Ordinance confirming the final
assessment roll (after completion of the construction) , there is
a 30-day period in which any portion or all of the assessment can
be paid without interest charges. After the 30-day period, the
balance is paid over a ten year period wherein each year' s
payment is 1/10th of the principal plus interest on the unpaid
balance. The interest will be what the market dictates.
NEED FOR IMPROVEMENT
With the heavy traffic flow on S. 180th St. it is very difficult
to enter the roadway from 72nd Ave S . or turn left into 72nd Ave.
S . With the ever increasing amounts of traffic the situation
will only become worse. Several of the developers in the area
recognized this problem and petitioned the City for the
installation of a traffic signal in an effort to protect their
property value and promote their developments. As an example of
the need, the developers of the new Centerpointe project at the
southeast corner of the intersection, have told us that the lack
of a signal at the intersection is discouraging prospective
tenants . They view the signal as being very important for the
success of their project.

RESOLUTION NO.
A RESOLUTION of the City Council of the City of
Kent, Washington, declaring its intention to order
-• the installation of a traffic signal at the
intersection 72nd Avenue South and South 180th Street
within the City and to create a local improvement
district to assess the cost and expense of carrying
out such improvement against the properties specially
benefited thereby, and notifying all persons who
desire to object to the improvements to appear and
present their objections at a hearing before the City
Council to be held on May 17, 1988.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KENT,
WASHINGTON, as follows:
Section 1. It is the intention of the City Council of the
City of Kent, Washington, to order the improvement of the
properties within the area described in Exhibit A, attached
hereto and by this reference made a part hereof, by the
installation of a traffic signal at the intersection of 72nd
Avenue South and South 180th Street, including interconnecting
the signal with the overall traffic signal system of the City.
All of the foregoing improvements shall be in accordance
with the plans and specifications therefor prepared by the City
Engineer and may be modified by the City as long as such
modification does not affect the purpose of the improvement.
Section 2. The total estimated cost and expense of the
improvement is declared to be $130,000 and the entire cost and
expense thereof shall be borne by and assessed against the
property specially benefited by such improvement to be included
in a local improvement district to be established embracing as
nearly as practicable all the property specially benefited by
the improvement.
Section 3. All persons who may desire to object to the
improvement described herein are notified to appear and present
such objections at a hearing before the City Council to be held
in the Council Chambers in the City Hall in Kent, Washington, at
7:00 p.m. , local time, on May 17, 1988, which time and place are
fixed for hearing all matters relating to the proposed
improvement and all objections thereto and for determining the
method of payment for the improvement. All persons who may
desire to object thereto should appear and present their
objections at such hearing. Any person who may desire to file a
written protest with the City Council may do so within thirty
days after the date of passage of the ordinance ordering the
improvement in the event the local improvement district is
formed. Such written protest should be signed by the property
owner, should include the legal description of the property for
which the protest is filed and should be delivered to the City
Clerk.
Section 9 . The City Clerk is authorized and directed to
give notice of the adoption of this resolution and of the date,
time and place fixed for the public hearing to each owner or
reputed owner of any lot, tract, parcel of land or other
property within the proposed local improvement district by
mailing such notice at least fifteen days before the date fixed
for public hearing to the owner or reputed owner of the property
as shown on the tax rolls of the King County Department of
Finance at the address shown thereon, as required by law. The
City Clerk is directed to keep on file and make available for
public perusal a list of the owners or reputed owners receiving
such notice.
This resolution also shall be published in at least two
consecutive issues of the official newspaper of the City, the
date of the first publication to be at least fifteen days prior
to the date fixed for the public hearing.

Section 5. The City's Director of Public Works is directed
to submit to the City Council on or prior to May 17, 1988, all
data and information required by law to be submitted.

Each property serviced is being assessed. Since each lot is a
single family residential lot each receiving one service, the
benefit is equal for all parcels. Therefore, the cost is evenly
spread over all lots within the L. I .D.

NEED FOR IMPROVEMENT
The project location is a developed residential area composed of
single family lots on septic tanks. For years, it has been known
that the septic systems in the general Derbyshire area function
poorly or not at all . However, previous attempts to install sewers
have failed. -
It has been reported that within the Derbyshire area that some
residents have made illegal connections to the storm drains to
avoid the consequence of a failing septic system. Residents report
that there is raw sewage on the surface of the ground and that
septic odor is a real widespread problem.
The Seattle-King County Department of Public Health has identified
various failing septic systems within the general area. These
problems are a threat to everybody who lives in the area. Most of
the problems are not repairable and are expected to become worse
and more widespread. The only economically feasible alternative is
to install a public sewer system.

It is our understanding that one house within Derbyshire No. 7 has
been vacated by order of the Seattle-King County Health Department
until sewers become available. It was estimated that for this
particular house the cost of a septic system reconstruction would
exceed the cost of the sanitary sewer LID assessment.
As the situation deteriorates further, more people will probably be
removed from their homes.
Knowing the severity of the problem, property owners within
Derbyshire No. 7 came to the City to request sanitary sewers. The
Engineering Department requested that a petition be circulated. A
petition for sewers was received with 22 signatures out of 26
properties which was sufficient to proceed with the formation
process.
REVIEW BOARD APPROVAL
This proposed L. I.D. is outside of the City limits but is within
the City' s sewer franchise area. However, final approval of this
specific project by the King County Boundary Review Board will be
required. To satisfy the Review Board, the City will require each
person applying for a sewer permit to execute a "Petition for
Annexation and Declaration of Covenant" . This means that in the
case of an annexation attempt the property will be counted as a
"yes" vote and once enough covenants have been signed an annexation
could proceed. The covenant procedure is an alternative to
requiring actual annexation prior to formation of the L. I . D. and
expedites the sewer installation.

any lot, tract, parcel of land or other property outside of the
proposed local improvement district that is required by the
Federal Housing Administration as a condition of loan
qualification to be connected to the proposed improvements, by
mailing such notice at least fifteen days before the date fixed
for the public hearing to the owner or reputed owner of the
property as shown on the tax rolls of the King County Department
of Finance at the address shown thereon, as required by law.
The City Clerk is directed to keep on file and make available
for public perusal a list of the owners or reputed owners
receiving either notice.
This resolution also shall be published in at least two
consecutive issues of the official newspaper of the City, the
date of the first publication to be at least fifteen days prior
to the date fixed for the public hearing.
Section 5. The City's Director of Public Works is directed
to submit to the City Council on or prior to May 17, 1988, all
data and information required by law to be submitted.

RESOLUTION NO.
A RESOLUTION of the City Council of the
City of Kent, Washington, declaring city
utility property, in the vicinity of S.E. 240th
and 102nd Streets, located in Kent, to be
surplus to the City's needs and not required
for continued public utility services; and
setting a public hearing pursuant to RCW
35.94.040 for May 5, 1988.
WHEREAS, the City Council confirmed the Public Works
Committee recommendation to declare the property described in
Exhibit A situated in Kent in King County, Washington, as _surplus
to the City's needs and not required for providing continued
public utility services; and
WHEREAS, RCW 35.94.040 requires a public hearing before
the City may cause such property to be sold and conveyed; and
WHEREAS, an appraisal in the amount of $2,500.00 has been
obtained by the Department of Public Works; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF KENT, WASHINGTON DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The property described in Exhibit A and
incorporated herein by this reference situated in Kent in King
County, Washington is no longer required for continued public
utility service and is surplus to the City's needs.
Section 2. A public hearing is set for May 5, 1988 at
7 p.m. in the Kent City Hall.
Section 3. Notices of said hearing shall be placed at

Wickstrom reviewed the list of equipment to be declared surplus and
sold at auction. He added that the City of Snohomish is interested
in purchasing the vibratory roller. He requested the equipment be
offered for sale at state auction with the exception that the
vibratory roller be sold to the City of Snohomish at its appraised
value. The Committee concurred with the request.
Lead Mechanic
Wickstrom explained the position of Maintenance Supervisor in
Equipment Rental has been redefined to that of lead mechanic which
better meets the division's needs by putting more mechanics on the
floor. The Committee concurred with the redefinition.
LID 333 Traffic Signal 72nd and S . 180th Street
Wickstrom explained the process that has been taken in developing
the LID boundary. There have been several meetings with the
property owners. It appears the project is now acceptable to the
majority of the property owners within the project boundary. The
area is zoned industrial but there is one remaining single family
residence within the boundary. Johnson asked if the signal would
be interconnected with the one at 180th and WVH. Wickstrom
responded it would be interconnected with the City' s system. The
Committee approved proceeding with the creation of the LID.

appraised the roller with a value of $700 . 00 .
I doubt that we could recover $700 . 00 at the auction , and request
your approval to sell the roller to the City of Snohomish for the
appraised value.

If you recall when we finalized the L.I . D. for the above referenced
improvement we did so with the knowledge that a claim from the
contractor remained outstanding. The L.I .D. was finalized anyway
to cap the project' s interim financing costs ($96, 000/year) which
would become overwhelming should the settlement drag out over
years . It was also finalized with the knowledge that a
supplemental assessment roll could be levied to cover the final
" settlement amount if deemed appropriate. It now appears that a
settlement is imminent at about $75 , 000. The funds remaining
within the project fund are inadequate and, as such, it is
•- recommended that $32 , 000 be transferred from the unencumbered
sewerage funds to compensate therefor. Assuming that this
settlement is finalized, it is then also recommended that we not
pursue the supplemental assessment roll option as the costs
associated therewith would probably add another $10, 000 to $15, 000
thereto and we are a major property owner anyway.
Lastly , as additional information , we have an outstanding
supplemental grant application for FADS funding to fund a portion
of this claim settlement. While we will pursue same, our potential
for success is minimal .

RE: Clark Springs Improvement
Over a two year period, $296, 000 was budgeted to make improvements
to both the Clark Springs Well Facilities and the Clark Springs
Transmission Main Pressure Control System. These improvements were
directly overseen and managed by our Public Works Operation
Manager. With his departure, the status thereof was reviewed. The
initial conclusion based on his obvious approval of additional work
was that the project budget would be overrun. With completion of
the Clark Springs Well Facilities work, the final amount of the
overage is $47, 000.
While change orders are synonymous with construction projects, the
direct management in the future will not be a function of the
Operation Division.
It is my recommendation that $47 , 000 of the unencumbered fund
balance of the water utility be allocated to this project fund to
compensate for the overrun.

Examiner, the following findings of fact and conclusions shall
constitute the recommendation of the Hearing Examiner on this

FINDINGS OF FACT
1. The applicant, Wayne Potter, Barghausen Engineers, Agent for
owners, request a rezone from M2, Limited Industrial, to MRM,
Medium Density Multifamily Residential, under application #RZ-88-

5. The developer proposes to provide a total of 255 spaces for RV's
covering approximately 49 percent of the site by impervious

6. The Kent Shoreline Master Program designates the subject site as
an "Urban" environment.
7. In 1979 there was a shoreline management permit approved to
develop a parking lot, storage area, and storm detention pond.
This development never occurred and the site currently is vacant.
8. Surrounding land uses in the vicinity include a mixture of
industrial and some residential uses. Unfortunately, several
wrecking and salvage yards have developed east of the railroad
tracks which are in unincorporated King County. South of the
site there is a large storage/staging area for new automobiles
which arrive via trains and are then transported to dealers by
truck. Currently, south of the auto storage yard is a
distribution center for Pay N Pak stores. The Green River is
located to the north of the site. As indicated previously, to
the west is the Valley Freeway.
9 . The site is relatively flat and covered with native shrubs and
grasses. A formal landscaping will be required upon development.
10. There are existing water and sanitary sewer lines available to
serve the subject site.
11. The subject property has access to S. 262nd Street which is
classified as a local access. The street has a public right-of-
way width of 60 feet and actual width of paving of 24 feet. At
the time of the public hearing hereon, the applicant' s
representative made several comments with respect to the
conditions on the SEPA Determination of Nonsignificance.
However, as the applicant is aware, SEPA conditions have an
entirely different appeal process and are not properly before the

undersigned in connection with the three applications .
Accordingly, the comments from the applicant's agent with respect
to the SEPA conditions will not be considered.
12 . The staff report, with its recommendation of conditional approval
is incorporated herein by reference as though set forth in full.
CONCLUSIONS
1. The City of Kent Zoning Code sets forth a series of criteria
which must be established by the evidence prior to the time that
rezone can be recommended.
2 . Specifically, the proposed rezone must be consistent with the
Comprehensive Plan. The proposed rezone is consistent with the
Comprehensive Plan designation of the site as multifamily
residential.
3 . Further, the proposed rezone and subsequent development of the
site must be compatible with development in the vicinity. The
only possible conflict would be the storage areas located south
of S. 262nd Street. However, given the transitory nature of the
use intended by the applicant, it is unlikely that there would be
a significant conflict.
4 . Further, the proposed rezone must, not unduly burden the
transportation system in the vicinity. Given the traffic
mitigation conditions required in the mitigated Determination of
Nonsignificance the proposed rezone will not unduly burden the
transportation system.
5. Further, an applicant must establish that circumstances have
changed substantially since the establishment of the current
zoning district to warrant the proposed rezone. Since 1973 when
the initial Zoning Code was adopted, the popularity of
recreational vehicles have increased considerably with some
fluctuations based upon gasoline prices and availability. The
City of Kent has few facilities available to serve the needs of
recreational vehicle users and this proposed park will provided a
needed service in Kent.
6. Further, it must be established that the proposed rezone will not
adversely affect the health, safety, and general welfare of the
City of Kent. The Fire Department has indicated that it is
extremely difficult to respond to the vicinity with fire engines
because of the low train trestles. However, given the fact that
the Fire Department will keep a record of this difficulty and
will respond using another route, coupled further with the fact
that it would appear that aid cars would have to respond to the
site more frequently than fire engines, this criteria is

established by the evidence. The evidence establishes that aid
cars could pass underneath the trestle.
RECOMMENDATION
For each of the above reasons, the recommendation of the Hearing
Examiner on the requested rezone is Conditional Approval, subject to
the following conditions:
1. The developer shall execute a signal participation agreement for
the future construction of a traffic signal system at the
intersection of the northbound on-ramp of SR 167 and S. 277th
Street.
2. Approval of this rezone is tried directly to the Kantor RV Park
site and landscape plans submitted as a part of this application.
Any significant changes to the plans will require a new public
hearing.

The second item on the agenda was a public hearing to consider the
request by Barghausen Consulting Engineers , Inc . ,
18215 72nd Avenue S. , Kent, WA 98032, for a project known as Kantor
Recreational Vehicle Park for A) rezone of property from M2, Limited
Industrial, to MRM, Medium Density Multifamily Residential; B) a
mobile home park combining district to allow the development of a
recreational vehicle park; and C) a shoreline substantial development
permit to allow the construction of a recreational vehicle park within
200 feet of the Green River. The property is located north of
S. 262nd Street, east of the Valley Freeway (SR 167) and is
approximately 14 acres in size.
(1-900) Greg McCormick, Kent Planning Department, presented the staff
report. View foils were shown depicting 1) location of the site, and
2) zoning of the site and surrounding zoning. A video of the site was
shown.
Some of the goals and objectives of the City-wide Comprehensive Plan
were mentioned. Further, portions of the Shoreline Management Plan
were mentioned. The project falls under the review of the Green River
Corridor Special Interest District regulations. It appears to be
consistent with the regulations.
The site is currently zoned M2, Limited Industrial. The property has
access to S. 262nd Street, which is classified as a local access
street.
Two criteria of the seven required for rezone review were addressed.
The Fire Department expressed concern regarding access to the site by
the fire and aid trucks. Staff recommends approval with conditions.
(1-1711) Gary Gill, Public Works Department, commented the figure for
peak hour trips is about . 25 for each recreation vehicle stall. There
would be 255; that would be approximately three daily trips per stall.
Ms. VanDerbeek asked for comments from the applicant.

( 1 -1794 ) Dana Mower , Barghausen Consulting Engineers ,
18215 72nd Avenue S. , representing the applicant. Mr. Mower commented
about the amenities that would be available to people at the park. A
topographic and boundary survey have been completed on this property.
Mr. Mower requested modification to the setback information. The
applicant is asking for the right to develop within 200 feet of the
Green River. However, applicant would like the setback changed to
11100 to 150 feet from the ordinary high water mark" .
Further, Mr. Mower requested that on page 5, condition #4 containthe
words "bond or construct and overlay" for S. 262nd Street. It is felt
that at the present time it is not necessary to upgrade the street.
In regard to the access easement, if it can be located anywhere, the
applicant would like to have the ability to locate the easement so it
would fit into the theme of the park. Mr. Mower asked that the
following wording be added to Item #1: the assessment shall be based
upon the calculated pro rata share of total traffic at the
intersection. On page 10, item 2, applicant would like to insert the
word "conceptual" on the second line between "park" and "site" . The
additional change could also as follows: Minor site plan
modifications related to a final boundary and topographic survey shall
be allowed.
(1-2288) David Kantor, Orcas Island, WA, applicant, thanked staff for
the assistance they have given him. He felt that there would not be
as much traffic as stated in the staff report.
Ms. VanDerbeek asked for rebuttal comments.
(2-70) Mr. McCormick stated that listed in the Shoreline Master
Program is the requirement for a 150 foot average setback from the
ordinary high water mark. The proposed development would be reviewed
for compliance with those regulations. Staff would not contest the
modification in the condition concerning minor modifications to the
site plan. Staff feels that the rezone should be related directly to
the construction of the RV park and that if a different scenario is
planned, the new scenario should be returned to the Hearing Examiner
for a recommendation.
(2-158) Ms. McClung commented that in order for the City to be able to
enforce any condition, the condition has to be stated as such in the
ordinance.
(2-183) Mr. Gill commented the signal participation agreement takes
the amount of traffic at the time the traffic warrants are met, the
percentage of the approach volume attributed to each specific parcel
and then the property owner' s cost towards putting in the signal is

obtained. Thus, the amount paid by each property owner is a
percentage attributable to the traffic volume of each property.
However, Mr. Gill did not feel the language in the condition needed to
be changed since the agreement itself is are quite specific.
There was no further public testimony.

A. Description of the Proposal
The applicant is requesting a rezone from M2, Limited
Industrial, to MRM, Medium Density Multifamily Residential.
This rezone request is made in conjunction with a request for
a Mobile Home Park Combining District, which would allow the
development of a recreational vehicle park and a shoreline
residential development permit which would allow development
to occur within 200 feet of the Green River.
B. Location
The property is on the north side of S. 262nd Street and
bounded to the east by a Puget Sound Power & Light Company
right of way, west by SR 167 .
C. Size of Property
The property is approximately 14 acres in size.
D. Zonina
The property is currently zoned M2, Limited Industrial.
E. Comprehensive Plan
The City of Kent first adopted a City-wide Comprehensive Land
Use Plan in 1969. The goals, objectives and policies of the
- Comprehensive Plan represent an expression of community
intentions and aspirations concerning the future of Kent and

the area within the Sphere of Interest. The Comprehensive
Plan is used by the Mayor, City Council, City Administrator,
Planning Commission, Hearing Examiner and City departments to
guide growth , development, and spending decisions .
Residents, land developers, business representatives and
others may refer to the plan as a statement of the City's
intentions concerning future development.
The City of Kent has also adopted a number of subarea plans
that address specific concerns of certain areas of the City.
Like the City-wide Plan, the subarea plans serve as policy
guides for future land use in the City of Kent. The subject
property is within the Valley Floor Plan subarea. This Plan
also consists of goals, objectives, and policies which apply
to the area and is used in concert with the City-wide
Comprehensive Plan. The following is a review of each of the
above plans as they relate to the proposed rezone.
CITY-WIDE COMPREHENSIVE PLAN
HUMAN ENVIRONMENT
OVERALL GOAL: ASSURE KENT RESIDENTS AN AESTHETIC AND
HEALTHFUL ENVIRONMENT.
GOAL 1: Maximize the aesthetic qualities of Kent's natural
and manmade environments.
Objective 2 : Encourage a high degree of aesthetic
quality in the manmade environment.
Policy 1: Require that new construction and
improvements be designed and built so as to
enhance the quality of the neighborhood in
which it is located.
Planning Department Comment
The developer of the proposed recreational vehicle park has
designed a large water feature to provide both storm water
detention and a recreational amenity for the users of the
park. Also, noise baffling walls, extensive landscaping, and
a minimum setback from the Green River of 150 feet will
enhance the appearance of this project and minimize the
project's impact on the Green River.

" GOAL 4 : Assure adequate and suitable residential
developments.
" Objective 1: Provide for planned residential development
between industrial areas and the Green
River.
Policy 3 : Permit higher densities when developer
provides open space or other amenities.
Planning Department Comment
This project would provide a transition from the Green River
on the north and the industrial zoned lands to the south.
The developer is required to setback an average of 150 feet
from the Green River. This provides a large open space
between the development and the river. This large open space
in conjunction with the large water features designed for the
site should provide a pleasant environment for users of the
park and be of minimal impact on the river and its environs.
II. HISTORY
A. Site History
This site was part of a 378 acre annexation in 1959 . There
is no indication that the site has ever been developed. In
1979, George Xenos requested a shoreline management permit
(#SMA-79-5) to develop a parking lot, storage area, and storm
detention pond. This request was conditionally approved.
However, this development never took place and the site
remains vacant.
B. Area History
The area generally east of the Valley Freeway in the vicinity
of the proposed RV park has been developed with a mixture of
industrial uses and some residential uses. Several auto
wrecking/salvage yards have been developed east of the
railroad tracks which are east of the proposed park. These
operations are not within the City limits of Kent, but are in
unincorporated King County. South of the site is a large
storage/staging area for new automobile which arrive by train
and are then taken to local dealers by truck. south of the
auto storage yard is the distribution center for the Pay-N-
Pak stores in the region.

III. LAND USE
The subject property is currently vacant. Adjacent land uses
include:
North: the Green River.
South: A vehicle storage/staging operation for new cars and
trucks arriving by rail.
East: Union Pacific Railroad and Puget Power & Light Company
right of way.
West: The Valley Freeway (SR 167) .
IV. ENVIRONMENTAL CONCERNS
A. Environmental Assessment
A Final Declaration of Nonsignificance was issued on
January 15, 1988 with the following conditions:
1. Provide a Type II landscaping, and a minimum 6 ' high
noise baffling wall along the westerly property.
Landscaping shall include planting Lombardy poplars or
similar type of fast-growing tree planted a minimum of
20 foot on center.
2 . Provide a 6' noise baffling wall along the easterly
property to shield project from adjacent railroad right-
of-way. Provide a 5 ' landscape strip of Type III
landscaping along the interior of the easterly noise
baffling wall.
3 . The developer of the Kantor Recreational Vehicle Park
shall do a traffic study to identify all traffic impacts
upon the City of Kent road network and traffic signal
system. The study shall identify all intersections at
level of service "E" or "F" or which will be at level of
service "E" or "F" due to increased traffic volumes from
the development. These intersections are at a threshold
level for traffic mitigation.
The study shall then identify what improvements are
necessary to mitigate the development impacts thereon.
Upon agreement by the City with the findings of the
study and mitigations measures outlined in the study,
implementation and/or construction of said mitigation
measures shall be the conditional requirement of the
issuance of the respective development permits.

a. In lieu of conducting the above traffic study,
constructing and/or implementing the respective
mitigation measures hereby, the developer may agree
to the following conditions to mitigate the traffic
impacts due to the Kantor Recreational Vehicle Park
development.
The developer shall execute an environmental
mitigation agreement in the form of a no-protest LID
agreement to participate in the formation of an LID
to construct the South 272nd/277th Street corridor
project . The minimum benefit to the above
development is estimated at $66, 216 based upon 62
p.m. new peak hour trips entering and leaving the
site and the capacity of the South 272nd/277th
Street corridor.
The execution of this agreement will serve to
mitigate traffic impacts to the above mentioned
intersections and road system by committing funding
for the South 272nd/277th Street corridor which will
provide additional capacity for traffic volumes
within the area of the above mentioned development.
4 . Overlay S. 262nd Street for entire frontage of property
with a 2" asphalt concrete pavement and necessary
pavement markings, etc. Provide a minimum pavement
width of 24 feet.
5. Execute a no protest LID covenant for the future
widening and improvement of S. 262nd Street to collector
street standards.
6. Quit Claim Deed to the City of Kent for the entire
property frontage thereon, what is believed to be the
existing 60 ' right-of-way for S. 262nd Street.
7 . Provide an as built survey by a licensed land surveyor
locating the ditch along the westerly property line with
respect to the property. Grant to the City, an easement
for drainage purposes for that portion of said drainage
ditch plus a 15 ' wide maintenance road on both sides
thereof, as measured perpendicular and parallel to the
top of the bank which lies within the property.
8 . Provide biofiltration of storm water prior to releasing
to the drainage ditch or the river.
9 . Provide an as built survey by a licensed land surveyor
of the levee improvements along the Green River for the
entire property frontage thereon.

10. Grant to the City, an easement for levee and
recreational purposes from approximately a line measured
ten feet southerly from the toe of the levee on the
landward side to the northerly property line of this
property.
B. Significant Physical Features
1. Topography and Hydrology
The site is flat with less than a three percent slope.
There are no apparent hydrologic problems on the site.
As part of the site design for this project, a small
pond and canoe and paddle boat canal has been
incorporated which will act as the storm water detention
system for the site.
2 . Vegetation
The site is currently covered with native shrubs and
grasses with small groves of deciduous trees scattered
throughout the site.
C. Significant Social Features
1. Street System
The subject property has access to S. 262nd Street which
is classified as a local access. The street has a public
right-of-way width of 60 feet while the actual width of
paving is 24 feet. The street is improved with two
lanes of asphalt paving. The average daily traffic
count on the street is not available.
2 . Water System
An existing 12-inch water main line is available to
serve the subject property. The existing mains are
located along S. 262nd Street and along the easterly
property line.
3 . Sanitary Sewer System
An existing 72-inch sanitary sewer truck line is
available to serve the subject property. The Metro
trunk line is located along the west property line.
4 . Storm Water System

A storm water system is necessary to accommodate the
proposed development. The adequacy of the on-site
detention system will be evaluated at the time of
development plan review.
5. LID's
None at this time.
V. CONSULTED DEPARTMENTS AND AGENCIES

VI. PLANNING DEPARTMENT REVIEW
The Planning Department has reviewed this application in relation
to the Comprehensive Plan, present zoning, land use, street
system, flood control problems and comments from other departments
and finds that:
A. Both the City-wide Comprehensive Plan Map and the Valley
Floor Plan Map designate the subject property as MF,
Multifamily Residential.
B. The site is presently zoned M2 , Limited Industrial .
C. This site is bordered on the north by the Green River, on the
east by a railroad and power company right of way, west by
the Valley Freeway (SR 167) , and to the south is a vehicle
storage yard.
D. The property has access to S. 262nd Street which is
classified as a local access street.
E. There are no apparent flood control problems on the site.

F. A rezone shall only be granted after the Hearing Examiner has
reviewed the proposed change to determine if it is in
compliance with the following standards and criteria. These
standards are provided for in the Kent Zoning Code Section
15. 09.050 A3 and are listed below:
1. The proposed rezone is consistent with the Comprehensive
Plan.
2 . The proposed rezone and subsequent development of the
site would be compatible with development in the
vicinity.
3 . The proposed rezone will not unduly burden the
transportation system in the vicinity of the property
with significant adverse impacts which cannot be
mitigated.
4 . Circumstances have changed substantially since the
establishment of the current zoning district to warrant
the proposed rezone.
5. The proposed rezone will not adversely affect the
health, safety and general welfare of the citizens of
the City of Kent.
The staff has responded to these statements and made the
following findings.
1. The proposed rezone is consistent with the Comprehensive
Plan.
Planning Department Finding
Both the City-wide and the Valley Floor Plan Map designate
the site as MF, Multifamily Residential. Rezoning this
property to MRM, Medium Density Multifamily Residential, will
implement the Comprehensive Plans.
2 . The proposed rezone and subsequent development of the
site would be compatible with development in the
vicinity.
Planning Department Finding
The site is bordered on two sides (east and west) by manmade
features (SR 167 an railroad right of way) and to the north
by the Green River. The only land use in the area which may
conflict with this use is the storage areas located south of
S. 262nd Street. It is not anticipated, however, that this

use will negatively impact the existing use to the south.
3. The proposed rezone will not unduly burden the
transportation system in the vicinity of the property
with significant adverse impacts which cannot be
mitigated.
Planning Department Finding
The City's transportation engineer has estimated that the
proposed RV park will generate an additional 622 daily trips
to the site with an additional 62 p.m. peak hour trips.
Several mitigation conditions were required in the Mitigated
Determination of Nonsignificance issued for this project
which are anticipated to address the impacts of this
development on the transportation system in the vicinity.
4 . Circumstances have changed substantially since the
establishment of the current zoning district to warrant
the proposed rezone.
Planning Department Finding
The site was part of an annexation that occurred in 1959. At
the time of annexation, the property was zoned MI Light
Industrial. With the adoption of the existing Zoning Code,
the site was rezoned to M2, Limited Industrial. Since 1973,
very little development has occurred immediately adjacent to
the site because of the natural and manmade constraints.
However, north of the Green River, industrial park type of
developments such as the Kent Center have been built.
_._ In the 15 years since the zoning was established for this
area, the popularity of recreational vehicles such as travel
trailers and motor homes has grown markedly. Kent has few
facilities to accommodate such vehicles. The development of
a park such as this will provide a needed service for the
Kent area.
5. The proposed rezone will not adversely affect the
health, safety and general welfare of the citizens of
the City of Kent.
Planning Department Finding
The Kent Fire Department comments that this area is extremely
difficult to respond to with fire engineers because of the
low train trestles. Fire engines would have to travel south
on SR 167, exit at the 277th ramp, and then access the site
form the south. AID cars would not have access problems to
the site.

The rezone and subsequent development of this property is not
anticipated to adversely affect the health, safety or general
welfare of the citizens of Kent.
VII. CITY STAFF RECOMMENDATION
The City staff has reviewed the requested rezone and based on the
merits of this request and the Code criteria for granting a
rezone, staff recommends that this request by Conditionally
Approved. The staff recommends that the following conditions
apply:
1. The developer shall execute a signal participation agreement
for the future construction of a traffic signal system at the
intersection of the northbound on-ramp of SR 167 and S. 277th
Street.
2 . Approval of this rezone is tried directly to the- Kantor RV
Park site and landscape plans submitted as a part of this
application. Any significant changes to the plans will
require a new public hearing.

INTRODUCTION
After due consideration of the evidence presented by the applicant,
all evidence elicited during the public hearing, and as a result of
the personal inspection of the subject property by the Hearing
Examiner, the following findings of fact and conclusions shall
constitute the recommendation of the Hearing Examiner on this
application.
FINDINGS OF FACT
1. The applicant, Wayne Potter, Barghausen Engineers, Agent for
owners, request a rezone from M2, Limited Industrial, to MRM,
Medium Density Multifamily Residential, under application #RZ-88-
1; a shoreline substantial development permit under application

application #CD-MHP-88-1.
2 . Each of the aforementioned applications would permit the
development of a recreational vehicle park on property which is
located within 200 feet of the Green River.
3 . The subject site is located on the north side of S. 262nd Street
and bounded to the east by a Puget Power & Light Company right of
way and to the west by SR 167.
4 . The property is approximately 14 acres in size and is currently
zoned M2, Limited Industrial.
5. The developer proposes to provide a total of 255 spaces for RV' s
covering approximately 49 percent of the site by impervious
surfaces. The development would provide an average setback of
150 feet along the river.
6. The Kent Shoreline Master Program designates the subject site as
an "Urban" environment.
7 . In 1979 there was a shoreline management permit approved to
develop a parking lot, storage area, and storm detention pond.
This development never occurred and the site currently is vacant.
8 . Surrounding land uses in the vicinity include a mixture of
industrial and some residential uses. Unfortunately, several
wrecking and salvage yards have developed east of the railroad
tracks which are in unincorporated King County. South of the
site there is a large storage/staging area for new automobiles
which arrive via trains and are then transported to dealers by
truck. Currently, south of the auto storage yard is a
distribution center for Pay N Pak stores. The Green River is
located to the north of the site. As indicated previously, to
the west is the Valley Freeway.
9. The site is relatively flat and covered with native shrubs and
grasses. A formal landscaping will be required upon development.
10. There are existing water and sanitary sewer lines available to
serve the subject site.
11. The subject property has access to S. 262nd Street which is
classified as a local access. The street has a public right-of-
way width of 60 feet and actual width of paving of 24 feet. At
- the time of the public hearing hereon, the applicant's
representative made several comments with respect to the
conditions on the SEPA Determination of Nonsignificance.
However, as the applicant is aware, SEPA conditions have an
entirely different appeal process and are not properly before the

undersigned in connection with the three applications .
Accordingly, the comments from the applicant's agent with respect
to the SEPA conditions will not be considered.
12. The staff report, with its recommendation of conditional approval
is incorporated herein by reference as though set forth in full.
CONCLUSIONS
1. The requested recreational vehicle park development complies with
the goals and policies of the Comprehensive Plan and the
Shoreline Master Program for the City of Kent.
2 . The use is compatible with adjacent land uses in the vicinity and
provided that it is developed pursuant to the site plan, the
proposed development will comply with the recommended zoning on
the site.
RECOMMENDATION
For each of the above reasons, the recommendation of the Hearing
Examiner is conditional approval subject to the following condition:
The property shall be developed substantially as shown on
the plan submitted with the application. Major revisions
from the plan shall be returned to the Hearing Examiner for
further review.

The second item on the agenda was a public hearing to consider the
request by Barghausen Consulting Engineers , Inc . ,
18215 72nd Avenue S. , Kent, WA 98032, for a project known as Kantor
Recreational Vehicle Park, for A) rezone of property from M2, Limited
Industrial, to MRM, Medium Density Multifamily Residential; B) a
mobile home park combining district to allow the development of a
recreational vehicle park; and C) a shoreline substantial development
permit to allow the construction of a recreational vehicle park within
200 feet of the Green River. The property is located north of
S. 262nd Street, east of the Valley Freeway (SR 167) and is
approximately 14 acres in size.
(1-900) Greg McCormick, Kent Planning Department, presented the staff
report. View foils were shown depicting 1) location of the site, and
2) zoning of the site and surrounding zoning. A video of the site was
shown.
Some of the goals and objectives of the City-wide Comprehensive Plan
were mentioned. Further, portions of the Shoreline Management Plan
were mentioned. The project falls under the review of the Green River
Corridor Special Interest District regulations. It appears to be
consistent with the regulations.
The site is currently zoned M2, Limited Industrial. The property has
access to S. 262nd Street, which is classified as a local access
street.
Two criteria of the seven required for rezone review were addressed.
The Fire Department expressed concern regarding access to the site by
the fire and aid trucks. Staff recommends approval with conditions.
(1-1711) Gary Gill, Public Works Department, commented the figure for
peak hour trips is about . 25 for each recreation vehicle stall. There
_.. would be 255; that would be approximately three daily trips per stall.
Ms. VanDerbeek asked for comments from the applicant.

( 1-1794 ) Dana Mower , Barghausen Consulting Engineers ,
18215 72nd Avenue S. , representing the applicant. Mr. Mower commented
about the amenities that would be available to people at the park. A
topographic and boundary survey have been completed on this property.
Mr. Mower requested modification to the setback information. The
applicant is asking for the right to develop within 200 feet of the
Green River. However, applicant would like the setback changed to
11100 to 150 feet from the ordinary high water mark" .
Further, Mr. Mower requested that on page 5, condition #4 containthe
words "bond or construct and overlay" for S. 262nd Street. It is felt
that at the present time it is not necessary to upgrade the street.
In regard to the access easement, if it can be located anywhere, the
applicant would like to have the ability to locate the easement so it
would fit into the theme of the park. Mr. Mower asked that the
following wording be added to Item #1: the assessment shall be based
upon the calculated pro rata share of total traffic at the
intersection. On page 10, item 2 , applicant would like to insert the
word "conceptual" on the second line between "park" and "site" . The
additional change could also as follows: Minor site plan
modifications related to a final boundary and topographic survey shall .
be allowed.
(1-2288) David Kantor, Orcas Island, WA, applicant, thanked staff for
the assistance they have given him. He felt that there would not be
as much traffic as stated in the staff report.
Ms. VanDerbeek asked for rebuttal comments.
(2-70) Mr. McCormick stated that listed in the Shoreline Master
Program is the requirement for a 150 foot average setback from the
ordinary high water mark. The proposed development would be reviewed
for compliance with those regulations. Staff would not contest the -
modification in the condition concerning minor modifications to the
site plan. Staff feels that the rezone should be related directly to
the construction of the RV park and that if a different scenario is
planned, the new scenario should be returned to the Hearing Examiner
for a recommendation.
(2-158) Ms. McClung commented that in order for the City to be able to
enforce any condition, the condition has to be stated as such in the
ordinance.
(2-183) Mr. Gill commented the signal participation agreement takes
the amount of traffic at the time the traffic warrants are met, the
percentage of the approach volume attributed to each specific parcel
and then the property owner' s cost towards putting in the signal is

-- obtained. Thus, the amount paid by each property owner is a
percentage attributable to the traffic volume of each property.
However, Mr. Gill did not feel the language in the condition needed to
be changed since the agreement itself is are quite specific.
There was no further public testimony.

The City of Kent first adopted a City-wide Comprehensive Land
Use Plan in 1969. The goals, objectives and policies of the

intentions and aspirations concerning the future of Kent and

the area within the Sphere of Interest. The Comprehensive
Plan is used by the Mayor, City Council, City Administrator,
Planning Commission, Hearing Examiner and City departments to
guide growth , development, and spending decisions .
Residents, land developers, business representatives and
others may refer to the plan as a statement of the City's
intentions concerning future development.
The City of Kent has also adopted a number of subarea plans
that address specific concerns of .certain areas of the City.
Like the City-wide Plan, the subarea plans serve as policy
guides for future land use in the City of Kent. The subject
property is within the Valley Floor Plan subarea. This Plan
also consists of goals, objectives and policies which apply
to the area and is used in concert with the City-Wide
Comprehensive Plan. The following is a review of the above
Plans as they relate to the proposed combining district.
CITY-WIDE COMPREHENSIVE PLAN
HOUSING ELEMENT
OVERALL GOAL: INCREASE THE RESIDENTIAL POPULATION IN KENT,
ASSURING A DECENT HOME AND SUITABLE LIVING ENVIRONMENT FOR
FAMILIES DESIRING TO LIVE IN KENT.
GOAL 3 : Assure an adequate and balanced supply of housing
units offering a diversity of size, densities, age, style,
and cost.
Objective 2 : Encourage the production of a variety of
new dwelling units.
Policy 2 : Provide for mobile home parks.

Allowing the requested mobile home park would provide a
facility for recreational vehicles which, at the present time
facilities such as this are in short supply on the valley
floor. While these parks provide temporary housing, this
development would encourage a variety of housing
opportunities for people choosing to visit the Kent Valley.

Planning Department Comment
The Comprehensive Plan Map recognizes this site as a suitable
area for multifamily development by designating it as MF,
- Multifamily. This area is served by adequate city water and
sewer services. The Fire Department commented that due to
low railroad trestles in the area fire truck access would
have to come from the south to access the site, however, Fire
Department aid vehicles could readily access the site.
II. HISTORY
A. Site History
This site was part of a 378 acre annexation in 1959. There
is no indication that the site has ever been developed. In
1979, George Xenos requested a shoreline management permit
(#SMA-79-5) to develop a parking lot, storage area, and storm
detention pond. This request was conditionally approved.
However, this development never took place and the site
remains vacant.
B. Area History
The area generally east of the Valley Freeway in the vicinity
of the proposed RV park has been developed with a mixture of
-- industrial uses and some residential uses. Several auto
wrecking/salvage yards have been developed east of the
railroad tracks which are east of the proposed park. These

IV. ENVIRONMENTAL CONCERNS
A. Environmental Assessment
A Final Declaration of Nonsignificance was issued on
January 15, 1988 with the following conditions:
1. Provide a Type II landscaping, and a minimum 6 ' high
noise baffling wall along the westerly property.
Landscaping shall include planting Lombardy poplars or
similar type of fast-growing tree planted a minimum of
20 foot on center.
2 . Provide a 6 ' noise baffling wall along the easterly
property to shield project from adjacent railroad right-
of-way. Provide a 5 ' landscape strip of Type III
landscaping along the interior of the easterly noise
baffling wall.
3 . The developer of the Kantor Recreational Vehicle Park
shall do a traffic study to identify all traffic impacts
upon the City of Kent road network and traffic signal
system. The study shall identify all intersections at
level of service "E" or "F" or which will be at level of
service "E" or "F" due to increased traffic volumes from
the development. These intersections are at a threshold
level for traffic mitigation.
The study shall then identify what improvements are
necessary to mitigate the development impacts thereon.
Upon agreement by the City with the findings of the
study and mitigations measures outlined in the study,
implementation and/or construction of said mitigation
measures shall be the conditional requirement of the
issuance of the respective development permits.
a. In lieu of conducting the above traffic study,
constructing and/or implementing the respective

mitigation measures hereby, the developer may agree
to the following conditions to mitigate the traffic
impacts due to the Kantor Recreational Vehicle Park
development.
The developer shall execute an environmental
mitigation agreement in the form of a no-protest LID
agreement to participate in the formation of an LID
to construct the South 272nd/277th Street corridor
project . The minimum benefit to the above
development is estimated at $66, 216 based upon 62
p.m. new peak hour trips entering and leaving the
site and the capacity of the South 272nd/277th
Street corridor.
The execution of this agreement will serve to
mitigate traffic impacts to the above mentioned
intersections and road system by committing funding
for the South 272nd/277th Street corridor which will
provide additional capacity for traffic volumes
within the area of the above mentioned development.
4 . Overlay S. 262nd Street for entire frontage of property
with a 2" asphalt concrete pavement and necessary
pavement markings, etc. Provide a minimum pavement
width of 24 feet.
5. Execute a no protest LID covenant for the future
widening and improvement of S. 262nd Street to collector
street standards.
6. Quit Claim Deed to the City of Kent for the entire
property frontage thereon, what is believed to be the
existing 60 ' right-of-way for S. 262nd Street.
7 . Provide an as built survey by a licensed land surveyor
locating the ditch along the westerly property line with
respect to the property. Grant to the City, an easement
for drainage purposes for that portion of said drainage
ditch plus a 15' wide maintenance road on both sides
thereof, as measured perpendicular and parallel to the
top of the bank which lies within the property.
8 . Provide biofiltration of storm water prior to releasing
to the drainage ditch or the river.
9 . Provide an as built survey by a licensed land surveyor
of the levee improvements along the Green River for the
entire property frontage thereon.

10. Grant to the City, an easement for levee and
recreational purposes from approximately a line measured
ten feet southerly from the toe of the levee on the
landward side to the northerly property line of this
property.
B. Significant Physical Features
1. Topography and Hydrology
The site is flat with less than a three percent slope.
There are no apparent hydrologic problems on the site.
As part of the site design for this project, a small
pond and canoe and paddle boat canal has been
incorporated which will act as the storm water detention
system for the site.
2 . Vegetation
The site is currently covered with native shrubs and
grasses with small groves of deciduous trees scattered
throughout the site.
C. Significant Social Features
1. Street System
The subject property has access to S. 262nd Street which
is classified as a local access. The street has a public
right-of-way width of 60 feet while the actual width of
paving is 24 feet. The street is improved with two
lanes of asphalt paving. The average daily traffic
count on the street is not available.
2 . water System
An existing 12-inch water main line is available to
serve the subject property. The existing mains are
located along S. 262nd Street and along the easterly
property line.
3 . Sanitary Sewer System
An existing 72-inch sanitary sewer truck line is
available to serve the subject property. The Metro
trunk line is located along the west property line.

4 . Storm Water System
A storm water system is necessary to accommodate the
proposed development. The adequacy of the on-site
detention system will be evaluated at the time of
development plan review.
5. LID' s
None at this time.
V. CONSULTED DEPARTMENTS AND AGENCIES
The following departments and agencies were advised of this
application:

In addition to the above, all persons owning property which lies
within 200 feet of the site were notified of the application and
of the March 16, 1988 public hearing.
Staff comments have been incorporated in the staff report where
applicable.
VI . PLANNING DEPARTMENT REVIEW
The Planning Department has reviewed this application in relation
to the Comprehensive Plan, present zoning, land use, street
system, flood control problems and comments from other departments
and finds that:
A. Both the City-wide Comprehensive Plan Map and the Valley
Floor Plan Map designate the subject property as MF,
Multifamily Residential.
B. The site is presently zoned M2, Limited Industrial.
C. This site is bordered on the north by the Green River, on the
east by a railroad and power company right of way, west by
the Valley Freeway (SR 167) , and to the south is a vehicle
storage yard.
D. The property has access to S. 262nd Street which is
classified as a local access street.

E. There are no apparent flood control problems on the site.
F. The City of Kent has adopted a Recreational Vehicle Park
Code. This proposal has been reviewed in light of the RV
Park Code and has determined that the plan is in conformance
with the Code.
VII. CITY STAFF RECOMMENDATION
The City staff has reviewed the requested Mobile Home Park
Combining District in light of applicable Code criteria and upon
discussion of the merits of the request and recommends that this
request be granted with the following conditions:
1. The property shall be developed substantially as shown on the
plan submitted with this application. Major revisions from
the plan shall be returned to the Hearing Examiner for
further review.

1989 COMMUNITY DEVELOPMENT BLOCK GRANT
-.- Lin Ball presented the funding options for the 1989 CDBG program. The
revised estimate for Kent's share of CDBG funding is $170, 000. The
Committee agreed with staff' s recommendations as follows:
1) Elect to receive pass-through funds
2) Allocate 15% of funds for public (human) services
3) Allocate 6% of funds for planning and administration.
These recommendations will be forwarded to the City Council at their
meeting this date. Further, the Mayor will read a proclamation at
tonight' s meeting declaring this week National Community Development
Week. There is a display on this topic on the first floor of City
Hall.
Jim Harris confirmed for Councilman Dowell that the Human Services
Commission recommends the use of human services funds from both the
General Fund and the CDBG funds.
ADDED ITEMS
Chairwoman Woods set April 19 , 1988 as the meeting date to discuss 20%
multifamily density. The meeting will be held at 3 : 30 PM in the
Library next to City Hall.
Fred Satterstrom stated that currently the Planning Department is
working on two other projects that will impact the multifamily density
issue. One is the Planned Unit Development ordinance and the other is
the Central Business District Subarea Plan Update. The CBD Task Force
has been reviewing a revision of the CBD Plan's goals and policies and
map and have expanded the geographic scope of the CBD to include
north/south boundaries of James and Willis and east/west boundaries of
SR 167 and Jason Street. CBD Task Force recommendations will include
creation of a special multifamily zoning district to recognize

urbanization of the CBD with perhaps greater densities and greater
development standards. The Task Force is also recommending that mixed
use designations be placed on several properties in the CBD. The Task
Force recommendation should be going forward to the Planning Commission
at the latest sometime in early May. The mission of a committee
created to look at the PUD ordinance is to work out problems with the
ordinance and get it into a workable form to forward to the Planning
Commission and City Council .
The 20% graduated scale reduction option is only part of the direction
given by the City Council to the Planning Department in Resolution No.
1145. Overzoned areas of the City need to be addressed as well (Option
C) . However, staff thought the best approach was to look first at
zoning district density levels as a whole and then look at rezoning;
decisions on rezoning properties might be different depending on the
outcome of the decision on multifamily zoning densities. Rezones are
heard before the Kent Hearing Examiner. Discussion occurred on
approaches the City Council could take in considering all three issues
of PUD, CBD, and 20% multifamily reduction.
In response to Jim Hansen, Chairwoman Woods indicated the meeting on
April 19th would be conducted so that everyone would have an
opportunity to provide input. The Committee will ask questions. No
decision will be made at the April 19th meeting. Staff will provide
information prior to the meeting.
The meeting was adjourned at approximately 4 : 45 PM.

CANTERBURY FAIRE SLIDE SHOW
' Thorell showed a slide presentation of the Canterbury Faire which she has shown
sponsors, service clubs and boys and girl scouts, etc. Over 1 ,000 people have
seen the show which is used to solicit volunteers and donations. There will be
a Canterbury Faire meeting next Thursday, April 7, at 5:30 in the Council
Chambers. Volunteers are solicited.
RIVERBEND GOLF COURSE STRUCTURES BIDS
Wickstrom advised that 6 bids were received for the support structures. Charf
reviewed the Pease bid (low bidder when alternates combined with base bid) ,
breakdown as follows:

Wilson noted that the push button traffic signal was needed and that item would
come out of next year's budget. Dick King reviewed Shearson Lehman Brothers'
financial breakdown and said he could attend the April 5 Council meeting if
necessary. Wickstrom advised that it would be necessary to transfer $50,000
from the Mill Creek Trail and $250,000 budgeted for Kent Commons Parking into
the Riverfront Acquisition Account to be utilized for Golf Course land
acquisition. It was requested that both items be placed on the consent
calendar; unanimous approval was given by Council members.
SENIOR CENTER BY-LAWS
McFall explained that there had been two proposals, one from the existing
Senior Center Advisory Council and another from a group called the Concerned
Citizens of Kent. He had met with both groups and recommended to the Committee
the following compromises to the Senior Advisory Council By-Laws.
1 . Membership in Advisory Council - All members must be registered
participants for a minimum of 30 days.
2. Facility Manager would be an exofficio member.
3. Among the officers would be an elected secretary; the staff administrative
secretary would not be an exofficio member. The duties of the secretary
would be to record and prepare minutes, records of attendance and maintain
all records of the Advisory Council .
4. Change wording to read that the nominating council shall list, not select,
all candidates.
5. Qualifications: 55 years of age and a registered participant for 30 days.
Eligibility for voting also 30 days.
6. Nominations to be posted (with resume) .
7. A majority plus one to allow an amendment to the by-laws.
McFall clarified that secret ballots would be used for elections and pointed
out that vertification of votes could be covered in Operating Rules and
Procedures.

A concern was voiced regarding the 30 days requirement; it was felt that this
was not long enough. Johnson pointed out that the seniors could decide from
the resumes whether a nominee had been a member long enough. One senior wanted
to note that she was 100% behind the staff and was concerned about role of new
Advisory Council .
Dowell complimented all participants of the meeting on their diplomacy and
explained that the Advisory Committee was "advisory" in nature and did not set
policy. Woods recommended that future differences be handled within the
context of the Senior Center Program and said that she had complete confidence
in staff and volunteers, and felt it was the finest Senior Center in the area
if not in the state.
It was moved and seconded that the Parks Committee approve the bylaws with the
above changes and change the name to the "Senior Advisory Committee," instead
of Council (so this body would not be confused with City Council ) ;
- Administration was directed to implement same. This motion passed unanimously.
